DV 2022 AOS (Adjustment of Status) Only

Hello everyone I’m a DV2022 winner AS16xxx.
Thanks for the spreadsheet, very useful.

I recently extended my L1 visa and its valid until June 2023 and planning to go with the AOS.
My question is about my family, their I-94 expires this month and we filed an extension for their L2 visas but the processing time is about 10-13 months! If they stay in the US until the extension is approved will that count as unlawful or overstay and affect our AOS?

And one more question, A friend of mine who is a previous DV winner told me that for high case numbers like mine CP would be a better option the AOS is that true? I read the spreadsheet but couldn’t find any info on that.
You should check the Visa Bulletin when your case number becomes current. As for DV-2021 AS16xxx became current in June. AOS process takes several months and if you will not get AOS approved before the end of the fiscal year (end of september) it will not be approved at all. Please check DV-2021 AOS Timelines for that.

I'm not sure on this part but as far as you file an extension request, you will not accumulate unlawful stay while it is being processed. Though I'm not sure if it will count as a valid status. Please correct me someone if I am wrong.

1. Considering the EOS was filed before the I-94 expired, your family while currently out of status are not accruing an unlawful presence (there is currently no overstay while the timely filed EOS application is pending). If the AOS. Gets approved before your CN becomes current, they will be eligible to file AOS.
2. The decision to file AOS or CP (for someone is is eligible to process either) is a personal choice. Go through the pros and cons of each option, following which you decide what works best for you.

I have been selected for DV lottery (AS000085xx), 2022. My husband submitted I-140 in December 2020. He was also planning to submit I-485 (concurrent filing with I-140 receipt notice) soon including me as a derivative. However, after selected for the lottery we are thinking about which one to chose. We also have another problem as our OPT extension (EAD) will expire on June 2022. Could you please advise us whether it is possible to submit I-485 for DV lottery if I submit a separate I-485 for NIW (I-140). Thank you!

Q.1: How can I get the Self-addressed stamped Envelope (do I need to prepare it myself)?
Q.2: How do I arrange the package for the DV fee payment if the order matters?
If anybody has gone through this process please provide me some advice. And I would also like to request the admin to add this information to the spreadsheet as well. Thank you in advance.

1. You buy an envelope. You write your name and address on it. You put a stamp in the top right hand corner. Done.

There’s no problem with having multiple AOS applications in the system at the same time.

2. What DV payment package are you asking about? There’s no package that gets submitted with the DV fee payment.

I'm currently reside IL and gonna move to CA at the end of July, so I'm thinking about file my DS260 and AOS application on August after moving. I was wondering that is there any deadline of DS260 or AOS? I've read through the spreadsheet and just want to confirm that not filing DS260 immediately won't loose my eligibility.

There's no deadline for DS260. In fact it's not required for AOS process and you won't loose your eligibility if you decide not to complete Ds260.

Yes, the AOS application must be approved by Sept. 30th 2022 (which is the last day of your applicable FY). I'm assuming you're aware you cannot file before your CN is current though (and you're required to be in a valid status), that is what you need to be working towards in terms of AOS package submission.

I was chosen for the DV lottery 2022 my case number is AS9XX. I am currently on my OPT. It does not really make sense for me to submit the DS-260 since I will need to leave the country to go to an embassy and i technically can't do that because of my visa. I know the form is not necessary, but i am a little concerned about letting the Kentucky office know that I plan to do an AOS. I have emailed them asking some questions but not received an answer. Also, the first page of the DS-260 application asks if you want to do an AOS, does this mean it is better to fill it out and submit and this way they will know? i am a bit confused now. A lawyer told me to send the Kentucky office a cover letter letting them know of my AOS decision with a receipt of the payment fee. Not sure this was correct though. I would really appreciate some guidance. thank you soooo much in advance! My apologies if my question has been asked before, it is a stressful time!

Reasons for recommending DS260 form submission are listed on the FAQ section of the AOS process spreadsheet, I recommend you take another look at it.

Should you decide to not submit the form, KCC will eventually become aware of your decision to process AOS once you make the DV administrative fee payment. There’s no need to send the payment receipt with a cover letter to KCC as recommended by the lawyer you consulted with.

I've saw some advices on another forum saying that if my CN is gonna be current in Oct., I can file my application on Aug. or Sep, so that my application will be received on Oct. Is this a right way to file my AOS?

Have you read the spreadsheet? This is explained.

I'm currently in the US on a F1-Visa. My wife is listed on my DV visa application. She is on a F2 visa. She is currently working on her PhD in Japan. She is not a Japanese citizen, neither am I. She usually visits the US every couple of months.

I am planning to apply for AOS here when my number is current. Can I include her in my application given that she will be spending most of the year in Japan? She can probably make it for medical checks in the US and for the AOS interview.

I realize that it is possible for her to apply from Japan after I adjusted my status in the US but would it be better for her to fly in for these steps (or is it even possible?). Is there a rule against her joining me, given that she will be spending most of the year abroad?

Your wife is not “on F2 visa” from what you’ve described above, she has F2 visa which she uses to visit the US. Since she’s not based in the US, she is not eligible to file for AOS with you. AOS is an option for someone already based in the US on a NIV when the decision to file for AOS is made. Your wife will have to process FTJ (follow to join) as your derivative in this case.
