Could you tell me why people who are in NON-RIR failed to receive any 45 days letter so far? Your analysis and from your statement as it says 15 people working both RIR and NON-RIR cases; why did single individual didn't receive any 45 days letter? Are you sure they are working in NON-RIR queue as well? I am so confused, please help me understand this. Thank you for your time.

RIR queue, at least, has gone into 2002. Obviously, as additional cases reach queue, the date regresses to accommodate. It changes from day to day, depending on the workload, and what mail is received in response to 45-day letters.

Well your assumption is wrong as non-RIR people who made it to Regional have recieved not only 45 day letters but also approvals..'

If your case did not make it to Regional then it is still at the Data Entry stage at the BEC and you will recieve 45 day letter shortly.

My question was since there are 15 ppl working in NON-RIR and RIR cases, why NON-RIR ppl failed to receive any letter. This letter seems to be more crucial, just forget the approval for right now.

Even the case first was filed as TR, later got converted into RIR. I would treat this case as RIR, not NON-RIR.

An approval from Dallas BEC

From the lawyer, a case filed on April 6th, 2001, TR, CA case, later converted to RIR and received by Regional in Dec, 2003 has been approved by Dallas BEC. Lawyer got the approval notice.

Approvals

I talked (emailed) my lawyer on Friday about any approvals she recieved so far. My priority date is AUG 2002. According to her

"Their firm recieved around 25 approvals so far but all from priority dates APR 2001. These are all from Dallas BEC. She said that the CO has around 1600+ applications waiting to be approved."

Now, I do not know how many are RIR and Non-RIR but I will ask her.

Can you please ask your attorney if they recieved any Approvals from Regular Case (non-rir).
I initially filed my case in 1997 and Dallas recieved date was June 2000. It was a non-rir case.

I found out and all the approvals have been for RIR cases

D = Dallas Backlog Processing Center
04264 = Year 2004, 264th day of the year, your case was received in Dallas
05XXX = Tracking number.

According to Shaakas's update, it seems to me that the CO queue has reached April, 2002. Given that there are about 1600-1800 cases waiting for CO's review, and your numbers that there are 660 cases for 04/2002 and 1022 for 05/2002, my speculation is your case is now waiting for the final review of CO. The RIR queue should already be at 05/2002 or even passed it.

Am I making any sense here?

To which SWA or regional RIR cases do these belong? Mine being May 2002 from Indiana (did not go to regional) should be close???

Approvals

Guys, I just spoke to Rajiv Khanna's office and they said that they have NOT received any approvals from the Dallas BEC so far. I am finding it hard to believe that of all the cases that did get approve from the Dallas BEC, none of them were from this office. Any thoughts? Please let me know if someone has really got any approval.

Please help me on this.

That will be asking my lawyer too many questions. I can say for sure that they started recieving 45 day letters since DEC 2004. I got mine in DEC 2004 and I know one more person from my company also got the letter in DEC 2004. Both were replied in two days.

One thing is that 45 day letter is a must. Also, applicants in Dallas DOL recieved the first batch of these letters.
 
Dallas BEC June 2003-RD

I spoke to my lawyers para legal today and she said although they have not received any approvals from Dallas BEC, she got a "Request for further Info" from Dallas on a June 2003 RD case-SF DOL-EB2-RIR case. The Dallas BEC apparently told her that after getting this info they will forward the case to DOL for approval. I am gathering that this is also in"final review" process. The info BEC was asking abt was on company recruitment efforts.

Now I'll let Zb do the analysis-but June 03 RD means it is June/July 2002 PD-right ? because mine is July 03 RD and I have August 02 PD.
