However, any information helps, and we make it out to be whatever we want it to be.

I can feel that it is going to be one of those frustrating days again!
 
Update!!!

Regarding my letter to DOL.

I took the letter response from DOL and wrote a letter to Georgia Governer "Sonny Perdue". I got the response from GA govener today. Here is the response from Governer.

"I do not have authority to intervene in matters of Atlanta Department of Labor functionality and hence unable to help the situation, as the case has already been approved in SESA office and forwarded for federal processing stage. Please do your communication with Department of Labor with appropriate channels"

My comment : appropriate channel is "my attorney" and he is useless like anybody else. Just paying attorneys $6K because we cannot represent ourselves in this matter, by law.

So, here I remain and wait for approval.

Non IT cases...

I know quite a few non IT (specifically healthcare) cases that were filed until mid 2003 clearing in 2-3 months on average consistently. But then the cases received by ATL after Aug are still pending for the same Co. and same job title until now. This center lacks transparency in the process which makes the waiting even worse. They should at least give us projections to help us plan alternatives.

Spoke to DOL Employee this morning

Hi all

I first tried 404-562-2131, it just keeps ringing, no AVM reply. So I called 404-562-2115, spoke to a lady.

I asked her what month's applications your are currently processing ?

Dec - 2002

How many applications still left for the month Dec 2002 ?

No idea

How long it will take to process Feb applications (Mine is Feb 24)?

No idea...



No idea..., No idea..., No idea.. ?


Frustrated ?

I spoke with my attorney today. She says that ATL DOL is backlogged almost 14 months.

She has some cases (still pending), that went to ATL DOL in 2nd week of December 2002.

So this tells me that ATL DOL will, looking at their current speed, probably finish

Dec '02 cases by end of Feb '04.
Jan '03 cases by end of Mar '04.
Feb '03 cases by end of Apr '04.
Mar '03 cases by end of May '04, so on and so forth ....

Fellows, this again, is just a speculation. The processing time may vary (+/-) further. But let us hope for the best.

BTW, is there anyone here in the forum, who got approved by ATL DOL, with their receipt date at ATL DOL as, on or before 15th Dec 2002.

Whats is your attorney saying. Yours is too late, u should put pressure on your attorney to contact DOL and get explanation. Mine went to 17-dec-02 and that is what I am going to do once they chnage the processing date to JAN'03.

Let us know what you get from attorney.

Another thing, I always see your post as

no further information like what is the DOT code, responses from your attorney etc. In past you posted that you are trying for labor substituion with other company, is that the reason you don't have much intrest in this labor case?
 
I don't have DOT code. If I call my attorney their reply is always ..."you are not supposed call us, please contact your HR".
I called my HR and their reply was please wait for another month. They have been saying this for almost 4 months.
Well what I can do? nothing but getting frustated..

I was looking for labor substitution option, but I can't take risk since lot of 140's are gettting rejected.

I feel sorry for you. I guess that you have to be more assertive with your HR. Tell them that the US DOL's website is currently posting December cases, and that now it is past due. You have to insist that they check with the attorney, and that the attorney in turn will check with US DOL. There has been a lot of cases like this whereby the applications have gone missing in action. How would you know, if you do not check on this matter? The only way to put your mind at rest is to check on this. YOu have a valid reason to, unlike the rest of us who are still waiting for some updated news. Some, whose application has gone missing has to resubmit, via attorney's records. Don't mean to alarm you but it is worth a try. Good luck.

I would strongly suggest you to talk to your attorney regarding this. ATL DOL is processing Dec '02 cases, for sure. Check if there are any more Nov '02 cases pending for adjudication.

Be proactive and put some pressure on your attorney to talk to ATL DOL and find out the reason for delay.

 
What NII says is perfectly right. I am the right example... my paperwork was lost by Atlanta DOL. I had to contact my employer/attorney resent the paper work to FL SESA. Had to follow up with people at FL SESA until they forwarded it to ATL DOL in about a week's time. Then had to call up ATL to get my case and confirm they have my application this time.

why don't to call DOL directly and ask them about your case.
They claim (both on phone and website) that they are processing DEC.

I have been tracking a random case that I found for a long time now and it is still pending,

04395540 030.062-010 09dec pending.

This date is even before prosix's.

And .... sometimes they at Atlanta DOL will tell you that they will only speak to the attorneys and not the applicants. It is a catch 22 situation. I was told that when we are going through the GC process to expect a lot of attitude - close to slavery. Get the slackers (the HR department and the attorneys) to work.

Do not get carried away with the AVM answers. they Don't update on a daily basis which are processed previous day.

Even after processing, they take few days, if not weeks, before they do data entry.

DID ANY ONE SEEN ANY CASES APPROVED IN JAN,04 ?

NO. This does not mean ATL DOL not working all these day in Jan 04. They are working. But slow. And VERY SLOW in updating AVM system.

Do you guys agree with me?

What is the source of this information and how sure you are about this? We have heard from this forum that they update AVM every morning.
 
Finally Here it comes...

Finally.. Finally.. Here it comes.., after 14 months of waiting, my LC has been approved by ATL DOL today. I do not have case # or DOL code.

My case fwded to ATL DOL (from FL State) on Nov 21st 2002, certified on 01/29/2004 (according to the email from my attorney).

Unbelievable but awesome news. This gives a new ray of light. Veerudu .. do you have your case no and does the AVM provide any case status ? want to know if its been update.
