Does not process any application (including I-485) with in six months (or the time they say on the phone). It is legislation cong. passed last year, if I am correct and hence this transfers and shifts. But, there is no such time limit for DOL.. However, Texas DOL supposedly combined processing with Denver DOL.!!
 
Is it a Holiday factor ??

Is it because of Lincoln\'s Birthday holiday there were no work at DOL yesterday??? as a result you are not getting any list of processed cases...!!
 
It\'s not lincoln B\'day.. but

it seems DOL processed so many cases and received so many cases from SESA, dol server broke down, while trying to input this enormous data..
 
Only 20 Cases yesterday but the Good News is -- It processed some NOF Cases - so there is a hope

Hey guys so RIR denial is not only for IT guys seems to even hit Dentists and Biologists ???

Also Rahul how many of there were NOF cases!!! Seems like DOL is on track but since these are special cases not too many are processed per day

Anyone\'s case have forward form MA SESA with priority date around April 30 and already find the cases in DOL database, please reponse, I just can not find my case in dol but the MA SESA shows that they have done the April 30 RIR case long time ago.

3 NOF Cases got Certified today... I agree but still it provides some hope for guys like me who are expecting NOF

Yes, I know of people in my company (a very large high tech company) who got NOFs and were subsequently certified. I got an NOF a few weeks ago, and my corp. immigration people called to tell me what was going on - and that they had been successful with the rebuttals they have filed thus far. It is an involved process they tell me, involving collection of a LOT of data about similar people in your position who were laid off, their qualifications, your unique skills and contribution to business etc. The way they made it sound, the more GOOD data your employer can provide to DOL, and the better your immigration counsel can package and present said data, the better your chances. Like I said, our company has been fairly successful (all over the country, including here with MA DOL) and I\'m given to understand it is due to the diligence of our HR, legal and immigration teams. I am quite positively bouyed after seeing that my employer is putting in their utmost effort - in the end - upar wale ke haath main he (It\'s all in God\'s hands)...hang in there - and be warned, it is a lengthy process. Our company says it takes two weeks to collect the data, and another week to prepare it before sending out the rebuttal - and then you have to twiddle your thumbs till you hear back from DOL (anywhere from 10 days to many months). Happy waiting..
 
Why RIR cases were all denied

It seems that all RIR cases were denied, is that right? For other cases, if it doest not list RIR, does it mean it is regular LC case?

Why RIR cases were all denied

The basic premise of an RIR case is that a company had been engaged in hiring for the position for an extended period, documented the search extensively, and found few qualified candidates from which YOU were chosen. Now, with mass layoffs, DOL probably figures - it\'s not hard to find talent like you\'ve got - so its questioning the RIRs. Also, in most cases, it was medium to large size companies that were doing extensive hiring who were able to get their employees on the RIR bandwagon. These same companies saw their fortunes shift dramatically, and laid off thousands - those H1 employees who got to keep their jobs and had already started the Labor cert. process are now being NOF\'d one by one - DOL just wants your company to explain to them why you\'re still around while an American in a similar position was let go (if this happened in your native land, I\'m sure you would think it mighty fair). If your company can make the case, you\'re free to move onto I-140 - if not, they\'ll deny your RIR either because the company/lawyer did a poor job putting RIR data together or the DOL is not convinced that your position matches the criteria for a labor cert (one of which is that you are not taking away an American\'s job).
