Yes, I know of people in my company (a very large high tech company) who got NOFs and were subsequently certified. I got an NOF a few weeks ago, and my corp. immigration people called to tell me what was going on - and that they had been successful with the rebuttals they have filed thus far. It is an involved process they tell me, involving collection of a LOT of data about similar people in your position who were laid off, their qualifications, your unique skills and contribution to business etc. The way they made it sound, the more GOOD data your employer can provide to DOL, and the better your immigration counsel can package and present said data, the better your chances. Like I said, our company has been fairly successful (all over the country, including here with MA DOL) and I\'m given to understand it is due to the diligence of our HR, legal and immigration teams. I am quite positively bouyed after seeing that my employer is putting in their utmost effort - in the end - upar wale ke haath main he (It\'s all in God\'s hands)...hang in there - and be warned, it is a lengthy process. Our company says it takes two weeks to collect the data, and another week to prepare it before sending out the rebuttal - and then you have to twiddle your thumbs till you hear back from DOL (anywhere from 10 days to many months). Happy waiting..
