DV 2023 AOS (Adjustment of Status) Only

So far for this year, San Antonio seems to not have scheduled any DV based AOS application (based on cases reported in this forum). I think you should at this point (considering you filed since January) consider initiating a congressional case follow up assistance.

@Sm1smom How long should we wait and see to consider initiating a congressional case follow-up assistance? During 2022 San Antonio FO Waived almost all DV cases as per the forum timeline sheet. (Bio Appointment date -Card Production date is approx. 1 month)
 
My daughter received postal mails from her mailbox at University Residence Hall. She will not have access to her mailbox after May 15th. I'm worried incase if the interview appointment/waiver being received via post after May 15th.

@Sm1smom , Incase if I change address online via USCIS online account, how long does it take to update records?

I'm surprised your daughter did not use your home address as her mailing address on the I-485 in place of the school address. Unfortunately, there's no way of knowing how long it may take for her records to get updated with her new address to ensure USCIS correspondence do not get sent to the current listed address after she no longer has access to the mailbox. In general, I tend to discourage address change after AOS filing as it could take a while for the update to circle through the system. This is because it isn't unusual for USCIS to still mail correspondence to previous address even after acknowledging the new address.

You can do that now considering you also filed since January.
 
Hello @Sm1smom, I am reaching out because my wife and I have received IL and the interview is scheduled for May 9th (we received only 1 letter with both of us as recipients). As you may remember, at the beginning of March we were forced by the events to go back to our country for some days (loss of a family member), we both are on H1B visas, but my wife was still on J1 at the moment of AOS shipment. My questions are:
1- should she discloses she exited the country without AP (although it seems to me she should not unless a question about this matter will be asked)
2- would bringing the death certificate at the interview help the case, in case the officer asks questions about why she left the country?
3- is there any other document we need to bring that concerns this specific issue?

1. Don't volunteer unsolicited information. Only address the issue if the IO brings it up.
2. It wouldn't hurt to take it along.
3. I can't think of any at the moment, however the rule of thumb when attending an interview - take anything and everything you think you might need. Documentation demonstrating she's never been out of status for starters.

There's really no specific script to follow when chatting with Emma, it's a matter of using one's discretion as the chat progresses when you request to know if your bio has been scheduled or not. However, seeing as you only filed barely two weeks ago, I think doing so now could be a fruitless exercise.

Hello, I’m doing AOS in Chicago, I saw the spreadsheet you filled in Chicago too, i have questions about the bio appointment, why didn’t they send a bio appointment to you ?

Ma bad. Probably mixing you up with another case where the parents are in the US on a work visa and the daughter on F1 got selected.

Don't you think it's ironic you're referencing the data on the timeline spreadsheet, while you yourself are not listed on it?
 
There is no requirement to include any financial document (including an I-134) with the initial submission as a matter of fact. Use your discretion on what you wish to submit or take along to your interview.

Are you really saying that Form I-134 is not required to be submitted with I-485 submission or any financial or bank statement. If so how does one demonstrate to USCIS one's ability to support oneself.
Looking through the AOS Package Excel page , the items listed under Evidence of financial, support, I-134 is listed with other financial/tax statements and records. Is that no more valid?
Could you explain the difference between Form I-134 and I-864 and under what conditions do you file one or the other?
And has Form i-944 been discontinued?

What status "Lawfully App" showed you when your Invitation got waived? Or did you contact Emma to get to know your Interview appointment status? Did you get any notification via Post as well?

I have contacted Emma 3 times between my biometrics appointment and a card production notification to see if my interview had been scheduled. Usually, if your daughter signed up for the USCIS account, she would receive notification if there is a movement on your case. However, we do not get a notification when the interview is scheduled. I got a notification from lawfully when USCIS changed my status to "new card is being produced" which means that my interview has been waived. The next day my status changed to "your case was approved" and the status stated that they have sent me an approval notice but I have not received it yet

I never said the listed financial documents on the AOS spreadsheet are no longer valid. You wanted to know if the financial documents are "required" and I responded by letting you know USCIS has not listed any specific financial document as being required for DV based AOS application. The spreadsheet has a list of recommended tested financial documents that could be used. You have the option of proactively providing the listed financial documents with your AOS package or not, your call, as long as you're aware there's still an expectation to be able to demonstrate one is not likely to become a public charge. So you can decide on how you wish to overcome that.

I-854 is for family family AOS applications, it is not applicable to DV based AOS applications. Take a look at the "Interview Tips" tab of the AOS Process Spreadsheet for more on the difference between those two documents.
