And I think we should stick to what we want and not
talk and compare about issues/policies/laws not related.
I mean, we should only talk about our issues.
Plus it always helps to get legal advice.

Id rather stress more on the media and see what they can do. Come to think of it, the Senators and Presidents donot have anything to gain by giving us permanent resident status and we have to show them what we can offer them as rajeevnair32 pointed out.
Remember, its plain simple business, not asylum, that we seek.If you dont offer them something, they wont cut a deal. I think, comparing yourself with illegal immigrants makes apoint, but shouldnt be the first one.The benefits that enterprising people like us can imbibe in the economy and society by investing in real estate and businesses here, given our skill sets and determination needs to be stressed.
I have seen my friends run from pillar to post when their jobs were at stake and they might have to leave the country.They cannot leave their jobs and have to work extra hours doing what they didnt like, because of fear of being let go.
I am not sure if everyone is on the same point with me.The frustration we have is not because we want something and its not given to us, it is because we are being made a commitment and that promise is not kept and we are being made to wait.The anger is not at being in a precarious state with an H1B.The questions we ask are because many people have not kept their promise and are dilly dallying as to when things will happen.Making a person wait is no customer service. This attitude is nothing short of slavery and bonded labor. We want Permanent Residence because we are a progressive people and like the speed of progress (technology and private business wise) here. We are here not because we are hopeless or escaping from our native countries.We are here because we choose to be here, else the world is still waiting for us.We need a timeline and target to get on with our plans.If its going to take 6 years, I might as well take my skills elsewhere. This is not out of hopelessness, it is just being practical.( I have been part of arguments with many people in the last one month) We dont get excused for not meeting timelines.Why is the labor department and the USCIS allowed?It is surprising that this country can be so developed and yet so underdeveloped when it comes to federal processing, compared to the developing countries of the world.
who is writing the first draft?If I do, my points will stress on the above. I need an answer and a timeline.If Rajiv Khanna is ready to do this, we can discuss the terms of getting such a letter.
Also, someone has to have been compiling statistics and numbers (archives of processing times) to present the lackadiascal attitude of our "immigration DOL and USCIS businesspeople in the government".
The justice system is slower than the media and the Senators often throw up their hands has been my experience in the past.
Im on vacation for 3 weeks from tomorrow.But I'll dive in when I return..Just do it people.

Come on friends, this would be a good deal for all of us. More people have to join the force. This would be ultimately for your own good. Together we can make the difference.

Irugnevm, the reason for adding the difference between illegal and legal immigrants as a first point is because legal immigrant go through the strigent rules and regulations, and most of us are checked through all the wanted and terrorist list that govt keeps. So there would be very less likely to have a background that could harm US in anyway.

Also, legal immigrant have not broken the law in the first place. As they always say, present and past activity is the glimpse of the future behaviour. So a legal immigrant is very less likely to break a law. The only time most of us have seen a cop is when you get a traffic ticket.

Yes media is the biggest ticket. That is the best way we can get more publicity with very less effort.

Let us also have Rajiv Khanna whose is the inspiration to all of us. Can some one volunteer to talk with him and keep on updating him about the progress made by us.

I read that you are leaving for a vacation for 3 weeks. So you may create a first draft. We all members will collectively contribute towards making a final draft. What I need is your real name and signature. Can you have a letter head with "Immigration/Labor Certification Issues" with your name and signature, either scanned, or use initial the soft copy and send the email to rajeevnair32@yahoo.com

I am thinking of getting into many immigrant forums, and collect more people. We have one chance and we will have to make our voice heard.

I am thru with DOL business. No, it is not approved but I am giving up. Now, if they want a talented guy like me then they will calll me. As someone said take your talents elsewhere.

let us start defining the objectve

Hello all --

While the signing up process continues, we can simultaneously,
start to define and refine the objective.

- What is it that we want exactly and why ?
- Who are our audience ? Are we going to present it to
to different audiences differently ?
- Compromises (how can we help, paying premium etc.,).
- Suggestions.

For example,

OBJECTIVE : Speedy and immediate application processing.

COMPROMISE: We can afford to pay a thousand, two thousand, ?? to help make it faster, if one needs additional resources.

SUGGESTION : Practically, it will help those that are close to and beyond 6 year H period, or those that have been waiting for quite some time with labor or any other phase, to have a "TEMPORARY PERMANANT RESIDENCY", that which is same as GC except, it is until the application is processed. So, people will not feel the restrictions etc.

The above is just an example and my opinion only.

whatever you are stating as objective is what they call PERM and if you give that as objective, then you know what would be the answer. They would say we in last stage of implementing that and thats what they are saying since last 2 years.

