I have got an opportunity to join Chicago based company and confused about GC.. I have only 9 months left in my H1-B.
--- Have to any pending LC from past employer more than 365 days? If yes you can extend your H1 for the 7th year.
--- Don’t know if your employer is ready to file in RIR, how many days your lawyer will take to prepare the papers and filing the LC with SESA (if they have completed advertising) if filing in regular you may not be able to get LC approved in 9 months (it is taking more than that at this time nobody knows about the future)
- Depends on your SESA as the case is filed first in SESA you have to search how much time particular SESA is taking, from SESA it goes to Chicago DOL for the final approval, from the date it is received in Federal DOL Chicago they take about maximum 3-4 months (recent trends) it is SESA that takes longer.
---DOL was supposed to start PERM for LC but it has been being delayed for 2 years, if PERM gets started one can get LC approved in 20-30 days, recent info from DOL is that they may publish final PERM regulations in September 2003, with 60 day comment period (it has been postponed many times in past do know if they will publish in September)
--- Take a chance by filing the LC, because if PERM starts then one can claim earlier PD of filing with SESA (PERM has many restrictions for employers)
Please someone advice, what is a average time to get LC through IL,Chicago.??
