Concurrent Filing - Using Cross Chargeability

Thanks Prez.

I tried to ask about name check, but they were not telling, not even the date it was initiated.

Alex, take an Infopass appointment and find out about where your name check is. I'd also send letters to the service center like I believe william had in the past. It would also be in your best interest to send a letter to the Ombudsman explaining the issue and the service center's oversight...I'd first start with the name check and sending the correction letter to the service center. I realize how frustrating this must be.

Hi Dedo,
About a week all things being equal. But yes, the 30 days timeline is stipulated to cover any delays that may occur at the production facility, mail time, etc.

LUD Updates on our EAD cases

We see LUD updates on our EAD cases - both mine and my spouse's (05/15/2007); Does this mean that our EADs are approved? or it could be RFEs?

Thanks in advance!

Sounds like good news to me. But yeah, just by LUDs it is impossible to say what it is, but most likely it is your approval.

Haven't you set up an e-mail notification with CRIS when you set up your account? If so, you will get e-mails from them with some info when some status changes in your case. If not, you might want to set it up instead of relying on LUDs to tell you that something is happening.

Well - If you saw the LUD show up today, then you will see another tomorrow that says your EAD is sent for production. After that it is 7-10 days until you recieve it (from what I hear)

Congrats!

how is this PD moving forward by 2 years going to affect us?

Hey All,

Since the PD has moved by 2 years for all the countries, do you guys have any idea how this may hinder the progress of our cases. One thing came to my mind is that CIS may get overwhelmed by the number of new 485s coming in and that may cause a delay in processing of previously filed cases.

any idea?

Ks and anyone else who mgiht know,

To build on the above question, for the 485 stage, is it the 485 RD that serves as the basis of "first come first served" or is it the Priority Date ? If it's the former, that means this new thing should still keep us ahead of the wave of new filers, right? If it's the latter of course we are in for more delays. Does anyone know ?

Not in your case since your name check is done. I'd think the backlog might be at the FBI for NEW filers. For folks who filed and then got retrogressed, their name checks may have been done and the USCIS would get pretty darn busy.

Hi Prez
The PD gets you "in the door". After that the processing is via RD. Don't sweat it. If any delays occur it would be from cases already filed but their PD became now current...in which case their RDs are well ahead of us...but they deserve it (not that we dont, but they've been waiting longer). I'd expect the fallout to be reflected in the CIS 'now processing' dates that they publish...perhaps the July publication would be indicative.

Ok, that makes sense. Yes, the ones who already filed but got stuck and are now current will move in line ahead of us and that seems fair enough, but the new filers will be behind us because of our older RDs. Thanks for the clarification!

Its about time

Just heard the news that the dates have moved almost 16 months for EB-2
How is every one doing? I guess this bodes good news to us CC so that we do not languish if our cases are looked over by people who are not aware of CC :) unless of course, UCSIS gets overburdened with new applications that they forget to look at CC cases :-(
Ks_CC any luck with ur name checks?
Sorry I was on the road the past few months and had not time to log on.
I got FP done for my spouse and myself
FP - Spouse - 04-03-07
FP - Myself - 03-31-07
I have not seen any LUD on either of our cases :-(

Hey bud,
Welcome back! Bet you thought I wouldn't be here :)
No, still stuck in name check... got a letter from the FBI a couple of weeks ago telling me that my name check is "in process".
Well, sure beats a letter from them stating "name check...what are you talking about?"
True...the AOS flood is about to begin. These folks have been waiting a long long time, so I bet this has made so many folks deservedly very happy. I dont think CC really figures in their processing in regards to when they get around to it after you've filed. They just go by receipt date and whether name checks are cleared.

I called again yesterday, being routed to NSC and spoke to someone there. Apparently, my case hasn't cleared name check. So, while them not recognizing CC is no longer an issue (I hope) due to recent advance in PD's, I'm now stuck in name check, which is worse. The person I talked to suggested that this is a process that will take anywhere from a few months to 4 years (what!?).

I learned that some of us here are in the same boat as well. I guess at this point in time, there's nothing much we can do. Too early for Ombudsman (not sure if that even works these days), and too agitated to not do anything... pretty much sums up where I am now. I wonder if FBI needs any weekend volunteers for their manual security check details, I'm sure they can easily draft hundreds from this board. Oh, I forgot you need to be a citizen for that, and you need a green card before you become a citizen, and you need to clear name check before you get a green card. Too bad, we're in a catch 22.

Well, look on the bright side, at least you know for certain where the hold up is. Don't fret too much about the name check. Odds are that you'll get out of the name check in good time. Six months is a reasonable time to start taking proactive steps to help move the process along.

Good to hear it. Congrats!

Received mail from CRIS this morning that APs for me and my wife are also approved and is on its way to us. So now only the big fish remains...

Hope I don't have to mail back in a year saying our 2nd EADs and APs are on their way too :p

Oh Crud! Well they send you a letter explaining what you already know. What do you plan on doing? I presume that you have already got the infopass appointment and spoken to someone about this.
