uscis send ur name and DOB to fbi on a disc. they don't send the country name. how come a friend of mine, who is from my country got cleared in 2 days whereas i'm stuck? it is independent of country simply.

You may be right. I am stuck also and my name is rediculously rare. It is frustrating, I agree.

Name check usually starts in 1-2 weeks after you submit your application for I-485. It is not related to FP.
 
I-140 LUD after approval --- what is it for?

My I-140 was approved on 12/13/06, but I have an LUD of 1/1/07. Does anybody have any idea what this was for? Do you think it has anything to do with my pending I-485? Please share your thoughts on the matter.

This is getting curiouser and curiouser.
I have heard of moans of having "very common names" causing name check hit. Now "rare names" also getting in there.
There is probably no escape from this hole. Looking at the pace of reported approvals, it looks like ROW (with some exceptions) is less affected by this so called name check process. I have seen and know personally of people getting approved in 2-4 months of filing 485.

I have not seen any Indian approvals. At least most of the people stuck in NSC/TSC show filing dates from April but little movement since then for 485 at least. The I-140 queue seems pretty fast but 485 is slow and slower.

For those stuck in name check, may be a 6 month wait from filing is good point to start collecting documentation for Senators and Congressmen though the only sure shot thing which works is WOM.

I hope it ends soon for everyone of us.

I am no sure. Do you have I-485 LUDs as well? In my case it may be related to AP applications (12/11/06), becasue I also got a coulpe of LUDs on them on 1/1 and 1/2.
 
As far as I remember G325A is filed in 4 copies, one of which is likely to go to FBI, along with the country info, address, history, your name in your native alphabet, etc.

A couple of weeks back I was talking to my friend who claims he has some connections with the FBI office doing the name checks. He was trying to help his own naturalization case and did not share too much info with me. However, based on the data he provided it looks like they have different people working on requests for different countries. If the case is not cleared fast (not sure what that depends on, but could be likely your age or name), it will go to one of those guys. An officer can handle a country's cases or a cases for a part of a country. So, the fact that you are [let's say] from Russia does not matter - what matters is the part of the country. The other interesting point is that USCIS seems to use FBI's slowness to filter the caseload. This way they can claim significantly lower backlogs (they reported total of only 10K backlogged cases recently, because they exclude FBI-stuck cases from the totals). So, don't expect FBI or USCIS to speed up - they have common goals of slowing things down. But eventually it should work out...

hmmm if this is correct than I dont have to wait for FP appointment to check my name check through Infopass. I still have not received the FP appointment letter. Do you gurus think that I should make the appointment for infopass?

LUD Question

I had my fingerprinting done on 12/29/2006. The same day I got an LUD changed.

This morning I logged on and notice that yesterday, 1/3/2007 I had another LUD. What could this mean?

Also, how can I check if I passed the name check? (I haven't received any RFE's)

I have seen quite a few guys posting about having LUDs after their I-140 approval. I also had one (see my signature). The common factor is that all these guys had their 485 pending. I believe it's a good sign, but no one can really explain it. It is my understanding that after I-140 approval (and 485 pending), USCIS sends the approved petition to the Department of State's National Visa Center, where it remains until an immigrant visa number is available.
 
Dreamer_ny, I think you should make an infopass appointment to find out.

Based on my observations, most of the I-485 case with Notice Date around early and mid November already received FP notice. If you don't have FP notice by now, you'd better contact them to find out.

Thank you very much for your response. I called USCIS today just to see whats going on with the case and I spoke to lady which was helpful. She told me that eventhough Name check and Fingure Printing are two seperate processes. The information taken at the time of FP process is also used for the Name Check process. She also mentioned that FP notices might have been delayed due to holidays and my case is still under the regular processing times for FP (dont know how true is that?) but I guess I have to wait and see :(

Background check system

supposedly BCS should be operational on 01/03/2007 which is yesterday unless it was stopped. do u guys have any idea what happened with BCS ? is it working now or what?

at least USCIS should have mentioned it officially. what a bureaucratic agency. never ending !
 
write to USCIS director to encourage momentum of efficiency improvement

I am thinking to write a letter to the USCIS director, Dr. Emilio Gonzalez, to urge him to keep the momentum of continuing to reduce backlog and to speed up processing. He was recently reconized as one of the recepients of Outstanding Americans by Choice award. I want to congratulate him and the same time encourage him to turn the 6 month processing pledge into an ongoing project. Ironically I have not been able to search his exact mailing address for this letter. Can some folks here provide his mailing address if you know where to locate it?

Additionally, I want to ask everyone who has a pending I485 to write such letter to show him we are caring about the 6 month processing pledge. There is little can be done, other than WOM lawsuit, to speed up FBI name check; but for the majority of us it is the USCIS service center that are holding up the processing. That is the least we can do.
 
stupid mistake

I had my interview on Jan 10th at Milwaukee office. I had moved to California and informed USCIS of the address change via phone (don't know what I was thinking). I have also written a letter to Milwaukee office to not move my interview date and that I had booked my flight tickets to Milwaukee and I'll attend the interview etc... I got a phone call yesterday from Milwaukee office. The officer said: we received your letter but we already sent your file to San Jose office so don't bother coming here for the interview!

Took an infopass in San Jose office today and they say my file is in transit and they haven't received it yet. My file is currently ........ no where!! I have to wait for the San Jose people to receive it and send me an interview letter again. It could take 2-3 months or more! Don't know if my PD will be current or further retrogress at that time.

The only good news is that the lady during infopass told me that my security checks are cleared on Aug 17th. If only I had waited until the interview to inform them of my address change I might have had a shot at approval on 10th!

Moral of the story: If you get an interview date don't mess with it/USCIS.
