Concurrent Filing - Using Cross Chargeability

Can you let me know what kind of extra evidence can be used to prove the marriage? I thought a certificate is good enough...

I was away for a few weeks so here is an update. There was an RFE issued on my spouses case on 3/11/08. They wanted 'proof' of our marriage (the marriage cert apparently did not suffice). We responded to the RFE and it was received at USCIS on 3/25. Saw an LUD on my spouses case on RFE response recd on 3/26. No change in my status, but at least someone is looking at our apps 13 months after the RD.

I'm very glad to report that we have received the approval emails late Friday. I remember reading somewhere in this forum that USCIS is currently working towards adjudicating old cases pending for more than a year. Judging from recent approvals including ours, I believe this is true after all.

This forum has been very informative and supportive in this long, ardous journey, so thank you all! For those forum members who are still waiting, especially old timers -- the day will come!

That's interesting MMU. I wonder if he saw any LUDs prior to approval, or directly got the magic e-mail after March/April last year with no updates in between.

I think "Mansarovar3000" got his GC a few weeks ago. I don't remember exactly when, but feel like I had seen his posting a few weeks ago indicating that he went green.

I wonder if "gokris", "nidhin_n" or "mali03" got their approvals, or any recent RFEs or LUDs at least. It seems like their cases are awfully similar to mine.
 
thanks for pointing it out. I have looked up the rest and except for "navneesharma" I have validated all the rest and as long as they have updated at some time this should be complete

That's interesting .... I thought if CIS does not consider a case for Cross-Chargeability, they would not accept a 485 application to begin with, if the PD was not current ..... so just the mere fact that CIS has accepted our I-485 applications while our PDs are not current (at least in my case, EB2-India) means that we are being considered for CC....isn't that true?
 
That could be true at the time of sending the application in. But once it has be relegated to the files in those boxes (and this is true) maybe they do not always keep track of where the files are. I am not sure. Just makes me wonder why we have not got approved yet and any number of reasons could come to play. I had already asked my lawyer to send in a reminder letter last week. Lets see if it bears any fruits. This particular case seems like a conicidence too in the sense from all I have heard of uscis how can they respond in 2 days.
His file may have just been in the right situation.. Does not hurt to REMIND them i guess.

I agree completely. Might be a good idea for me to do that as well. Quite simply, with CIS You never know. Thanks MMU.

Our assumption was that a marriage cert should suffice as well. but USCIS works pretty mysteriously. They asked us to provide a whole list of documents to prove our marriage. Some of the documents we submitted included previous tax returns, joint account statements, joint credit card statement, life insurance policies, medical benefit statements, home/auto lease/ownership info etc. If you have a kid and have the kids birth cert that usually does the trick and you do not have to furnish the above mentioned docs.

It might be a dumb question but well wanted to ask....what really matters for 140 processing? LC PD or RD of 140?
From trackitt it seems avg approval time for 140 at TSC is somewhere close to 280 days...and than there are cases like this which pops out of nowhere
Any idea?

To the best of my knowledge, I-140 processing should depend on nothing but the I-140 RD.
