DV 2023 AOS (Adjustment of Status) Only

Its been 10 weeks since my fingerprints were taken, no updates since then & the live chat agent said that no interview has been scheduled. Is it a good time to initiate a congressional inquiry?

Yes it probably is (not necessarily because it’s been 10 weeks since bio completion, but because I couldn’t find any other case from your FO on this year’s Timeline Spreadsheet to analyze against yours, and I currently do not have the time to review previous years’ data).

my I-485 form and documents delivered to lewisville lockbox on 31th of May but after 15 days I have not yet received any notice of action from uscus and I have not yet been charged 1225$. As I checked the timeline section, applicants have received NOA between 5 to 19 days in the Dallas center. I was wondering if I should contact to uscis now or it is still early? Considering that we only have 3.5 months to end of fiscal year.

Exercise some P.A.T.I.E.N.C.E. You will not be able to obtain any information by contacting USCIS now, there's currently no receipt number they can use to look up your case. Since you're already utilizing the Timeline, you should consider adding yours to it too.

I havent got tax return transcript for year 2022. and I started filling from year 2021. Should I just send the tax return transcript of year 2021? What else can I do for this?

I have a B1/B2 visa and filled I-485 form.

For Question 61, which asks “Are you subject to the public charge ground of inadmissibility under INA section 212(a)(4)?”

I answered "NO"

Did I answer it wrong? If I did, how can I correct this mistake?

I recently graduated from my master's program on May 12. And I submitted Form I-765 for my OPT on April 12, while I had a pending AOS since March 2nd, when my finger prints were taken. I also responded to an RFE on May 10 (tracker shows delivered).
I have not heard anything else since then. I followed up on my AOS, and the live agent asked me to submit an outside processing time form.


I am just wondering what my next move should be, or should I continue waiting or submit the "outside processing time" form?
Is it possible to make inquiries for the two applications at the same time?
 
How to connect to live agent Emmma? I tried typing infopass, but it ask same questions and do not connect it.

The correct answer is YES - you are subject to INA 212(A(4). Not sure where you did your research considering we’ve always informed folks on this forum the correct answer to that question is YES.

You may receive a RFE asking you to submit an updated section of the I-485 with the correct answer. You may also have an opportunity to correct the response when you go for your interview (if no RFE gets issued). Other than that, there’s nothing else you can do about it.

Are you listed on the Timeline Spreadsheet? Add your data to the spreadsheet in order for us to get a better understanding of what could be going on with your case.
 
I honestly do not have a crystal ball for determining what the response most of you guys receive and post here without providing you providing the full context of the response. I don’t know what was it you sent you sent or who you sent it to. Just pasting the response along is not enough for me to know what it means I’m afraid.

Although I assume this email is connected to that request, I'm having trouble understanding the link between Cuba, the Potomac Service Center, and my inquiry. My field office is located in Los Angeles. I'm aware that interviews are typically scheduled towards the end of the fiscal year in this field office, but there are cases with scheduled interviews from the LA FO. It has now been 97 days since I completed my biometric interview. Would you suggest that I consider seeking congressional assistance regarding my case?

Okay, now I remember your case. You received a RFE asking you to proof you've continuously maintained a legal status. So you're basically on AP until that gets resolved. Your case is therefore not outside of the applicable processing time, this calls for patience IMHO. You however can submit the outside processing time form if you like though.

Okay, go ahead and initiate the congressional case assistance. Your case may be in AP due to pending background check clearance if there are other folks who already got interviewed.
 
Wanted to bring up a thing or two for people in San Francisco:

Got an email from my congressman late yesterday and they mentioned the following:

"We have confirmed that this case remains pending at the San Francisco Field Office. After the field office verifies that all applicable fees have been paid to U.S. Department of State's Kentucky Consular Center, your constituent's case will be scheduled for an eligibility interview when an interview slot becomes available. U.S. Citizenship and Immigration Services (USCIS) will contact your constituent directly when an interview is scheduled or if additional information is requested prior to the interview. Please rest assured that the agency is prioritizing the processing of I-485 applications through the Diversity Immigrant Visa Program before the end of the current fiscal year."

This morning I got an email from USCIS after I spoke with a Tier II officer a week ago:

"You or your representative contacted U.S. Citizenship and Immigration Services (USCIS) to request an expedite.
USCIS:Considers all expedite requests on a case-by-case basis;

Please submit a written expedite request with supporting evidence by mail to this office. Please include a copy of this letter with your request.
Once you have submitted documents associated with your request for expedite of your case, the documents will be reviewed to determine if you meet your burden for expedited. If the documents do not establish that one or more of the foregoing criteria are met, your case will not be expedited, you will not receive any further notice of your request to expedite your case."


Does anyone have a letter that they've used in the past to write for an expedite request that was eventually approved?
