Concurrent Filing - Using Cross Chargeability

Looks like I received the "magic e-mails" today (at 9:00 p.m. no less) saying that card production had been ordered for me, my wife, and my older daughter. I wish everyone else the best of luck with their cross-chargeability filing since it appears that there is hope after all.

Nice! Congratulations!!

My Details

Hello All,

Prez had asked me to post my details.
here they are:

labor P/D: Jan'06 AD: Mar'06
I140(TSC): ND: Sep'06 AD: Oct'06
I485(TSC): ND:Oct'06, FP(code 2): Nov'06
LUD: Oct'06 (about receiving the petition) no LUDs since then, not even after the FP. N/C cleared: Mar'07 (my guess since I don't know the exact date, never asked TSC about the exact date)

Thanks

Thanks Pururwa.

So far, the one common thing between the three approved cases on Still's spreadsheet, craye's case and pururwa's case is that they were all TSC cases! We need an NSC approval soon to start evening things out :)

BTW, I did not have to use the "POJ trick"; or initiate any FOIPA requests, senatorial or congressional inquiries, or letters to the First Lady since I was pretty close to processing times put out by USCIS. If I hadn't heard anything in a few weeks, I would have resorted to the above methods.

Thanks ks_cc

Craye's details are in Still's Excel tracker. He filed for AOS in September 06. Sorry for jumping in Craye, but I figured you may not be back to frequent the forums as much :)

Thanks for the reply. Where do I find Still's tracker? I tried going back quite a few pages but couldn't find any tracker.

Congratulations Craye!

I got a call from the Congressman's office yesterday in response to the letter I had sent them about 2-3 weeks back. They said that they inquired about my status and my Security Clearance is pending. They said that they would inquire again after 90 days...

I am going to use CC option for my 485 filing .My case was filed for EB2 perm in march 1 st but still waiting for Adjudication .I have 2 questions. 1)what is the normal time for labor to be approved 2) Is it better to do 140 PP first and get it approved and then go for 485 (since i need to get the EAD earlier) 3) Is faster aproval of EAD dependent on earlier 140 approval date

EAD and AP take about 30-90 days to get approved after filing. EAD approval is independent of 140 if I am not mistaken

PERM labor should happen in 30 days or so

Good Luck

140 PP is always a good idea, but regardless of whether you file PP or not, you can file 485 concurrently with 140 (as of right now, there's some rumor that concurrent filing may be stopped).

Hello John,

Welcome to CC. Hopefully your CC filing experience would be easy given the amount of information that has been posted on this thread. It would behoove your interests to locate and use WellWishers filing format. I don't remember exactly how long ago that was posted, but I'm certain he can point you in the right direction.
Dedo and Prez pretty much answered your questions. As mentioned, it definitely is a better route to choose premium processing for the I-140. The I-485s cannot be adjudicated without the 140 being approved, and the timeframes for regular 140 processing are all over the board. I personally filed regular since premium wasn't an option at the time, and I believe I was one of the luckier ones since my 140 was approved in a little over two months or so.
The EAD approvals are independent of the status of your I-140 application, and you would send those (I-765 for EAD and I-131 for Advanced Parole) when you file for the AOS (I-485).
Good luck and keep us all posted.
Regards

i agree with ks.. Go for 140 PP. My first 140 was approved in 2 mths.
My 140 ammendment is pending since Sep 2006 and i am not allowed to use the PP option.

I am hoping the 140 is the one which is holding my 485 from completion..

Any guess?

My case is EB3 India and my PD is 09/2002. Since the worldwide date moved to 08/03 and also my wife was born in non-retro country, I requested for CC on May 02nd thro' my lawyer. How long will they take to approve my case? Any idea friends? I already gave 4 times finger print, renewed 4 eads, 3 APs.
Thank you.

Hey Skp,
Good for you! You certainly have been waiting for a while.
If your name checks are cleared, it should not be too long for you and your spouse to receive your approvals. Since your case is pretty archaic, I would assume that your name checks have been cleared. Can you make an Infopass appointment and find out about the name checks? If all goes well, wait for about a month or 45 days and file an inquiry. I dont think its going to be more than a couple of months given your dates are current thanks to CC and since you case is as old as it is, chances are your name checks are done.

thx

Thanks for the reply sir. Is it possible to get an Infopass appointment to find out name check details? My name is common indian name (Sekar), and I'm also very optimistic about my security checks. It's been 43 months since I filed my I140/485 (concurrent filing). Thanks again.

Hi Skp

Its very easy to get an Infopass appointment. Go here http://infopass.uscis.gov/ and schedule an appointment. The appointment will probably be scheduled at the closest ASC to your address. It doesnt cost anything and lets you talk to an immigration officer who has full access to you case, for once.

Hello Sekar,
As Vikram said, schedule an Infopass appointment and determine what your name check status is. Since it has been 43 months since your AOS filing, I would be stunned if your name check were to have been still pending.
Odds are, USCIS would send you a new biometrics appointment for your spouse and you in the near future, and your approval would follow just a short while afterwards. You are probably on the cusp of being approved.
Since your CC request just went in, I'd give it a month after the request and initiate an inquiry.
Hope this helps. Please do post the outcome of your Infopass. You're almost out of the woods my friend. Your sheer patience will bear fruit quite soon.

Hi guys,

My 485/EAD/AP petition has been filed on May 2nd. My question is about color copy. I didn’t submit any color copy and moreover not even a B/W copy of DL.

Now I was reading this thread and am confused little bit.

Is it necessary to submit color copy? Why do we need copy of DL?

My lawyer didn't ask for the color copy. He didn't ask for copy of DL.

Please Advice, what should i do?

THanks,
VS
