I've stopped checking my status on AVM everyday. I am only doing it once a week now (every friday evening). As of last friday no changes(still received). Looks like all DOL's are dead b'cos of non funding and even the processing times are not being updated on the DOL website.

I haven't got my case number. I am not trying also. I know, all the efforts is going to be waste only.
 
I am relying on what my attorney said. So if they are showing Dec'02, that means my case has been assigned to analyst now for review based on my Dec'02 recvd date. Now how much time analyst is going to take, god knows. We have an idea that analyst could come to a decison in a week or at most 2 to 3 months. So I am expecting decision from any time now upto March end.

I have had enough of " waiting for the Godot" in my life. I am tired, frustrated, angry, helpless and humiliated with this slavery.
Mine is a straight case. WE have even applied for limited review in addition to RIR.
Nothing doing.
If mine does not get approved by the end of this year.
I am HISTORY..

UNITED WE STAND, DIVIDED WE FALL

I am planning to send a letter to the President and Senators to help us in our cause to make the labor certification backlog have some justification. Are any one of you guys interested in co-operating?

Guys, if we go and wait behind closed doors nothing is going to happen. We need to fight for our cause. We are legal immigrants and have done nothing wrong. If illegal immigrant get better treatment why cant we expect treatment atleast in par with them?

Are there any courageous people left in the forum, or people reading and writing in this forum and just there to keep on talking of the plight and agony of what they would be facing.

We need better treatment than what we are getting. People say it is bureaucracy and it will be like that. That doesnot justify in itself. What other parts in the govt system do we expect such unresponsiveness?

If one goes to get driver's license, he wont be told to apply for it, and we will let you know in 6 months when you can take drivers test, neither would IRS tell you that we would send your tax refund in 5 years. Why is that only this division of the govt doesnot have any justification in the delays faced by us.

We are paying fees in applying for GC? It is not a free service. I understand it is privilege, but it is not a torture. Average labor certification should not take more than 15 min to check, and the only thing they reply is "YES, it is approved", or "NO, it is not approved".

If we stand united atleast like the illegal Mexicans we should be able to get equal justice.

Are there any one in the forum who have guts to join me in sending a letter to President and Senators?

I have been thinking of doing this myself for somethime. But my only concern is whether our letters would ever reach the destined hands?

I think it has become necessary to bring the matter into their attention. LCA taking about 6-8 months is still acceptable, but how do you justify 26 months wait and still no signs of approval?

This is the right time to push for our cause. We have to convey our message to President Bush and top Senators. If they can think about illegal immigrants, they would certainly hear about law-abiding and tax paying legal immigrants. We would have to let them you what happened in 2001, when they allowed many illegal immigrants to file for permanent residency without enough budget to clear the labor certifications.

Look at other people in the forum, just keep on mouning and crying but still NO ACTION. They want some one to fight for them. They should put bangles and sit home, and stop bitching.

I resent your last statement which seems to imply the female gender. You forget, not only males subscribe to this thread.

I am one for action. Here are some food for thought. What is the course for action? Who is our representation? What is the monetary implication? How will this affect our applications? - are all the time questions that has to be addressed. We have to be rational and not hit out when our emotions are at all time high so that we don't come out with statements like the above.

Again, all of us are different in our social standing. Some of us have prior commitments, families and debts. I do not appreciate particularly sweeping statements such as the above that seems to stereotype the whole thread community. So if someone wants to do the groundwork for the above, they are welcome too. Don't forget to consult your own attorneys too and get their professional opinion on the above as you do not want to contradict your applications in any way.

Good approach and very courageous.

In fact, I did sent out letter to Georgia Governonr and Senetor 2 months ago. There was no reply. Then I called Governer's office (Governer Sonny Perdue) and was told that their office forwarded my letter to DOL to look into the delay issue.

You know what? ATL DOL contacted me and here is the response.

"ATL DOL is understaffed, as per their work load, compared to number of applications they received for last 1 and half year. Department is working on improving the performance of processing. All further communication regarding your case must be done through your attorney or his/her representative."

Here is my opinion : We cannot really enforce any laws. All dealys and issues are already known to Govt and is working on IT systems to improve the efficiency of the departments (as posted on www.immigration.com few weeks ago).

This is going stay as WAIT and SEE game. Nothing more than that. Atleast from my side I do not want to bring any more special attention at my case any further.

Governer's office and President's office are well staffed to look into each and every letter. But, keeping current conditions, they have more priority items (upcoming elections) than these minor issues.

You still can gather for a movement. I am not discouraging, but letting you know the response.

Don't take me wrong, but is my opinon.

Thanks for your advice, and I admire that you did something for bringing attention to the issue.

