I-485 approved

Hi all,

Finally, I went to san jose local office to check my case today and they said that my I-485 was approved lastweek. So they stamped my passport and said that they will order my card and send it to my new address.

I had an interview last months and I was stucked on name check. But everything is clear now and I am waiting for the real card. In the meantime, they said that I can travel outside the US using the stamp that they made on my passport.

The stamp is valid for 6 months and they said that a greencard will come within 6 months. I hope that it won't take that long. Any idea why it takes 6 months for them to mail my green card?

Good luck everyone.

Could you please let us know some details about your pending namecheck. Like when was the first time you were told that your case in pending FBI namecheck, whether you send inquiries through your local congress representative, whether you contacetd FBI or not, and how long did it take for your case to be cleared from FBI. Thanks.

Tantan,

I have no idea when my name check was started.
At the inteview, everything went well and it was on June 7th. By the end of the interview the officer told me that my name check had not been cleared so that I will have to wait for one to six months for the name check to be cleared. Then they will make a decision on my I-485. So in my guess, the name check was started sometime before my interview. The officer also told me that in some cases, name check can take upto a few years, but very rare. I was so worried when I heard that. I hope that your case is not in those rare cases.

The approved date of my I-485 was June 19 2006 (about 12 days after the interview). I filed my I-485 on 09/07/2005. I am sure the my name check took less than a year.

I did not go through congress representative. All my queries made to CSC (email, phone) and local san jose office.

I am sorry that I can't answer your question since I really don't know what exactly happened with my name check.

Good luck and thank you everyone in this forums for providing such informative experience.

may I ask your nationality?

Well it looks like there aren't a lot of people from May-Dec 05 whose 485 is still pending. If you are one of them, please make sure you keep the forum updated. Even if there is no activity on your case, it is not such a bad idea to drop a line and let everybody know that you are still in touch... Your help is appreciated.

Mine has been filed in 01 Aug 2005, RD 04 Aug 2005, ND 05 Aug 2005.
AP, EAD, and 140 are approved with no problem.
485 is pending FBI namecheck
There have been three e-mail inquiries which for each one I got an LUD with no message change. I was told that the application is pending FBI namecheck.
I have contacted the congresswoman. The office initiated an inquiry to CSC and got the same response. An inquiry has been initiated to FBI which is still pending their response.
Just filed an online request to Senator Feinstein.

Very frustrating... can't easily change my job without the actual card or the stamp.

yes, most folks have been approved. Its just us a few folks.

for the rest of us it seems its completely unpredictable,

House’s version of the Skill bill, H.R. 5744

Too good to be true???

HOUSE’S SKIL BILL TEXT POSTED AT THOMAS

THOMAS, the Congressional on-line listing of Congressional action, has posted the House’s version of the Skill bill, H.R. 5744

The bill mirrors the prior Senate’s version. This bill is even more favorable than the CIR proposal passed by the Senate in the Spring.

Among the favorable nuggets in the bill:

1. Market based H1 cap AND no cap for US Masters H1s. The H1 cap can increase as much as 20% per each successive year.
2. No Schedule A Immigrant visa (IV) quota -- forever
3. Doubles the IV ( aka green card) numbers
4. No IV quota for US Masters degree holders.
5. Creates a "streamlined process" for employers of IVs so that they shouldn’t have to, for instance, keep answering an “ability to pay” RFE over and over again.
6. Premium processing of I-140s.
7. Eliminates SWA's processing of PERM PWDs by making the function a national one AND mandates that the PWD must be issued within 20 days.
8. Re-institutes the in-country visa revalidation, which was eliminated in 2003, which eliminates the hurdle in revalidating H-1 visas.

Case pending response from NSC inquiry

I got the response from USCIS NSC after my second inquiry at the 800#. The letter states both cases are still pending or no decision has been made.

Also, they said if I don't hear from them for 90 days, then I should contact them again.

So 1 quarter written off...sucks.

awwwww, that sucks big big time. we are doomed to hell.

what did congressman/senator say ?

Congresswoman's office said they will send inquiry to FBI, but I should not expect response for 6-8 weeks, maybe even more because a lot of people are sending inquiries nowadays, so the FBI may be overwhelmed!