I think objective should be immediate clearance of backlog of all the LC application pending more for than 180 days. This is just my opinion.

Thank you Prosix. I did not know that the sample objective I stated was "PERM". I just wrote it as an example.

I think this is what we need to do. Come up with what we want to say, discuss it and finalize it as soon as possible.

I don't think we should suggest any measures for improvement. All we would want to highlight would be our immediate plight and the unnecessary hardship that we have endured thus far and put the ball in their court.

Some points to highlight are as follows:
LCA certification process now exceeds 12 months at ATL DOL, not including the number of months witheld at SESA's and advertising time prior to that. Applicants waiting for Labor certification has a waiting period ranging anywhere between 24-36 months (?). This is not inclusive of the GC processing after Labor Apps. Approximate waiting time per applicant - estimated time anyone ?

Regional Processing Centers are not consistent in reviewing applications. Hence, applicants with applications stuck at slower processing centers (such as Atlanta DOL) are treated unfairly in regards to the processing time-frame. Some applied at other regional centers have a faster processing time-frame and thus do not face any delay and are well ahead within the process as compared to the applicants within the slower regional processing centers

This forum in monitoring Labor apps. accross board, (submit proof of tracking if available), again we note inconsistency in the approval of applications. Some applications with later receipt dates have been approved prior to some other Labor apps. within the system.

ATL Dol officers are not being transparent in the review of the application with regards to the time frame - despite being a public agency. Understaffing is not a good enough reason to delay certifying applications, but instead should be more realistic in setting goals. Here I refer to Prosix's suggestion of setting a performance standard of being able to review applications within a certain period of time - 180 days. I am getting tired of hearing that they're understaffed. Well do something about it, hire more staff persons!!!

Any other ideas to add anyone? Do highlight all our duress, stress and hardship.

On another point

...... make sure Elaine Chao/main processing center gets CC copies of the letter to whomever the letter has been sent out to.

Why should we be penalized for their inadequacies? ;)

I like the way you wrote, seems to me, you have a good command over the language. Can you come with a rough
draft of what we want to say ?

Personally, I think we should not only suggest the measures to improve, but also come up with alternatives, even though it is none of our concern. It is just my opinion.

We are where we are, because the existing, current system is not helping us and not working efficiently.

Cannot do it alone

Unfortunately I have a lot on my plate right now. I cannot come up with something within a short span of time, but I can come up with some points in my own time - consisting of a clean-up version of the above plus other observations. Again, I will require the help of others who may have knowledge on other things that I am not well verse with. I would appreciate if the other readers of this forum could point out to me how they are personally affected by the delay - on their work, how it affects their families etc. as we especially need to expand on the "hardship" part of it.

One other thing, ATL DOL has always stressed that they would not entertain anything from individuals, I am assuming that goes for a group of individuals too, except through the representation of an attorney. Does anybody have any thought on that? We could itemize all the shortcomings of the system now, but we especially need someone to consolidate and edit all the findings. Our concerns will also have to be backed by factual data and this will be quite time consuming. I consider the tracking system by the others in this forum to be particularly useful as we are not just saying things, but it has been proven otherwise through our observations.

My thoughts are - even if , this writing does not materialize during my span of time, then probably there might be others who can probably can take it forward and pursue this further.

I will help you with it as much as I can, and I am sure lot of people on the board will be willing to help with it too.

Reading the posts in the last few days, I see that rajeevnair32 has already taking a lead with the cause and I hope rajeevnair32 will continue with gathering people and help carry the torch.

I just spoke with my attorney about all our plight...and asked him for opinion on if there is anything we could do to make things happen in ATL DOL. Basically what he said was that whatever we do, is not likely to practically bring about any change...again folks, this is his opinion. He also mentioned that the lawyers in atlanta are trying to schedule a meeting with the powers to be in ATL to impress upon them the hardship we have to face because of this and so forth. Just wanted to share this.

Also he mentioned that a couple of guys from Georgia DOL are now working in GA DOL office and certifying cases for ATL DOL. So, some cases are being forwarded from GA SESA to ATL DOL while some are retained at GA SESA for federal processing. It is the cases that are processed (federal processing) at GA SESA that get certified sooner than the cases processed at ATL DOL. He said he has seen cases filed 6 months back getting certified and they are the ones processed at GA.

I wish ATL DOL kicks me outta here!!! No one likes to be in this forum waiting forever. I wonder why DOL website hasnt updated their processing times this month. i am eager to see ATL move to the month of Jan so maybe someone can question about pending Dec cases. I spoke to my attorney,, they say the backlog is 14 months at ATL for IT related cases. Other cases are being adjudicated in 2-3 months.