Sorry NII, I didnot mean to hurt any feelings. But some action is required. If we keep quiet, the President Bush's new legislation will pass, and that will flood the immigration doors with applications. We all know what happened in Apr 2001. Do we want stand in line for years.

If we wait for 5 more months, then we will have PERM and we will spend money all over again. That would create third way of GC processing. It would start processing fast in the beginning, and tend to remain like RIR. Isn't that was what RIR proposed and implemented in first place? What is the use?

But NII, we all have commitments and responsibilites, laying back attitude wont get us anywhere. I am married and my wife is studying. Think of responsibilities. Dont you think we should have practically possible that we can dream about?

What you have to say TAMIL_GC? What do you want to do? Nothing. Just sit back, hope and pray! Why does it hurt if I write in the forum when most of the people are looking forward for? Is this reponse you have to give? "I am waiting for some one else to dig me out!"

What we have to do is to create a movement I appreciate people Vanguru who is trying hard to let the US govt the plight we face. But my response differs from what vanguru have in plan. We donot and should not give our case # nor our location; we can certainly give our names and signatures.

To lay out, I would like to get signature of as many people as possible who wants to support this movement. Because if you have just 1 person write the letter, it wont have any significant effect. We should sending editors of the newsletter. We have make this is an issue before the illegal immigrant bill gets passed.

DOL usual understaffed doesnot make sense. I read the manual released by DOL. It suggests an average case should take not more than 10 minutes to complete processing according to its own specification. The current average load is 15,000 to 20,000 cases yearly. If only 1 person is dedicated for this, then he should be able to process 16,800 cases ( 10 min x 6 (each hr) x 7 (7 hr workday) x 40 (weeks)) each year. Then atleast we should go month by month. I feel bad for prosix whose application is stuck at Dec 17. We all know that DOL has not processed that case. I know DOL has 8 people working on cases. Just think about understaffing? Either everyone is on vacation or processing visas specifically for illegal immigrants.

I really dont understand why govt always awards illegal immigrants, and punishes us, every single time. If you are illegal, you donot have prove anything.
 
I think the root cause in this particular case is that they don't have a separate queue for all the applications filed under 245(i). A lot of these applications must be incomplete, just filed to get in before the clock runs out.
Then there is the other issue about the US not wanting permanent workers. Think about it - most employers would not use the H1 if they could get your labor cert. + I140 processed in 6 months or so. The government increased the size of the H1 creating a bulge of applicants, but didn't touch the number of green cards.

Let us talk about benefits of being illegal. If it makes more sense and is easy I may volunteer for becoming illegal.

rajeevnair32, NII and vangaru.Thank you for displaying some practical sense here.vangaru,thank you for sharing the information in the letter that DOL sent you. You are lucky to get such a response. One thing you can do - send the letter to every media agency - fox, cnn, cbs and every Senator and the President and Vice President.Spread the word of slavery and bonded labor that is implicitly enforced by the slowness of the DOL.
Flood everyone until someone wakes up.
We do not need to plead or beg to anyone, we are paying social security and taxes, someone better pull their socks and get the job done. We do not beg that someone do something. If we send out that letter to a 100 people, at least one person will take note.
I agree the government workers are overworked, but so are we.No one is an exception.
I did get passionate here today, but yes vangaru - you have got something that is a good thing to start on.Im waiting for my letter when Ill start flooding mailboxes for what is rightfully mine.

Let us form a group now for sending the e-mail. Guys, more people have to contribute for their own cause.

I think this would be the list of the people interested in sending mail and correspondence with the media -

There is nothing to gain by doing nothing. This is the only hope. I humbly request more people to join and help themselves.

DOL says that they donot have enough funds, and we have to help DOL in filling up the need.

Last year, President Bush had allowed $1000 premium H1 money to divert to reduce the labor backlog. But in fact, the labor certification process became more worse and much more delays than the year before. I really dont why a system should get worse if it gets more money than before.

The plan I think we should follow is:
1. Formulate a letter that we let President know all the pain and frustation in responding to the non-responsive DOL.
2. Send letter to all 100 senators.
3. Send letter to more powerful representatives.
4. Inform the media about the plight.

I also think we should have 2 different sets of communication formats - one for Democrats and other for Republicans.
We can point the benefits to the society in admitting a legal immigrant rather than illegal immigrant.
We build our case on competitive strength and entriprising we have, and how the silicon valley was transform (but for the unfortunate Dotcom bust)
We also inform most people have many years of experience, and losing us would mean no one else to manage the projects, and thereby having lesser jobs to Americans.
Also the loss of revenue in the form of taxes, medicare and social security benefits - which most of us never use.
Remember, America needs us as much as we need it. It would be mutually benefitial experience.

Everyone's suggestions are welcome.
