My case is ready to go. I spoke to an office 3 weeks ago. He said that my name check is done and case is to be adjudicated. When?

Wow skp19722003, seems like you're farther along than anyone else. I'm sure you asked him when it might be adjudicated? I'm presuming he gave you the 60-90 day standard response. I'd say expect an approval pretty soon! Again, you just had your FP done, and I've seen folks get approved about a month to 6 weeks after, so that would put you in for a July timeframe...don't quote me on that though...if my powers of prediction were have to be any good, I'd predict everyone's approvals including my own :)
 
Today I opened a service request for my wife. I couldn't open for myself, since I opened one in last May.
For that they responded like case is pending visa availability. Lot of my friends who applied after me got the approvals this week.

I'm sorry to hear that you're in the name check black hole. However, definitely do not despair. I can testify to the fact that if you rattle the cages a little bit, you can dig yourself out of the hole, rather emerge from a wormhole on the other end. Trust me when I tell you that I had initially believed that all the correspondence I sent over to alleviate my name check issue was not going to have effect, but after getting out of the name check once I did undertake some proactive steps leads me to believe that writing to elected officials does bear fruit.
In my opinion, we as applicants need to realize that these agencies, both CIS and the FBI do not intentionally delay our applications in an underhanded effort to screw with us. Both agencies are bureaucratic behemoths that deal with unbelievable volumes of applications, are understaffed and underfunded. The FBI in particular does not have an enviable job. The National Name Check processing times vary wildly and since there is little insight or oversight into the workings of the process, it definitely causes a lot of anxiety since you just don't know and have no idea of when you'll be done. Just my 0.02. Its easy to forget about this when we're in it, trust me, there have been times when I was really frustrated.

Now. When is it a good time to start being proactive? I think six months after having filed your AOS application is the right time....not the labor, but the 485, so in your case, a good time would be now. There was a gentleman on these forums who sent letters to everyone imaginable including Santa Claus....and his AOS was just 4 months old. SO, in theory, he was well under FBI projected times and USCIS processing times. Nonetheless, he got out of the name check and even his AOS was approved a month or two ago. Good for him. Was it fair? Maybe not, but he did what he had to do and he's better off for it.

I hate to sound like a know-it-all, but sometime ago, I had postulated about steps to undertake to get out of name check on the Texas Service Center thread. To encapsulate, I believe that if you, as an applicant, send a letter to the First Lady's office, to the White House of all places, it does have an effect. Not just because the Dept of Justice gets a forwarded piece of mail from the White House (which I believe may have a lot of weight), but also because logically, if you send a letter to the White House, you know that it will be intensely scrutinized, and odds are, you aren't a person of malintent to the nation. Simplistic, yet probably true.

From what I have seen through the months, individuals who attached a copy of their FOIPA records along with their request letter to the White House, received a letter from the FBI Records Division stating that their name check was processed, finalized and sent to the USCIS HQ in DC on xx/xx/xxxx. Folks such as myself who did NOT do so received a letter stating that our name checks were "in process" and there was no estimated timeframe as to how much longer it would take. The latter individuals, self included, to much jubilation realized that their name checks had cleared about a month after getting that letter. So I think if you do not attach the FOIPA, the Records Division may have to obtain your FOIPA records first before consolidating your name check data. Those who attach FOIPA make it easier for the Records Division to process their name checks. In either case, I believe it gets the dust off your file.

Realize that my theory could be totally and absolutely nonsense, so use your own discretion, but from my observations, these are the ideal sequence of events:
a. Request a copy of your FOIPA.
b. Send a letter to the First Lady's office pleading your case.
c. Send a letter to your US Senator (make sure you personalize your boilerplate letter).
Also note that if you send a letter to either the President's office or the Vice-President's office, they redirect the letter to the USCIS. The First Lady's office is the only one I know of that directs it to the Dept of Justice which then sends it to the FBI.
d. You can also send a letter to the congressperson in your congressional district, but they need to know that they should request information from the FBI and not USCIS.

Lastly, ensure that you strike up a positive relationship with the office staff of these elected officials. In my case, both my Congresswoman's office and my Senator's office staff are incredibly proactive and very very helpful. Extremely patient and greatly resourceful. They're the messengers, so taking a positive stance with them even if it means they tell you to call back in 30/60/90 days would only help your case.

Apart from what ks said, I would also suggest you to write letter to president/vp/some of the fbi officials and omb though OMB may not be that useful and it is just like opening an inquiry with USCIS.

I wrote to every one once without FOIPA copy and later with FOIPA copy. I always used first class mail to send my letters. Please note that I didn't get any reply from FBI or anyone about my name check clearance yet, though I got reply from VP/OMB on my case. Also remember, emphasis on FBI name check give A#. This way, it may happen that VP may forward it to FBI rather than to USCIS

I talked to NSC few days back and also today and both the times they were saying that my case is ready to be assigned to officer. When I was specifically asking about my name check cleared or not, they were saying unless security checks are done, it won't be waiting for assignment to an officer. I have an info pass appointment on monday and will know for sure what is happening with my case. I opened a SR too.

My take is do whatever you can do from your side and sit back for few months.

You're doing all the right things. Don't worry too much about your service request response. Apparently the service centers are sending out canned responses that really don't make much sense. I would advise sending a copy of the CC documentation along with the service response back to the service center and the Ombudsman.

