BEC Priority Date Tracker

I thought that once the cases got transferred to Phily or Dallas, they would treat all LC by PD. How come some LCs with a 2004 PD have already received their 45-day letter when some with 2002 or 2003 haven't ?

Any thought on that ?

The real answer is: Who knows?

But:

Processing is supposed to happen by PD, which is not necessarily the order of 45-day letters. Although I agree it would make more sense to send those in order of PD as well.

There is also speculation about Regional cases being processed before SWA cases.

I think it will be 2-3 months before we get a real answer.

I found an interesting thing on the Department of Labor budget:
http://www.doleta.gov/budget/05app$.pdf
http://www.doleta.gov/budget/06req$.pdf

FOREIGN LABOR CERTIFICATION has $44,144,000 for the 2005 budget

That is quite a chunk of money ... and it is slow

And in another piece it says:

"The Administration will propose legislation to establish a new fee for applications under the permanent labor certification program. Fee proceeds would offset the costs of administering the permanent program and partially support backlog reduction in regional offices."

Who here would mind paying an additional $1000 if it means a 3 to 6 months processing time ?

Now I also saw something that will make everybody laugh:

Performance Metrics
2004 actual 2005 est. 2006 est.
H–1B Labor Condition Applications Program:

237801 Percentage of H–1B labor condition applications
(LCAs) for which no prevailing wage issues are
identified within seven days of filing............. 99% (04actual) 100% (05est) 100% (06est)
237802 Percentage of H–1B labor condition applications
(LCAs) for which no prevailing wage issues are
identified within two days of filing. .............. 95% (04actual) 98% (05est) 98% (06est)

Permanent Labor Certification Program:

238001 Percentage of backlogged applications for the Permanent
Labor Certification program that are resolved
each year (measured against backlog remaining
each year). ........................ ................... - (04actual) 20% (05est) 100% (06est)

so it means that they identify issues within 2 days of filing but those are resolved to non isuues in the next 5 days :D

For permanent LC, they plan to clear 20 % of the back log in 2005 which I guess is pretty good (IF they do it), considering there are only 5 months left in the current financial yr.

status letter or priority letter

hi,
Maybe my question is not related to this thread, but I appreciate any input from members. I'm in dire desperate.
My LCA was filed on May 24,2004 while my 6 year H1 will expire May 27,2005. My attorney request status of my LCA to NY DOL and BEC for a full month and no response yet. Could any one tell me how they deal with similar condition? What's the chance of get 7th year H1 extension without DOL letter?
thx

Dear yxd0018,

There is no letter required from DOL for pending LCA. Your attorney will type on his/her letterhead stating that your application is pending and will attach a copy of the LCA application filed along with delivery confirmation (usps tracking info etc etc).

You will get 7th year extention. God bless u.
