Any EB3 recevied RFE for their 485 applications?

I received 6 emails 3 for each(RFEs)

I got 6 emails 3 for each yesterday, haven't received the mail.
My PD is feb 2003.
Wonder what that is, and ofcourse we have not sent any medicals.
I expect the same as everybody.
Life was easy and smooth with EADs and APs, the RFE hit like a thunder.

Yes ... thats true to some extent ... only thing that they should do is make EAD valid for 5 years.

Then let it get stuck for ever ... one needs to do GC renewals every 10 years anyways...

Well ... I guess you should not worry much .. 485 RFE's are not all that bad ones.

Has anyone received any feedback after replying to the RFE?
THere are so many applicants who received RFEs.
There should be someone with feedback.

Yes you get a standard feeback .. the message seems to be common to everybody.

Wonder how we will know if the Evidence provided is OK with Adjucators or not.

Yes ... if we do not get enough visa numbers ... and then this preAdjucation might send looping EVL RFE's every year.
 
What needs to be there in non-availability

Please help me with a sample non-availability document for the following RFE.

This RFE states "If a civil record of your birth does
not exist, you must submit a written statement, on official letterhead,
from the relevant government or competent civil authority in India,
establishing that the birth certificate does not exist,, or is not
available in that country. The statement must indicate the reason the
record does not exist and indicate whether similar records for the time and
place are available."

"Please submit the oldest available evidence which establishes the birth
and parentage of XXXXXXXXX . This evidence may include, but is not
limited to:
a. Hospital birth records which name child and both parents.
b. Medical records which name child and both parents
c. School records which name child and both parents
d. Census records which name child and both parents
e. Church records in the form of a certificate under the seal of the
church where the baptism, dedication, presentation or comparable rite
occurred within two months after birth, showing the date and place of
child's birth, date of the religious ceremony, and the names of the child's
parents.

We acknowledge the submitted affidavits; please do not submit additional
affidavits."
 
about my rfe

Hi All,

Friends...I got rfe received for me . Seeking a help/input from co-members. My PD 2002 Augst, EB3/India...recently applied for 4th EAD extention and 3 months back given fourth time finger printing. Rfe received is:

"The documents you have submitted as evidence of your birth were executed so long after the fact they are attesting to that they are considered hearsay evidence. Therefore you must submit other documentary evidence.

Submit two written statements, sworn to or affirmed by at least two persons who were living at the time and who have personal knowledge of the events you are trying to prove, for example, the date and place of birth, marriage or death. The persons making the statements(affidavits) may be your relatives and need not be citizens of the United States. However, affidavits written by you or the beneficiary(ies) are not acceptable. Each affidavit should contain the following information regarding the persons making the affidavit; his/her full name and address;his/her date and place of birth;his/her relationship to you, if any; full information concerning the event; and complete details concerning how he/she acquired knowledge of the event. These affidavits should address the facts concerning your birth and parentage."

Did any one has received this kind of RFE ?

please advice any suggestions and what should I submit ? Do I need to submit through lawyer or myself can I send this information you suggested to INS directly ?

First FP is done
140 approved Aug 03.
2nd FP done on 20th Nov 2004.
2nd EAD Notice Date is:April 23 2004 and approved on May 31 2004.
2nd AP Also approved on Jun 2nd.
3d EAD April 2005
4th EAD May 2005
 
Are these RFEs based on RD or PD-based processing? Seems that while PDs seem close to Q1 2003 but RDs are around 2004. Is that true? Just curious about logic in getting RFEs. Based on PD or RD for EB3 apps?

From what I think:
NSC prepares a list of all approvable 485 by RD at the begining of the year .
They go FIFO from there ... any 485 that becomes approvable this year is generally reordered in Next year list.

So my best guess is they are going by RD...

I don't have an exact reply format but here's some ideas that may help.

what does your attorney have to say to this one?
Did you ask your relevant municipal for a BC?

The text of the letter seems to be a standard USCIS requirment based for document non-availability.
Look at this USCIS link ( under section Evidence and Processing)

Also, try to get a non-availability letter from your birthtown municipal where it mentions either it mentions that no official birth records were being maintained at that time ( if it is true). If not, get the letter based on what the municipal says on not having it.

Does REF really mean something?

My PD is 11/2001 and finally got an REF last week. But my congressman office checked my case again and saying my name check is still pending, this means REF does not help much. My REF is about the work permit from 2003 to current, perhaps we have to keep on waiting.....

Any body have idea on this?

Namecheck

is a very muddy topic. According to my lawyer namecheck is done every year so it's not an one time event. So u could have been cleared last year but again resubmitted this year. And according to some, NSC will not match FBI namecheck results to the file until the date becomes current. So your namecheck could have cleared but their system will not reflect it until ur pd becomes current.

So wait till ur PD is current then talk to an Immi. officer. or file WoM.
 
EVL letter format.. related question

The format\text of RFE on employment verification letter seems to be the same.

Did you guys, who responded to the RFE, mention your PRESENT duties, position and salary as requested by the first line of the RFE?
