Concurrent Filing - Using Cross Chargeability

I know my questions might annoy some of you who are waiting for the N/C to be cleared. Please forgive me.

I know FP expires in 15 months. But does the name check expire too?

This may be a valid question for people whose PD not current but 485 pending for more than a couple of years.

Nope questions aren't annoying at all. Yes, FP expires in 15 months, but the name check does not...especially if in the clear. If its been PENDING for a long time, CIS might send in another request, but they don't expire once cleared as far as I know.

Congratulations to all the three! By the way, how do you know that N/C is cleared? Do you receive seperate communications? When does this usually happen? I have given my fingerprints already. So just curious

Save your congrats for a little while, but hopefully not too long :) Their name checks haven't been cleared (except for pururwa).

You don't receive communications if your N/C clears - it's an internal step for them. But if you want to find out, you can make an InfoPass appointment and ask the immigration officer.

When does it happen? Good question! Um, 3 months to 3 years and anytime in between. No one knows.

There is absolutely no connection between fingerprints and name check clearance, I'm afraid. None whatsoever. (Unless it is a BAD connection, like the FP triggering a criminal's file) If your don't have your GC 15 months from your FP, back you go for a second FP. And so on...

I don't mean to sound negative, but just be aware of these issues. It's better to be pragmatic and not have false hopes. On the other hand, be ready to get pleasantly surprised and have a GC in your hands in 6 months time :)

Prez is right...we're not out of the woods, just hoping to be sooner than later. Sorry if the statements caused any misunderstanding.

Welcome. I'm sure Still would update your details into the Excel sheet he maintains so well. Its really hard to provide an estimate on when you should expect an approval. I'd say six months is a reasonable timeframe, since that is USCISs stipulated processing goal for AOS adjudications. What is unknown is the time it may take for your FBI Name Check. Realize that this is the step that a lot of us on this thread, and the forum as a whole are dealing with. There is no time frame projected for name check clearance and thats what makes it tricky to estimate. If all goes well, and you don't get mired in that process, I would say that under six months is a reasonable expectation. Good luck and welcome once again.

ks_cc thanks a lot for the welcome. How does one know if the appl. is stuck in name check and how does one go about finding the status of the name check? I apologize in advance if I am asking a question that has been asked many times before.

No worries.
You can find out the status of your name check by making an Infopass appointment and asking the immigration officer at the Application Support Center (ASC) where you get the appointment. Infopass is free, and you can make an appointment for yourself by following this link:

I don't think you need to worry about name check just yet. If its been over six months of your filing, then you can start making enquiries regarding your case. You can also try calling the service center directly using the POJ method (just search for POJ in this forum) to speak to a service center officer. Know that these folks don't divulge name check status over the phone due to security reasons, but some times you end up speaking to an empathetic person who might reveal your status as far as name check is concerned.

As far as determining if you are stuck in name check goes, if its been over 6 months since you filed, odds are that you might be in name check limbo, since FBI tries to process all name check requests within that period of time. At least thats what the claim is, but given the sheer volume of individuals in name check, it is my opinion that the statistic is slightly overstated. Note that even N-400 (citizenship) applicants undergo the same name check process, so the agency deals with a large volume of requests from USCIS.

My application is filed in Texas SC. No there was no expedite request. I was very surprised too that the EAD was approved so quickly. AP is still pending.

No update on my EAD case yet. I will initiate an inquiry if I do not receive any response by 05/18.

Our AOS (including EAD AND AP) application was out on mailed on 2nd May using CC. When should I expect the receipts?
