DV 2023 AOS (Adjustment of Status) Only

but the problem is that i's only two months left to the end of FY.
1. if my FO is considering waiving interviews for complete documents at the end of FY, is there a high likelihood that timing for an interview or RFE exceeds the FY, or in other words how was the experience of cases with a similar issue(missing document+ late FO review) in previous years on average?
2. Is there an additional action you would recommend that I can take to accelerate the review of my documents ?

I am really worried that late review of my documents leads to rejection. Appreciate it if you can help me. Thanks!

1. I have no recollection of any similar case in the past. Majority of the applicants send in a complete and properly front-loaded application - which is what I’ve always recommended, it guards against situations such as the one you’ve found yourself.
2. There’s really no additional meaningful action I can recommend at this point, considering they’ve acknowledged an awareness of your case. Of course you can always send the FO a direct mail at this point if you want to have the satisfaction of doing something.

After receiving your LPR, is it safe to apply for program such as FAFSA, Food stamp, etc.? Or does that make you a public charge ?

I am one of the Egyptian winners of DV-2023 with the case number 2023AF16XXX. I am writing to inquire about the possibility of processing the Adjustment of Status (DV AOS) before the conclusion of the DV year.

Since the March 2023 bulletin, my case number has been current for an interview at the US Embassy in Abu Dhabi. However, I have not yet received an interview confirmation due to perceived underperformance issues at the embassy. As the DV lottery year is nearing its end by 30th September, I am aware of the urgency to initiate the AOS process promptly.

Currently residing in Dubai, I can make arrangements to be in the United States by 10th August for the process. Thus, I seek your guidance to determine the likelihood of successfully completing the DV AOS within the allotted timeframe.

Could you kindly inform me if there is a chance to process the DV AOS before the conclusion of the DV year using attorney services?

Oh wow! Sorry to learn there's been no movement on your case considering one other case from your FO (@Azani), filed after you already completed their interview. I'm beginning to think you might be stuck in AP due to pending background check clearance. Is your line of study/work experience Technology Alert List (TAL) related?

By the way, @Azani, do you mind sharing your interview experience, and confirm if you've received your GC, for the benefit of others folks from your FO who are still waiting?
It actually is not, I am conducting research in psychiatric neuroscience. One of the issues I am facing is that I had an I-612 application (for the waiver of INA212) that was approved in June 2022, but I was never mailed an Approval notice due to a service error. And I had to file an I-824 to get a copy of that approval which is pending for 340+ days now. I am afraid (but not sure) that might be causing the delay. I hope the congressional inquiry will help resolve this quickly. The inquiry is for both the I-824 and the I-485.

I’m sorry I cannot discuss the potential of a successful AOS application in this case because of the fact that you’re currently not inside the US. Coming into the US on a NIV with a preconceived intent of filing for AOS is frowned upon, it is actually considered a fraudulent attempt at obtaining an immigration benefit. As such, this is not a conversation I can engage in.

Oh! I see. There are underlying issues that needs to be addressed before your AOS application can be approved. Thank you for providing the additional details. I’ll continue to keep my fingers crossed for you and hope you make it through.

I received an RFE letter requesting the completed Form I-693, which includes the report of my medical examination and vaccination record. Surprisingly, I had already sent it in my I-485 package. Dealing with my civil surgeon has been quite bothersome as it took them a whole month to provide me with the report using the new form with mistakes in vaccination part. However, I thoroughly reviewed the copy they gave me to ensure everything was in order.
  1. I wonder why they are asking me to submit it again?
  2. Should I visit a new surgeon to obtain a fresh report, or is it sufficient to ask my previous surgeon for another copy of my medical report?

I finally went ahead and did a congressional inquiry. Today, the case status reads "New Card is being produced".

It has been 3 weeks since my interview and still no update plus they have not replied my congress office. This is getting so stressful.

1. Without seeing the actual RFE or the full content of the RFE, I cannot hazard a guess as to why you got the RFE.
2. Either way is fine, it’s your call.

The inquiry should have gone to your FO.

Yes, I received the biometric letter on Monday and walked in to the office the following day and completed the process. I've already updated my timeline.

Hi Sm1mom, we received our green card. I updated the timeline spreadsheet. After filing our I-485 application on January 6th and giving biometrics on February 1st we did not hear any useful/reliable update for our case. Whenever we contacted USCIS they said our case is at NBC and processing under normal processing conditions. We set an appointment with a tier 2 agent to call us back but we never received that call. Finally, in May we initiated a congressional inquiry and waited one month. After one month we followed up with the congressman's office but still, they had not heard an update from USCIS. However, the congressman's office reinitiated the inquiry with USICS, and after one week congressman's office gave us an update that our case is pending at the Nashville field office and will schedule an interview in the near future. Before we heard this update we sent a letter to the Nashville field office explaining our situation. We don't know whether that had shed light on our case. One week after the letter delivery to the field office and congressional office update, we received the interview letter. Honestly saying we had given up our case at that point. We did not have much time to prepare but we prepared ourselves fully for the interview.
My husband and I had the interview at 7 am. We were the only ones in the field office at that time. The interview lasted ~30-40 minutes. The interview officer was pleasant and professional. First IO asked for our names, birth dates, birthplaces, current addresses, previous addresses, and SSN numbers. Then IO went through all the yes and no questions with us together. Then IO checked our original birth and marriage certificates (translations and originals from our native language) and passports. At the end of the interview, IO said our case will get approved. After 3 hours of interview, our cases changed from biometrics taken to new cards being produced. Then we received the approval notice first from the mail. Then within two weeks, we received the green cards.

There was a lot of useful information I abstract from this forum to follow up on our case such as initiating congressional inquiry and sending letters to the field office. I wish all who are still waiting to receive the interview or GC to get them soon. We know how stressful this process is. Sorry for taking the time to give this update. Congratulations on successfully completing your AOS journey and thank you for sharing your updates and interview experience, I’m sure someone else will find this useful.

For the benefit of other readers, I would like to point out the letter you wrote to the FO (which was a good idea to do at that point) did not play a role in the interview letter being issued/received considering both letters happened within a one week period. Considering the bureaucracy involved, as in the process your letter will have to go through when it gets delivered to the mailroom in your FO before it gets through to the right personnel that can act on it (if authorized to do so), and the number of days it typically takes USCIS mail to get delivered by the UPS, it is not possible for the letter to have resulted in the IL being issued and received within a week.
