I know what happens if derivative's name check gets cleared but primary's is stuck (ala what happened to ks) - you have to wait for both to clear in order to proceed.
But what happens if primary's name check clears and the derivative's is stuck - does primary's GC case proceed (to approval) or does it also get stuck waiting for the other name check to clear ?

Well, my Senator's office called TSC on my behalf yesterday. TSC confirmed that they received my FBI Name Check results and all is looking good, but, quote, they just cannot process our applications right now because they've got several applications and are very busy, end quote.
They asked the Senators office to call back after a period of...surprise...90 days...if we've not heard anything. This was the same number given back in March when they transferred the cases from the VSC to the TSC.
So, as I discussed with the Senator's office, they've essentially asked for 180 days post transfer. Considering the fact that my case had been pending for 14 months, which is 8 months over their processing time for AOS, asking for another 180 days is just overwhelmingly not cool.
Anyway. W-H-A-T-E-V-A-H.
Just 1 phrase........THIS IS JUST BS.................
You cannot do much, just wait...........just hang in there.............have waited so long, the bridge is not far............
Newbie,
You should have the EAD card physically in hand next week. Since your EAD is approved, you really don't need to file your H extension just to continue working. However, do pay heed to the fact that a lot of folks file their H1 extensions and having their H1s serve as an insurance policy, kind of a backup legal status, just in case something goes astray with the AOS applications. So I'd advise that if you have the coin to drop on the H1, do it, but its an individuals decision.
I remember BrittanySpears got her GC approved a few DAYS after she shelled out for H1B extension...
About your wife...she got her EAD too, right? If she did, then I think you're ok if you just file H1 for yourself...check with the attorney on that front. My personal case, we just didn't bother doing that for my wife. She's been working on her EAD, BUT, then again, she never held H4 status, always had her own H1.
