DV 2023 AOS (Adjustment of Status) Only

Still no good news on the horizon. To my request to speak to a tier 2 officer, i received a rescheduling automated email (although I had asked the info specialist repeatedly not to mark the request as a rescheduling request): "We have received your request for your interview to be rescheduled. Your application will be placed back in queue for interview scheduling at a USCIS field office. Once an appointment is available, your interview will be rescheduled. An appointment notice will be mailed to your current address of record on file with USCIS. If you have not received a new interview notice within 60-days of this response, please feel free to submit a new request to the USCIS contact center.".

My congressman's aide finally got a reply from USCIS about her request to get me scheduled ASAP for the new interview. They told her this morning that I was "placed in the regular queue" for scheduling. She's trying to escalate it to a supervisor and emailing directly the NY FO to get placed in a "priority"/faster queue. She's been trying to manage my expectations and told me that multiple DV cases she's handled in the past never made it through the finish line and that she didn't really know how this would end.

@Sm1smom I am stressing out too much and thinking to engage the lawyer that made magic happen to get interviews for 3 people last year in the NY FO in september. He seemed pretty confident that he could help out and get me through the finish line and I think this is probably my best chance at this point. Was hoping to get your thoughts on the situation/etc.

Honestly speaking, this is your call. Go with the lawyer option if that is what your guts instinct is leading towards, I cannot discourage you from doing that.

I guess my question was more about your feel on the situation. Do you think it's starting to be tight/tricky or is there still a lot of leeway from your experience/other levers I could pull?

While I understand the feeling of anxiety you’re experiencing, I personally feel there’s still enough time for the case to organically get resolved without pulling the lawyer plug at this point.
 
Wanted to bring up a thing or two for people in San Francisco:

Got an email from my congressman late yesterday and they mentioned the following:

"We have confirmed that this case remains pending at the San Francisco Field Office. After the field office verifies that all applicable fees have been paid to U.S. Department of State's Kentucky Consular Center, your constituent's case will be scheduled for an eligibility interview when an interview slot becomes available. U.S. Citizenship and Immigration Services (USCIS) will contact your constituent directly when an interview is scheduled or if additional information is requested prior to the interview. Please rest assured that the agency is prioritizing the processing of I-485 applications through the Diversity Immigrant Visa Program before the end of the current fiscal year."

This morning I got an email from USCIS after I spoke with a Tier II officer a week ago:

"You or your representative contacted U.S. Citizenship and Immigration Services (USCIS) to request an expedite.
USCIS:Considers all expedite requests on a case-by-case basis;

Please submit a written expedite request with supporting evidence by mail to this office. Please include a copy of this letter with your request.
Once you have submitted documents associated with your request for expedite of your case, the documents will be reviewed to determine if you meet your burden for expedited. If the documents do not establish that one or more of the foregoing criteria are met, your case will not be expedited, you will not receive any further notice of your request to expedite your case."


Does anyone have a letter that they've used in the past to write for an expedite request that was eventually approved?
DV based applications already get expedited as it is - they jump the normal processing queue/time frame - because USCIS is already aware of the sunset clause tied to them. In addition, DV cases do not meet the officially listed reasons for submitting an expedite request. These are the precise reasons I’ve never recommended a DV based AOS applicant submit an expedite request.

The following are USCIS’s acceptable reasons for a successful expedite request that I know of:
  • Severe financial loss to a company or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure: (1) to timely file the benefit request; or (2) to timely respond to any requests for additional evidence;
  • Emergencies and urgent humanitarian reasons;
  • Nonprofit organization (as designated by the Internal Revenue Service (IRS)) whose request is in furtherance of the cultural or social interests of the United States;
  • U.S. government interests (including cases identified as urgent by federal agencies such as the U.S. Department of Defense (DOD), U.S. Department of Labor (DOL), National Labor Relations Board (NLRB), the Equal Employment Opportunity Commission (EEOC), the U.S. Department of Justice (DOJ), the U.S. Department of State (DOS), DHS, or other public safety or national security interests); or
  • Clear USCIS error.
Even at that, USCIS states not every circumstance that fits under one of the above listed categories or examples necessarily results in expedited processing. You can read up more about the expedite criteria:

Hi Mom can a lawyer really expedite the process to get the IL if an applicant has been waiting for too long? Does he/she has an access to FO and are able to talk to the agents about the AOS cases?

Not in all cases. Some may have connections and may be able to speak directly with the FO supervisor to get things moving as a personal favor. Not all lawyers are able or willing to do so. It is also important to note that regardless of any lawyer’s inside connection, there’s nothing they can do if the delay is due to a pending background check clearance.

I dont think lawyer can help to get process faster. We went through lawyer but he just arranged paperwork and submitted. When i asked what he can do if its too late, then he said he will wait till August then request for expedite process. I think expedite request can be done by ourselves too. So, there is no big difference i believe.
 
I didn’t expedite since its been one month of my fingerprint, i was planning to wait two months then ask my lawyer to request expedite.

Thanks, I agree this forum is amazing (especially Mom, Blade, Xarthisius et al.) for DV application. I have more questions on my current status and extension of my status while waiting for AOS process to go through.

I’m sorry Simum, i was not confortable to share thinking about privacy concern. Since it was asked repeatedly and no response from you i thought it was fine. I apologize for that. I just wanted to help no more than that. I can feel the stress all are getting. Best wishes to all.

What is non immigrant visa number? Is it in the bottom right corner with red color starting with R?
It is the number in RED written on the lower (bottom) right side of the visa foil. Some start with an alphabet, some don’t.
