DV 2023 AOS (Adjustment of Status) Only

Hi Mom,

It's been 41 days now since I had my biometrics done. I don't mind waiting for one more week. I live in Illinois with a zip code of 61761. The field office locator shows St. Louis, MO, using my zip code. So my question is, do I contact the Congressional representative of Illinois?
2. My I-20 expires on May 12, 2023. I was recently issued a new I-20 (OPT), and I just submitted the online application for Form I-765. Is there anything to worry about regarding my status?

1. Yes.
2. Your status, as at when your package was accepted by the Lockbox is what matters in determining your AOS eligibility.

Having a mix of 1040 and 1040-NR documents on its own is not an issue. 1040-NR is an indication of having amended a previously filed 1040 because there was something wrong with the filing, USCIS has no issue with such mixture. If the salient question you're trying to ask (without necessarily asking) is about the fact that you only amended 2022 tax filing while the previous years you ought to have amended also (since you used Turbotax in place of Sprintax as a nonresident alien) did not get amended, that is an issue you need to resolve with the IRS.

Hello, Mom again thank you very much for your response. I in fact amended my last three years of tax returns. Now, I am curious how I would know that my tax has also been amended for other years than 2022. Also, any information on how I can get this issue resolved with IRS will be highly appreciated.
 
I am self employed currently. what financial documents do i submit?
1. bank statement for my business or personal bank account
2.i do not have an employment letter?
3.i do not do paystub as i am the only employee?
4. does it make sense to submit my business license, registration,

I should clarify my previous response regarding the 1040NR where I stated it is an indication of having amended a previously filed 1040 as that statement is not accurate. 1040NR is the form used by non-resident aliens while 1040 is used by anyone deemed a resident alien for income tax purposes.

I’m glad to know you amended your previous tax filings as required. I typically do not provide advice on tax related issues, that is beyond the realm of the DV processing guide I provide here. Please discuss any tax related issues you may have with a competent tax advisor.

You can submit about 6 months worth of bank statements for your business, business license and registration, profit and loss statement from the business, current tax year’s AGI (adjusted gross income), evidence of past years tax filings, etc.
 
Hello Mom, I finished my biometric on Jan 19th. Since processing from my field office (Baltimore, MD) is very slow, the congressman office helped me file inquiry to USCIS in the end of February. Last week, I told to congressman office, and they said USCIS still did not give them response. Do I need to request further inquriy with senator's office? or it probaly gets the same condition. Thanks

I am curious if you have filed I131 and I765 as well or only I485 please. Just trying to work out the time lines at Kansas City time frame.

I would recommend reaching out to your congressman's office again at the end of the month (if there's still no progress on your case) to find out if they're able to send in a fresh request on your behalf. If they're unwilling to do so, then you can reach out to your senator's office in that case.

The FO does not process I-131 and/or I-765. So the inclusion of those forms typically have no bearing on the processing time for the I-485.

My FO is Dallas. I have looked at Dallas FO data from 2023 through 2017 (did not add the ones where biometrics appointment was done after the interview and one case where the applicant waited more than 6 months) and the average wait time between biometrics and interview notice (or waiver) is roughly 15 days.

I was thinking that if I don't hear anything in 15 more days, I can contact my congressperson or is it too early?

I have dowloaded an app called lawfully. They send notification when there is a movement in your case.

No, I learned my appointment date from Emma - live agent. The app only sent notifications when my case status changed to "Application received by USCIS", "Case was Updated to Show Fingerprints were taken", and "New card is being produced".
 
Dr.HPol, did the app send an immediate notification when it changed from case was updated to show fingerprints were taken to a new card is being produced?
