DV 2022 AOS (Adjustment of Status) Only

Do we need to send an email to KCC saying that we want to do Adjust of Status or are we allowed to just directly send our AOS package to USCIS as soon as our case number becomes current?

There’s no requirement to email KCC, you however may do so if you like.

I have a quick question regarding education requirements as listed in the AOS package, and I could not find an easy answer:
- the high school diploma is written as if applicable, when is it applicable or not?
- same for potential further diplomas.
I have a high school diploma as well as a bachelor, and I am working towards a Masters degree in the US (on a F1 visa). Which one(s) should I include in my AOS package?

Another question: I believe Postal Money Orders are limited to $1,000, any advice on how to make the $1,225 payment?

1. “If applicable” refers to if a certified translation is to be included (for when the original HS diploma is not in English), and not to the HS Diploma itself. Same for potential higher diplomas.
2. You’ll need to purchase two money orders in that case.

DV 2022 Winner here. This is to clarify where I will be sending my I-485 documents. It appears there has been a change and living in Wyoming implies I will be sending my documents to the Phoenix lockbox. It that accurate?

1. About the Social Security Card section in the I-485, I might not be able to receive my SSN before submitting the I-485 since I just applied the OPT.
So, should I answer "No" to the question "14. Has the Social Security Administration (SSA) ever officially issued a Social Security card to you?" ?

2. Follow the above question, should I also answer "No" to the question "17. Consent for Disclosure: "?

3. About the section "Information About Your Immigrant Category" in the I-485, what kind of the situation will ask me to fill this section?
I'm F-1 visa just applied the OPT, and my wife is F-1 working on OPT and will also apply the AOS based on me. I thought I don't need to fill this part since OPT is not belonged to the immigrant? but just want to double check.

4. About the Part 8. General Eligibility and Inadmissibility Grounds in the I-485, since I've served the mandatory military service for 1 year in my country, should I answer "YES" in this part? If YES, should I also include the Military Service Discharge certificate in the AOS package?

5. About the Part 2. Application Type or Filing Category in the I-485, should my wife also select "Diversity Visa program" even if she is applying the AOS based on me(I'm the selectee)?

6. About the I-134, my wife is working on OPT start from last year, and she can provide the Recent Bank Statements, Recent pay slips, and W-2, so I guess she won't need the I-134?

7. Follow the question 6, I'm a F-1 student now(3 years in the US), so the only thing I can provide is the Recent Bank Statements.(Not much but can support my daily consumption). So, should I provide the I-134 ?

8. Follow the question 7, if I need to provide the I-134, can my wife be my sponsor? If yes, is there a minimum wage requirement like her annual income or balance of all her accounts? Since once she became my sponsor, she'll need to prove the Evidence of Financial Support for both of us ?

1. Answer NO if the SSN has not been issued as at the time you send in your AOS package.
2. It's your call, you will not be penalized based on whatever you choose for this.
3. Underlying immigrant petition information section is not applicable to DV based AOS applications.
4. Yes. Yes.

6,7,8: If your wife's income meets the applicable poverty guideline level, you both shouldn't need an I-134 in that case. Your wife's income will be considered jointly owned, meaning it will be used to assess both of you in terms of overcoming public charge concerns. Your wife does not fill out an I-134 for you. If you will require an I-134, that requirement will also be applicable to your wife also. You will both need to find one person to provide the the I-134 in that case.

I submitted my DS-260 in December 24th mentioning that I am going to do AOS processing, and still, I did not receive 2NL. Also, I sent processing fee of 330*2 for two people in Feb 10th and still I did not get any response. My number is AS85xx and hoping to submit the package in the beginning of April. How should I expedite the 2NL? Please advise me.

1. I never received 2NL and did not include that in my package. Not an issue. Read AOS spreadsheet and the FAQ tab.
2. Did you include SASE with your payment?
 
Hello Everyone,

I have a quick question on Part 1, lines 15-19 where we're asked information about our last arrival into the US. My most recent I-94 shows 08/07/2015 as the last date of entry to the US when I last came in as a Student but when I took a look at my travel history from the same website, my most recent entry date is different. I travelled to the US virgin islands (US territory) last summer and that's what's showing up as most recent entry even though I technically never left the country. Please see the below the difference. So I'm thinking of referring to the 08/07/2015 data as my last entry since it's showing up on my I-94 but please let me know if otherwise.

1.About the applicable poverty guideline level you mentioned, do you mean we'll be fine if my wife's income(W2) is above $27,465? (with 2 Sponsor's Household Size: me and my wife) since I'm still not sure what does "150% of HHS Poverty Guidelines" mean after googled it.

2.Follow the above question, if my wife's income(W2) is above $27,465, in our AOS package, should I prepare two each of the following documents (my wife's Recent Bank Statements, Recent pay slips, and W-2) for both of us to be considered jointly owned? or I can just prepare my own recent bank statement, and one each of my wife's Recent Bank Statements, Recent pay slips, and W-2 ?

Btw, we've not filed the joint tax return for 2021 since I don't have the SSN number (she filed her parts alone and I filed my part with the 8843 form), I'm not sure if this information will be helpful.

Lines 15, 16, 17 of the I-485 form I'm looking at has Social Security Card related questions listed, while line 18 and 19 are passport or travel document last used to enter the US related questions. If you're asking about line 26, that is I-94 related. List whatever is on your most recent I-94 (and not what is on your travel history tab).

1. Yes, $27,465 is the 150% PGL applicable to a household of 2 and should be okay. Do bear in mind though, that is really just the minimum amount, the more the income level is about that, the better.
2. Include same set of financial documents for both packages.

Regarding the tax filing, no problem filing separately as long as you both accurately listed your marital status and did not claim to be single.

We submitted DS260 for CP (Auckland) in May and received an email requesting further documents in September. We are thinking we will change to AOS (hoping OC will go current in June).

Can I post the $330 Admin fee check before I arrive in the country (ie. send a signed check to someone I know in the US to post for me). Then my wife and I fly to the US get all our documents together and post the AOS Package (a month before we go current) then fly back to NZ (with AP) while we wait for the interview. Just trying to keep my job in New Zealand until we are ready to move to the US permanently. Don't want to spend months there waiting..

If you are not residing and/or working in the US, I believe you’re not eligible to file for AOS even if you currently have a valid O-1 visa stamp on your passport. However, assuming you are eligible to do so (which I do not think you are), your plan cannot work anyways. You most definitely will not be issued with an approved AP card within one month of filing for AOS. And once you depart from the US without an approved AP card while your AOS is pending, the application will be presumed abandoned and subsequently denied by USCIS.
