How come EB1 and EB3 numbers for INDIA is still available until 01JAN06 and 01APR01 respectively? If demand for EB2 is high, they could barrow from EB1 right?

Just an update:
Got a LUD today with no message change probabely due to my phone call on Fri to initiate an inquiry.
Also, the attorney claims he got an email response to his inquiry earlier this month. I'm surprised cause I thaught CSC doesn't respond to email anymore. And yes he used the same email address to send the inquiry as we do.
And of course the response is the applicants are still pendinf FBI namecheck. The service has NO control over... M. Boeno. I hate him or her because of that capital NO!
Will file to renew the AP/EAD soon when I get some passport size photos. Attorney will take care of the filing.
I cannot afford to wait for another couple years in a backlog...

Nadler Attempts to Reduce Backlog of Security Checks for Immigrants
WASHINGTON, D.C. – The House of Representatives last night failed to pass an amendment offered by Congressman Jerrold Nadler to reduce the backlog of security checks for immigrants seeking legal status. The amendment, offered to the Science, State, Justice & Commerce Appropriations Act, would have provided $40 million for the FBI’s National Name Check Program (NNCP), which conducts security background checks on names it receives from multiple federal agencies.
“We ought to process these checks efficiently; the enormous backlog of background check requests does an injustice to immigrants—and poses a national security threat at the same time,” Congressman Nadler said. “Law-abiding immigrants should not have to wait years for their approval, and neither should would-be terrorists be allowed years of sanctuary in our country.”
Since the attacks of September 11th, the program has accumulated a significant backlog. In fiscal year 2006 alone, the National Name Check Program received 3,346,435 requests for background checks.
United States Citizenship and Immigration Services (CIS) is the largest source of NNCP requests because of the number of immigrants applying for asylum, legal permanent residency, and citizenship. The backlog has resulted in a major delay in the processing of immigration applications.
The Nadler amendment would have helped the FBI eliminate the backlog and process new requests more quickly. To offset this increase, $40 million would have been cut from the Department of Justice Legal Activities, Salaries and Expenses account. The amendment failed on a vote of 176-243.

Didn't the costumer service give you a confirmation number so you can call back if you don't get a response within 30 days? Why don't you call back and provide your confirmation number and let them know that you have not heard anything back, see what they say. Please make sure to keep us posted on result. When i called second and third times, I gave the confirmation number. But it didnt matter, they asked me all the same questions (address, name, dob....) and intiated another query.

I asked about the use of the confirmation number.
She said they will first try to find the previous inquiry using WAC number and A# I guess and then if they don't find any they will use the confirmation number to locate the previous inquiry.
It might be their standard operating procedures to ask about all the details.

Capturing Earlier Priority Date
I have two priority dates, one from my previous employer's I-140 approval notice (11/2000) and one with my current employer Labor Certificate (07/2002), when my current employer filed I-140 in 08/2005, he requested USCIS to capture the earlier priorty date 11/2000 using a copy of the I-140 approval notice. but when i received the I-140 approval notice for the current employer, it doesn't have my earlier Priorty date. instead it shows 07/2002.
My current lawyer says, the I-140 shows the correct PD. he says if they recapture, it won't show in the I-140 approval notice but it will be in my I-485 application file. Is it correct? if not, how can i correct this, is it easy procedure?

Got two mails today. One from senator Davis that they have sent an inquiry. It's not clear to whom. And it says that the case is pending. And there is nothing they can do about it. And that her office is working to do some thing in grand scale! Pathetic.
Next was a mail from CSC indicating that my case has been delayed due to background check. It was a response to the phone inquiry I initiated last Friday. That was fast.
So here I am. Case is still pending. My impression is that the congress representative and senator doesn't do much (let me rephrase it, it doesn't do anything!).

Send three email inquiries in Oct05, Feb06, and May06. All was replied by M.Benu, R.Cruze that the application is pending namecheck.
Attorney sent an email inquiry on Jul06 which was responded the same way.
Initiated a phone inquiry last Friday which I got a written response.
Contacted congresswoman and senator which was responded by a vague mail saying that case is still pending. Am not even sure if they contacted anybody.
Will file for AP/EAD renewal next Monday. Hope I get it on time.

Wow, thats a lot of effort. I think I have approximately the same amount of contacts - except CSC replied only twice (both with pending status, with 'please call 800#' note). Also, I have Congresswoman and Senator both pending response from FBI. They have both told me not to hope for anything special.

i don't know what is the deal with AP. I also applied maybe 10 days before you and gor EAD two weks ago but no news from FP yet.
