129F,I-130, K-3, AND 1-485 DETAILS

k-3 STEP BY STEP DETAILS IF MARRIED TO A CITIZEN
Iam an Indian got married to USC in India-- Feb2002.

My spouse filed I-130 and I 129F in USA

I-130 filed and obtained receipt notice in the month of MARCH 2002

Filed 129F in the month of MAY 2002 and got approved in the MONTH OF NOV 2002.

The U.S. consulate informed me to attend for the interview in the last week of JAN 2003.

THIS VIVIDLY SHOWS THAT FOR OBTAINING A K-3 VISA IT TAKES
1 YEAR (IN MY CASE ITS 1 YEAR)

I appeared fpr the interview with all documents such as,
--- Marriage certificate,Marriage pictures, Date of birth
certificate, affidavit of support which my wife sent
me,and PC.
Finally i got my k-3 visa stamped for 2 years.i,e;2003--2005.

I joined my wife in April 2003 and i applied for EAD which i got
in 90 working days.
Ialso applied for I-485 in the month of AUG 2003 and got receipt
notice in the MONTH OF OCT 2003 also i gave my BIOMETRIC FINGER PRINTS IN THE MONTH OF NOV 2003.

I think this info would help to all my friends.

Now iam perplexed how to remove my conditional residency?

whether i must remove it before 90 days of my 2nd Anniversary to be celebrated in the MONTH OF FEB 2004 or i should take my 2 year visa stamped into consideration and apply in the year 2005 DEC as my k-3 expires in the MONTH OF MARCH 2005.

My advance personal thanks for the clarification.

(I updated the post saying the two latest items were NOA #2 to be consistent)

Correct. I'm a bit baffled by it. They got it done about 2 months earlier than estimated. (but who am I to complain)

I received the I-130 NOA #2 in the mail today. The notice states that the petition was approved and has been forwarded to NVC. NVC will process (essentially lookup which consulate they need to send to I guess) and forward the petition to the consulate abroad. NVC will also contact the beneficiary.

I-129F NOA #2 will get here in two weeks I guess.

Hi batman PPC,
Did you do DCF ( direct consular filing ) from Dhaka or did you file for your wife from US? Do you have any idea which process takes lesser time? It's been taking more than 5 months in your case. I thought it takes only 3/4 months for K3 visa if filed directly from Dhaka. Correct me if I am wrong.

I had to file in the US.

As far as I know, US Citizens living in the US MUST file in the US.

I'd assume DCF would have taken less time. My petition was here in the US for 5 months before it got forwarded to Dhaka.

Working after the interview

How soon can my wife get a temporary work permit after she arrives? She interviews at the Consulate on Feb 4. (We filed the I-129F back in mid-August.) What do I have to file next? My wife already has a SS#. My wife will go crazy if she can't work at something kind of professional. Basically, I am looking for a short cut--unless we will have to go through the full 90-day green card process.

Thanks,

Boyd

Where does your wife live? I filed towards the end of august and am still waiting for the US Consulate in Bangladesh to schedule an interview date.

Batman,
Have you heard anything from Bangladesh consulate since you filled for your wife? Did you do any inquiry with BD consulate after filing? My assumtion is that it shouldn't take that long. You can do DCF ( Direct Consular Filing ) if you are a USC. You don't have to leave in your home country.

Yes, I did heard back. Her interview is on the 13th of April. I am going to Bangladesh to be with her for the interview. I had inquired about DCF previously and they said I couldn't. DCF was only available in certain countries.

Batman,
Wish you all the best. Please be sure to share your exp with us about Dhaka consulate. Thanks!!!

k-visa

Mary Bakhouya said:
no you can not, first you need proof that you did file the I-130, and in this case you will need a cashed check receipt from ins, or the letter of receipt from ins, stating they have received your application, then you can apply for the I-129, with this receipt.

hi,
I am very new here and I am planning to file for a K visa for my fiance in Nigeria. I thought I only neeeded to file the 1129f form? But from the discussions so far it seems I also need to file I130.
Please help me . What are the things I need to do as a first timer filing for a Kvisa?
