Oh Crud! Well they send you a letter explaining what you already know. What do you plan on doing? I presume that you have already got the infopass appointment and spoken to someone about this.

WellWisher, congratulations on the EADs. I figured thats what the LUDs would be. Prez, congrats on the APs.

Huizet, I've pretty much exhausted my options at this point; congressional intervention with the TSC, senatorial letter to the FBI (waiting for response), letter to the First Lady (got me a letter from the FBI indicating that the name check was 'in process'). My next recourse would be to await response from the senator's office and have the congressperson's aide call TSC back in a month like she said she would. I'm also planning to write to the CIS Ombudsman, although I know that it won't really amount to anything. Other than that, its either wait or WoM....and I guess I'd just wait.

GC_LIKEE, don't sweat it. From your RD, I would guess your AP should be approved pretty soon. Looks like your EAD came through blazingly fast though.
 
Please Help!

I believe my CC application will be returned by the NSC without looking the fact of CC. One of my co-worker (Philippines) who’s AOS was filed three days after me has already received the receipts.

Is it possible they have rejected my application because MY PD (based on India) will be current next month?

What are my options? What can I do to avoid the same thing in future? I just want to be preparing for the worst.

Would it right assume that for a CC application it might take extra time to receive a accepted/rejected notice?

William uploaded a document that describe the internal process at the following post

After reading that it looks that a CC application would definitely be rejected by initial contractor and then might be accepted by an INS reviewer.


Any Advice on that.

Hey VS,
Yes, we've all mostly experienced this. The mailroom processors do not know or care about CC. To increase your odds of being accepted past the mailroom, you need to highlight the CC clause and perhaps address it to the mailroom supervisor. If it comes back, send it again. For some it takes about three tries before the service center gets it right. Find WellWisher's post from way back. His was the most well prepared and thorough CC application known to mankind. Hang in there, you'll get through...we all did.
From what I gather, you're supposing that this will get returned on the first go...check to see if your checks have been encashed. Thats usually a good indicator of acceptance.

My lawyer is consistently insisting that they have clearly flagged the application for CC and it is very unlikely that it would be returned. So far I have very good experience with them in last 5 years.

I didn’t issue checks for my case my company did. So I really can’t you this workaround. I wish ( I really don’t wish ) I had.

Please advice.

My lawyer is consistently insisting that they have clearly flagged the application for CC and it is very unlikely that it would be returned. So far I have very good experience with them in last 5 years.

I didn’t issue checks for my case my company did. So I really can’t you this workaround. I wish ( I really don’t wish :) ) I had.

I'm not quite certain about specific delays per se. Note that in CC cases, the receipts may take slightly longer since if it gets correctly noticed, it would go through the mailroom supervisor and so forth. I'd suggest not basing your timelines on anyone else, since folks who file the same day aren't guaranteed to be issued notices at the same time either.
I'd also say that the majority of us have been subject to the service centers improperly sending the applications back...and having them be accepted on the second (or third) go around. So hang in there and relax. You never know, they may have already accepted the applications and the notices might be forthcoming. One way or another, you should hear something soon. I realize that its VERY frustrating, but speculating isn't going to answer your questions or put your mind at ease. I recall being borderline insane when my applications were sent back the first time. But all you can do is try again since you essentially have published laws and rules behind you.

I do realize that I am being little over anxious but sometime you can't control. After waiting five years now when I have the opportunity to file AOS I have to rely upon on someone else’ mercy to see CC clause. I am in position where I can't wait to have receipts.

I do realize that I should not compare with some else timeline for getting receipts but, the only reason I was because his application was filed after few days of mine.

The other reason I want (actually I wish) my application to get accepted on first round because as of June 1st I can’t use CC. If I have to re-submit my application I have to do it without CC. I would still want to use CC because chances of ROW dates moving back to where they were are very less as compare of India.

Anyway I have to wait and live on someone's mercy.

VS, I fully understand your angst. I'm currently at the mercy of the FBI. If its not one thing, its the other. The frustrating aspect is that you have little control on these things.
BUT, I've got good news for you. Even if they do overlook the CC and send it back, you can still apply using CC post-June 1st. Your attorneys can successfully argue to the effect that the original filing date should be retained because the mailroom screwed up and it wasn't YOUR fault or delay in filing. You can use CC at anytime regardless of if your dates are current or not. If its beneficial to use your spouse's country of chargeability at any time, I believe you are entitled to do so.

VS - I am not sure when you applied but it seems that these days the staff is well informed to recognize a CC case. We applied via CC concurrently and our attorneys informed us that though there were rejections early on, the rejections have almost stopped now in 07. We applied in mid March and got receipts within 2-3 weeks of applying without any hassle. So if your attorney is competent then you shoudn't worry. When did you submit the application?

Once your application is acppeted you will start to see finger printing, AP, and EAD approvals within a few weeks

I am in similar situation but not same. Because I am using PD portabilty from my old I140 which is current for I140/485 concurrent filing. My lawyer finally filed in April even though I have been pushing him from March 2nd week. He recieved the email for I140 PP in last week of April and this week the I140 is approved and waiting for the approval notice. He voluntarily sent a specific update to CIS 2 days before I140 approved with ref to my I140 Receipt# because he did not recieves my other 485 receipts. I saw on line update received message and next day my I140 approved. We are expecting my new 140 will have correct old PD and receipts for 485 should follow with it. Lawyer says he attached cover letter properly. Hoping it may be true for special cases need additional review so thats why delay in receipts.

My PD is 09/2002 (India). It's been 3.5 years since I filed my 140/485. I got my 140 approved after 2 years. I requested CC thro' my lawyer on May 02nd 2007 since my wife was born in non-retro country. There's no response yet. My case pretty old case. IF I APPLY FOR EAD, WILL IT TRIGGER MY 485 APPROVAL? ANY OPINIONS? Thanks.

Absolutely. Your CC application will be forwarded to the Texas Service Center and you should see receipts in the next week or so. After that the FP notice should be forthcoming. No need to worry just yet
 
Folks - How long did it take you to receive your EAD cards once you received an email that you card production had been ordered? I know the email says upto 30 days but i wanted to get a more realistic timeframe

Saw this question from you a couple of days ago and finally am in a position to answer it. I received EAD approval e-mail from CRIS on 5/10. I received the physical cards by mail today 5/17. So for me, it took exactly one week.
