Certified!!

Thank you all for providing a lot of informaion here.
My LC was certified on Oct. 6, 2003 via AVM.

SESA: Apr. 30, 01
DOL: Jun 25, 03
Remanded to Employer: July 17,03
(SESA has mistakenly placed the date stamp in the area where the original certification is to be placed.)
Replyed to Remand: Aug 8, 03
Second submittal of the response to Remand: Sep 20, 03
(DOL lost my application)
Certified: Oct 6, 03

MYSEROUSGC, on 25 July Kinko posted following post, check his DOT code

Automated telephone sys. says " the case was remanded to employer on July 17".
According to my attorney, it was because NC Dep. has stamped in wrong place on my application.
So, as soon as NC correct it and send it back to DOL, my LC will be certified.
I'll post further movement.

Actually I browse through several pages and then loose patience to go go upto 25th July...

No! This DOT code does not belong to IT related case..

Only cases start with 030.XXX-XXX deals with IT Related cases..

like Programer/Analyst has 030.162-0140

You can find the list of all DOT codes here
Just type 030 in the first one left the other two blank and it will show you the list..

They haven't updated it yet! I checked with my employer phone number. As I said earlier, my colleague case was forwarded on mid of July. Still even his case is not updated with AVM.
 
What's the case number now?

Would you mind to share the first 5 digits of your friends case number so that we can have some idea of how many case they received this year?

He did not get his case number yet. His lawyer requested his case number with ATL USDOL. Once he gets the case number. I will update with the forum.

Raj2010, It's very sad to know about your job.

As per my understanding GC is always for future employee..

You can continue the GC process as long as your company allows this ( This means that they are not withdrawing the application from labor and after labor approval they are ready to file 140/485 processes ).

It totally depends on your company...

But my suggestion is talk to your company; But don't rely on them as this would be a very long process....and try to find a job ASAP....
 
Sure you can, as long as your old company supports it. Try to find a new job and if possible start a new petition with them (if you have enough time left on your H-1). You'll be better off posting this to the general forum (start a new thread). More people will see your message that way (including people who can help you find something, hopefully). Audience for this thread is mainly Atlanta DOL "victims"

I don't know sufficient about your situation.

Normally, after you get laid off permanently from this company, you cannot continue LC process. But you can retain the Priority Date, which is the date your LC was filed with State SESA.

If you are not running out of 6-year H1B time, you can always apply for a new H1B with a new employer.

If you are running out of time of 6-year H1B, as long as your LC was filed 365-day prior to 6-year H1B expiration, you can apply for 7th year H1B extension and use that to work for a new employer.

How long can you be out of H1B status until you find a new employer, that I don't know. Legally speaking, once you lose a job, you no longer maintain H1B status. You can change to H4, or F1 or B or something else.

You cannot use this labor cert with any other company.

You should be able to continue your labor cert process with your current employer even if you get laid off.
The labor cert does not really belong to a particular employee, it is for any person that that has the qualifications mentioned in the application. It belongs to the company.

After the labor gets approved, while filing for I140, your company has to prove that they have intentions to hire you when it gets approved.

Please check this with an attorney and make sure your current company supports your in all these steps.

In the mean while, the best thing would be to start LC process with your new company ASAP
 
I called today at Atlanta DOL. The lady told me that they are still processing October 2002 cases. Apparently, they are taking 2 months to process one month.

I just called in AVM system as I do everyday morning, it says my case has been approved. Here is case information

I still can not belive, I think there might problem with AVM system. If you guys happen to check the AVM for my case pls post the response. I am going to send email to my lawyer. Good luck guys.

It's good to see that they are making progress...

But we could not figure it out what is the logic behind for processing the cases..

I was trying to reach AVM; But it is not working...

Anyway, Thanks again for sharing your info..

Please post your detail when your lawyer received the papers..
