DOL messed up on Processing Dates
I am new to this group & this happens to be my first posting.
Here goes....
My state Labor was cleared in July 2003 & my lawyer received a letter for the same from State. Based on that my federal priority date should have been somewhere between Aug-Oct 2003 ( My guess taking into account all the god forbidden delays) However I checked the AVM 3-4 weeks back & it said that my priority date is now March 2004 for Federal Processing. My lawyer immediately wrote a letter to the Atlanta DOL stating that there has been an error. But till now we have not heard back from them. My lawyer says that they may or may nor make a change. I dont understand this. How long do i wait? Is there a better way to approach this situation?
Will appreciate any guidance

What do you mean by "Federal Priority Date"? As far as I know there is only one priority date which is date when the State SWA received your labor application.

I Made my reception call the DOL and told her to act as HR when she talks to them, She did and guess what my file is still sitting in the locker room and was not assigned to anyone yet. How does they assign the cases?. When someone is done processing his/her cases he/she will be assigned with new ones or will the cases be assigned monthly or does any one know what order they assign the cases to the officers?...

Finally my case is certified, I checked it over AVM. Here are the details.
US DOL Receipt Date: 26th March 2003.
Remanded to Employer: July 19th 2004
Reason: Recruitment Report Missing
Replied to Remand: August 08th 2004
Certified on: August 10th 2004
Thanks every one for their support. See you guys in I-140/485 thread list.

Just to let everyone know that after 3 years in the pipeline, my Labor application has been approved on August 11th 2004.
Here is the info..

> Labor forwarded from SESA to regional on Feb 2003
> Remanded to employer for additional advertisement in July 2004
> Lawyer responded to DOL, Atlanta and documents were received on
August 6th 2004.
> Application certified within a week.
It's been a long journey... but i would like thank everyone for there input in this forum as it made me better understand the complexities in this process. I will be better prepared when i start filing my I-140 and I-485 shortly.Hopefully i will see you all soon in the other forum.

When my Labor Application was forwarded to Atlanta DOL in Feb 2003, my Lawyer had posted only one advertisement in a local newspaper and filed that documentation with the DOL.
However when my application reached the Certifing Officer, it was sent back to the lawyer requesting one more additional advertisement for my application , this rule was effective Jan 2003 and all applications were being checked for this rule.as i had only one advertisement it was sent back..My employer then put one more advertisement out on a HR website and waited for one month, then the employer sent the ad clipping along with documentation back to the DOL on Aug 6th 2004 and was later Certified.

Lot of cases certified in AVM Please check your case...
Today morning first time I access AVM and I observed, lot of cases certified in early June 2004 which received to DOL on the end of May 2003( I strongly beleive these cases might be completed their state in the month of April 2003). Most of the cases are other than 030-162-01* DOT code.
And also I observed couple of 030-162-01* ( which i beleive are software )are certified.
My Laywer personal website showing, my case was received in DOL on Apirl 23 2003 but in AVM, it is saying my case was received/updated in DOL on May 30 2003. I don't know exactly which one is correct.....
I am still waiting ......
They didn't updated AVM after 03 August 204. So I hope the remaining Apirl cases might done but not updated in the AVM... -- Just making myself happy ......
I suggest everyone who completed their state in the month of Apirl 2003 should check their status in the AVM.