Yes, I've read posts where folks have been confused about which route to go. If you don't have a Notary Public accessible, the easiest thing to do is the "penalty of perjury" declaration. If you do that, you do not need to get the form notarized. Its either or.

Yes, no doubt that enough time has lapsed in your case wherein you could start to be proactive in getting your name check cleared and have your case be adjudicated. I actually think you're in an enviable position to be able to put the AOS on the backburner of life. I wish I could do that, but I've been totally OCD with the AOS. You've got a couple of months on me as far as the 485 filing is concerned, and there's no reason why you shouldn't get out of this sooner than later.
As mentioned, I never got around to sending the FOIPA when I sent my letter to the First Lady's office. I sent my letter sans the FOIPA to the WH on February 14 2007 and received a letter from the Dept of Justice/FBI Records Division in the 3rd week of April, informing me that my name check was "in process" and they could not provide me with any timeframes for completion. My Senator's office had launched an inquiry with the FBI for me in the 3rd week of March, and on June 1st, they received an email response from the FBI that my name check was processed and sent along to the USCIS HQ in DC on May 22nd. So, I am pretty certain that the letter I sent to the First Lady had an effect and the Senator's inquiry simply reflected that. Not quite certain if it was a combination of the two...but whatever works I guess.
I had however, filled out the FOIPA just in case while all this was going on. I also did some research about what exactly to send in, and it is my impression that the FOIPA form is all that you need to send.

Why would anyone yell at you?
Anyway, the FOIA form can be faxed in, and the FBI has a fax number listed on the instructions; but the Privacy Act form (FOIPA) can only be mailed in, I believe it is the latter is what you're looking for.

Looks like ever since the dates have progressed to mid 04 (before everything became current), there havent been a lot of approvals comming through. Maybe the service center folks are busy with the new applications. Wonder when we'll see cases getting approved again...

Thanks for the props. The stuff I claim to know isn't anything that anyone else cannot crawl the web and find out. The thing is that I just have happened to have done it, so its more of a time-saver than anything else. I think I've stuffed terabytes worth of INA data in my brain and its good to be able to put it to good use.

Now, from what I've seen, both the NSC and the TSC have been processing EB3 cases from 2003 and 2004, with a few 2005s sprinkled in. I don't know what their logic for the EB3s is, since I always thought that the flow goes from EB1 to EB2 to EB3. I guess thats only for per country visa quotas...so they're processing by RD, which would be why they're purging ye olde EB3 cases.

The VSC to TSC transferees, self included, are SOL and have been told to wait another six months, because someone somewhere fked up and the TSC is presuming that the transfer date is now the RD...bullsht. So, a lot of folks have sent nastygrams to the Ombudsman voicing their protests..especially since the USCIS claimed that this was an internal processing transfer and it wouldnt affect applicants an iota.

I haven't seen a single transferred EB2 case being approved...a couple of EB2 were approved, but they were originally filed at the service center they were approved at, NSC or TSC.

If I'd to guess, I'd say that they'd start processing EB2 around mid-July timeframe. No idea about transferred cases. So, just hang in there...I tell myself that in the mirror every AM...

Yes, that is correct...from my understanding, the form should suffice. You can attach a cover letter if you'd like, but from what I've read of folks requesting their FOIPA records, the form is the only thing they've been sending in. The only stupid question is the one not asked!

.. since you and I have very similar case details, I am wondering what your plan of action is?

Here is what I am thinking right now :

Wait till mid July or so; then take another Infopass appt. to find out about name check. (I've called NSC a couple of times, but they wouldn't tell me the status of namecheck on the phone)

If name check is clear, then wait till 485 processing dates at NSC go 30 days past RD (which makes it early April 07), and then issue a service request to find out what's going on.

If name check is not clear, file FOIPA with FBI. Once the report comes in, write to Laura Bush, local congressman, ombudsman etc.

On an unrelated note, does anyone know if we need to keep all I-94 copies?! I thought I read somewhere that someone got an RFE for copies of I-94 apart from the current one.

Now are they asking for all I-94s since 485 was filed or since we came in to this country? If it is since 485 was filed, then I am ok (I haven't travelled since 485 was filed), but if it's since we came into the country, I have travelled on business and pleasure close to 10 times or more out of the country, and I certainly don't have copies of all the I-94s and don't even know how to go about doing anything about it at this point!

Someone please tell me it's since 485 was filed!

Hey Still, I'm just about ready to send a FOIPA request as well. Thanks to ks_cc being so active, this place is awesome - I've written to the First Lady, a Sentor and a Congressman. This is getting nuts again and its not pretty. Wonder if I should write to Cheney :D

You never know with USCIS what they ask..its a good practice to keep
a copy of the I-94's and I think most lawfirms insist on giving a copy
of the passport and I-94 whenever u return to US after a overseas trip.
I got an RFE for these and the lawfirm has responded and the processing
of my case as resumed as per the latest LUD..

I got an RFE for an I-94 which i had submitted when 485 was filled, you have to submit the latest/current you have when u file your 485.The only reason I can think of why an RFE was issued was I had changed jobs around that time.
the reason they gave was the I-94 copy was not clear enough...
Dont worry too much...now on this...just make a good copy of these
documents till you get your GC...just a good practice.
