Concurrent Filing - Using Cross Chargeability

Prez, I read on a different thread about this person awaiting his FP notice for three months only after which he initiated inquiries with USCIS. Not to state the obvious, but my opinion would be to not wait that long.

Yeah, I won't wait that long. If I don't get a FP notice by 4/16, I'll initiate enquiries according to the methods you've suggested. Thanks.

Ok, I got all my receipts today (140, 485, 131, 765). What next? Where do i track and do I have to do each one seperately for me and my wife (meaning 8 things to track)?

Ks_cc - Looks like mine went to the Texas Center for processing. I have created the tracking account like you said. Looks like the last LUDs were on 3/27
 
How long did your Labor take? Did you use PERM?

There are so many folks out there that are still stuck in Labor after 4-5 years, and then we have to look forward to retrogression. Atleast I married well and can use CC

I've been at this since 2000, but the one that really clicked was the PERM with the current sponsoring employer. I was done in about a couple of months if I remember, as far as the labor was concerned.
Yes, by stating that we've come this far, I stress upon that fact that at least we can, as EB2 candidates, file for AOS. A lot of our Chinese and Indian bretheren aren't as lucky.

Thanks. Its unfortunate, but if it was easy, everyone would have a green card.
About Sen. Obama's bill, I did some more research on it. The highlight of the bill is that they appropriate funds to backup the provisions in the bill. I think what the Feds have been most lacking is sufficient funding.
Despite my obvious bias and dismay at being stuck in the name check process, I really do empathize with the FBI Records department personnel. I do believe they're overwhelmed by sheer volume, and its not like they sit around and purposefully delay applications. I do believe that they have a tough job and they're doing the best they can given the limited resources made available to them. Thats not a personnel issue, but a bureaucratic issue.
The Ombudsman also prioritizes increasing the FBI name check efficiencies as a top line item in his 2007 report.
Unfortunately for those of us currently stuck, Sen. Obama's bill would bring little if any immediate relief. I don't believe that the bill would go into immediate effect anytime soon, so folks down the line may benefit. Good for them if it does happen because I wouldn't want to wish this anguish on anyone.

I've considered it, but at this point it would do little to move the process along. As you're probably aware, CIS released a memo on Feb 20 clearly stating that unlike in the past, pending federal litigation would no longer be the sole criteria for USCIS to request an expedited name check from the FBI. This was clearly done to stem the floodgates of WOM cases faced by them, and for the most part its been quite successful, since it effectively discourages folks to sue the CIS and/or FBI. This does not mean that you cannot file a lawsuit, all it means that CIS would most likely take the matter to court, where the decision would be made by a federal judge. Long story short, its going to take longer and cost exponentially more to litigate.

Received travel documents for both self and spouse today. 3 Copies of each, not sure why 3 copies. Received teh EAD cards a week ago. Can I apply for SSN for my spouse with the EAD? She currently has ITIN.
 
So i received all my notices and noticed at the bottom that they are from the Texas processing center. Is there any advantage of one prcessing center over the other? Are all the apps (485, 140, AP, EAD) processed there together now?

Indeed, moving very fast. As my PD was current there was no need to wait so my I-140 was filed Premium Processing. I didn't file for EAD because I just finished my First year on H1-B. Also the secret is that I was very aggressive with my lawyer and employer to make sure everything was correctly filed to avoid RFEs or Rejections. Believe me my Forms were full of mistakes thank God that was a wake up with the help a lot of reading on these forums on mistakes made.

I came to realize that the source of our misfortune with USCIS is the fact that we (applicants) are uninformed and some law offices are a big mess.

My labor was filed on Sept 17th, 2001 and went to Backlog elimination centre. We never received approved copy but when they opened status check system my application showed as approved. When my Attorney contacted Backlog centre they said they sent approval but returned as Attorney moved office. They also said they cannot send another copy.

So my Lawyer filed my I140/485 asking USCIS to request copy of Labor from Department of Labor.

I was wondering Has any one been in this situation? If so What was your experience. Did DOL replied promptly replied for USCIS request?
