DV 2023 AOS (Adjustment of Status) Only

Hi Mom,

I filed my I-485 form (with both I-765 and I-131) on January 5th,2023 and provided my fingerprints on February 23th,2023. Since then, I have been waiting for an interview notification or any update regarding my case status. According to my zip code, my office is San Antonio, TX.

Judging by past timeline spreadsheets, It seems my process after biometrics seems to be late even though San Antonio office waived the interview for DV2022 selectees.

Approximately 20,000 diversity visa based visas are issued for EU region every year. For 2023, It has already reached to 9594 issued and 7526 ready. I'm very concerning the EU region quota will be expired till I get my greencard.

Could you suggest me a way to speed up my process or should I wait a little more

You need to add your timeline to the 2023 Timeline spreadsheet to enable us compare it to similar cases and make a determination of what the next step could possibly be.
 
Hello ! Someone helped me to fill my taxes this year for the 2022 tax year since it’s my first time dealing with taxes. However, I’m looking at my tax record and here’s what I see: 1040 instead of 1040 NR. Is that normal since I know that the 1040 NR is a variation of 1040? Or was it really supposed to mention 1040 NR?

For those of you non-residents who filled taxes, is it 1040 or 1040 NR on your tax record?

We did our bio 2 weeks before but my childs' case is following us. Because I had to resubmit it and now waiting for his bio appointment letter.
My question is, does FO waiting until they get all the bio clearance or do they schedule interview without his clearance? Thank you.

So far for this year, San Antonio seems to not have scheduled any DV based AOS application (based on cases reported in this forum). I think you should at this point (considering you filed since January) consider initiating a congressional case follow up assistance.

Today was the call-back day to my congressman's office. He just told me to wait another 30 days since the decision can take 60 days. I was just wordless at that moment.

I got a callback from a tier 2 officer last week. After I asked for any updates and progress. She said that the only thing she can see is that the case has been assigned to an adjudicating officer. It is at the final stage of adjudication. I do not know if that was the truth or not. Do tier-2 officers have access to the info on whether or not the case is assigned to an officer? I am getting more and more impatient.
 
Hi mom, I received my interview notice today. The notice says I should go with my spouse whom I am not applying with and is located outside USA. Will this be a problem?
 
Hey Mom, just wanted to give you an update on my immigration case. I completed my biometric on March 9th, and my case is being processed by the LA field office. It's been 40 days since then and I'm still waiting for my interview. I've been keeping an eye on the forums and from what I've seen, cases in the LA office seem to have longer waiting times after biometrics. While I think it may be a bit early to reach out to Congress for assistance, I also wanted to get your thoughts on it. Would you recommend waiting a bit longer, or do you think it's time to initiate a congressional request for my case?

Unfortunately, AP resolution could take several months to get resolved (as we've already discussed), I think that is the message your congressman's rep was trying to communicate to you in view of the fact that USCIS is yet to get back to them with any new update.

Yes, Tier-2 officers are able to see that. Even if the Tier-2 officers are unable to see or verify that information the general practice is for cases to get assigned to an IO (Immigration Officer aka adjudicating officer) once they get transferred to the FO from the NBC. Part of the adjudicating process involves reviewing the application, scheduling an interview (which could be before or after the background check has been completed or cleared), or approving the case without an interview (if the IO feels inclined to do so) following the background check clearance.

Shouldn't be a problem if your spouse does not attend the interview with you. Seems to me like you received a generic IL typically used for marriage based interviews. So don't worry about that.

Waiting a bit longer would be my recommendation since the LA FO is notorious for taking a while.

Thank you for the response, Mom! That's the reason why I asked her on the phone "Do you consider it is assigned to an officer since it is in the field office? Doesn't the IO start adjudicating as soon as it enters the field office?" She said no that's not how it works. The case goes through some processes before being assigned to an officer. She told me your case was assigned to Adjudicating officer on the 29th of March.
 
And one of the L1 officers told me that "your case was worked on 29th of March but we cannot see what that is" before.

Yes of course, there are certain steps involved in the process. You'll basically drive yourself crazy getting bogged down in the weeds of what starts when. Details of what gets started when from when the case reaches FO is completely irrelevant IMO.

By the way, don't get surprised if another T2 officer tells you something else, hence my conclusion about the irrelevancy of trying to verify what gets done at which point.

OMG, Mom! You are right! I have dedicated literally my life to this now. I heard about the 29th of March date and I thought maybe is something happening. But it does not seem like it. I do not know what to do. I just wanna sit down and cry. I wish never won this crap.

Just hang in there and try to focus on whatever you're doing at the moment. Sept 30th is still ways out, so there's plenty of time left at this point.
