DV 2023 AOS (Adjustment of Status) Only

It actually is not, I am conducting research in psychiatric neuroscience. One of the issues I am facing is that I had an I-612 application (for the waiver of INA212) that was approved in June 2022, but I was never mailed an Approval notice due to a service error. And I had to file an I-824 to get a copy of that approval which is pending for 340+ days now. I am afraid (but not sure) that might be causing the delay. I hope the congressional inquiry will help resolve this quickly. The inquiry is for both the I-824 and the I-485.

I’m sorry I cannot discuss the potential of a successful AOS application in this case because of the fact that you’re currently not inside the US. Coming into the US on a NIV with a preconceived intent of filing for AOS is frowned upon, it is actually considered a fraudulent attempt at obtaining an immigration benefit. As such, this is not a conversation I can engage in.

Hi Mom,

I received an RFE letter requesting the completed Form I-693, which includes the report of my medical examination and vaccination record. Surprisingly, I had already sent it in my I-485 package. Dealing with my civil surgeon has been quite bothersome as it took them a whole month to provide me with the report using the new form with mistakes in vaccination part. However, I thoroughly reviewed the copy they gave me to ensure everything was in order.
  1. I wonder why they are asking me to submit it again?
  2. Should I visit a new surgeon to obtain a fresh report, or is it sufficient to ask my previous surgeon for another copy of my medical report?

I finally went ahead and did a congressional inquiry. Today, the case status reads "New Card is being produced".

Congratulation. One question regarding congressional inquiry, @Sm1smom Do congress directly send message to field office or NVC? My congress representative sent my inquiry to visa center. It has been 3 weeks since my interview and still no update plus they have not replied my congress office. This is getting so stressful.

2. Either way is fine, it’s your call.

The inquiry should have gone to your FO.

Yes, I received the biometric letter on Monday and walked in to the office the following day and completed the process. I've already updated my timeline.
 
Oh wow! Sorry to learn there's been no movement on your case considering one other case from your FO (@Azani), filed after you already completed their interview. I'm beginning to think you might be stuck in AP due to pending background check clearance. Is your line of study/work experience Technology Alert List (TAL) related?

By the way, @Azani, do you mind sharing your interview experience, and confirm if you've received your GC, for the benefit of others folks from your FO who are still waiting?
Hi Sm1mom, we received our green card. I updated the timeline spreadsheet. After filing our I-485 application on January 6th and giving biometrics on February 1st we did not hear any useful/reliable update for our case. Whenever we contacted USCIS they said our case is at NBC and processing under normal processing conditions. We set an appointment with a tier 2 agent to call us back but we never received that call. Finally, in May we initiated a congressional inquiry and waited one month. After one month we followed up with the congressman's office but still, they had not heard an update from USCIS. However, the congressman's office reinitiated the inquiry with USICS, and after one week congressman's office gave us an update that our case is pending at the Nashville field office and will schedule an interview in the near future. Before we heard this update we sent a letter to the Nashville field office explaining our situation. We don't know whether that had shed light on our case. One week after the letter delivery to the field office and congressional office update, we received the interview letter. Honestly saying we had given up our case at that point. We did not have much time to prepare but we prepared ourselves fully for the interview.
My husband and I had the interview at 7 am. We were the only ones in the field office at that time. The interview lasted ~30-40 minutes. The interview officer was pleasant and professional. First IO asked for our names, birth dates, birthplaces, current addresses, previous addresses, and SSN numbers. Then IO went through all the yes and no questions with us together. Then IO checked our original birth and marriage certificates (translations and originals from our native language) and passports. At the end of the interview, IO said our case will get approved. After 3 hours of interview, our cases changed from biometrics taken to new cards being produced. Then we received the approval notice first from the mail. Then within two weeks, we received the green cards.

There was a lot of useful information I abstract from this forum to follow up on our case such as initiating congressional inquiry and sending letters to the field office. I wish all who are still waiting to receive the interview or GC to get them soon. We know how stressful this process is. Sorry for taking the time to give this update. Congratulations on successfully completing your AOS journey and thank you for sharing your updates and interview experience, I’m sure someone else will find this useful.

For the benefit of other readers, I would like to point out the letter you wrote to the FO (which was a good idea to do at that point) did not play a role in the interview letter being issued/received considering both letters happened within a one week period. Considering the bureaucracy involved, as in the process your letter will have to go through when it gets delivered to the mailroom in your FO before it gets through to the right personnel that can act on it (if authorized to do so), and the number of days it typically takes USCIS mail to get delivered by the UPS, it is not possible for the letter to have resulted in the IL being issued and received within a week.
 
time is running out ... is there anything i can do till i get my Receipt ? shall i file without receipt?

That’s your call. I asked you a couple of questions which you obviously haven’t been able to answer. Knowing the right answers to those questions will provide better insight into your situation.

1. This is the latest edition of 03/09/2023. It took longer for them to complete my form because I requested the latest edition from them and this was her first time to complete this edition and she was not familiar with it.
2. I checked a copy without signatures that they provided, and I notice 2 mistakes in the vaccination section, they fixed it and then it looked fine.

Okay. It’s possible the Lockbox did not properly scan the medical report when your package was received, or it somehow got misplaced hence the RFE. This sometimes happens.

Also, I sent a letter to my fo explaining the issue of visa cut-off that was delivered on 07/19 but it didn't affect my case till now. I saw in an earlier post yesterday you told Azani that a week is not enough after the delivery of your letter to play a role in getting the il.

1. There's no specific number of days, it can take as long as they need to before responding.
2. Maybe same place you sent you email response to, or be patient. They will get back to you when they have a response.
3. That is an internal process. Like any big organization, there will be certain steps/process an unsolicited mail (especially one not addressed to a specific person by name) will need to go through - it can take as long as needed, or could basically end up in the shred bin once the mail room opens it considering it is an unsolicited mail.

p.s. this is the reason I typically do not openly discuss or advocate folks send out letters to their FOs after filing, unless this is under a rather dire circumstance. Most folks read about sending unsolicited letters to the FOs and immediately jump at doing the same thing as soon as they file. The FOs do not appreciate receiving general and unsolicited mail, and more often than not, do not act on them.
 
Hi... I finally got a response from the LA county congressional inquiry, and this what they said:

Hello Mr. XXXX,

Our inquiry to the Los Angeles Field Office was forwarded to the National Benefits Center. I have included USCIS’ correspondence to our office below:

“According to U.S. Citizenship and Immigration Services (USCIS) records, National Benefits Center has jurisdiction over this case, Therefore, we have forwarded your inquiry to the National Benefits Center for review and direct response to you.”

We will be in contact with you when we receive a response from the National Benefits Center.

Is it bad that it's back at NBC?

Hey guys, I got my biometrics appointment letter for August 10. I have two questions regarding walk-in:
1. Will the interview letter come fast if we walk-in?
2. Do we need to call ASC to take an appointment for a walk-in, or can we directly talk with the officer in ASC?
