Contact DOL for explanation of FIFO and fairness
It is listed on http://workforcesecurity.doleta.gov/foreign/pdf/backlog_faqs_5-2-05.pdf that they will follow FIFO, but also declare a lot of "We're unable to ...". If u think unfair and want to know what they "are able to ...", why not complain to the following:

DBEC is such a big Black Box , once your application goes there, getting information from them is almost impossible.
