Any EB3 recevied RFE for their 485 applications?

RFE received

I guess it is our turn to report RFE. My husband got e-mails for both of us June 24. The RFE received today by our attorney. They ask to submit all the bio forms and the evidence of employment authorization since we are in US.

For my husband they requested it even for one year earlier that we came to US. I'm not sure why.

I think now they are really after people who worked here illegally.

I got the following one from my city / municipal office as non-availability of birth records.

(Issued under section 17 of the Registration of Births and Deaths Act 1969)

This is to certify that a search has been made on the request of Shri/Smt/Kum: ........................... Son / Daughter of ............................ residing at ................................ in registration records for the year ...... relating to (local area) ............................... of Tahsil .......................... of District ........................ of State of ......................... and found that event relating to birth of .................... Son / Daughter of ..................... was not registered.

I also received an email asking for more documents.

I was happy but when I read this thread, its obvious that everyone is getting RFEs for no reason.
 
RFE on his Date of Birth and parentage

My friend got an RFE on his Date of Birth and parentage. The NSC has acknowledged the receipt of affidavits and requesting not to submit any more affidavits. The RFE is asking him to submit the following items like ….School, Medical, Hospital and/or Census records.

Please let me know if any one has got similar RFE, what school records have you submitted and any out come after submitting the same. Thanks in advance.

I have received the same RFE for my wife and I am planning to send in a 1. copy of her BC 2. Affidavit notarized from India. 3. School Records.
 
My RFE on EB3 / I-485

My attorney got the RFE requesting my evidence of work authorization between Nov 2001 to Jun 2002. They already have the copy of I-797 during that period and told me that they will handle this RFE.

I do not how much time it will take for the status update after sending the reply to RFE.

Is this type of RFE very common?

RFE details

NSC is asking for the following for my wife
1. I-94 card
2. Form G325-A
3. ORIGINAL BC (Why ???) and a photocopy of BC (really doesn't make sense)
4. Employment authorization from Jan 01 to Mar 02. She was in F1 during this period and worked as Teaching assitant in the univ. NSC is asking for the following
. EAD (form I-688 OR I-766)
. Form i-797
. Copies of I-94 showing she was admitted to US in an employment authorized nonimmigrant status.

Wondering what to send for this Employment authorization.... Would form I-129 be sufficient ?
 
Seems to me that most of the people who have seen movement/received RFE have 2004 as RD for 485. Anyone here with 485 RD in 2005? I have Oct, 2005 as RD for my 140/485. From the USCIS website, they seem to be processing Nov, 2005 RDs. But not in reality. Is that correct? I do understand that actual adjudication is not going to be until my PD gets current but pre-adjudication might happen before. Thats what I want to find out about.
Therefore my Q: Anyone here with 485 EB3 RD in 2005 and has received the RFE?

I just noticed an LUD update on my 485 on 8/19. Lets see if there is more activity beyond it. Msg did not change yet. Maybe its part of pre-adjudication, maybe new FP notice, maybe RFE...who knows. I hope its something non-negative. Thats all.
 
2 RFE's in 1 month

I recieved 2 RFE's last one month

1st RFE - Letter from prospect employer .... (same letter as everyone)
2nd RFE - Last five years employers and my residences (form G-325A)
with original signature
 
Replied to RFE(EB3) a month back .. what next ?

Hi All,

I got a REF regarding birth certificate and employer letter.
We replied a month back and the status on the uscis website changed with the message saying that they have received the reply and are processing it.

Should I expect a confirmation from them saying that the case has been processed and will get GC once date become current ?

People with EB3-India with non-current PD, please share your experiences ..

Nope !!

You will just see the LUD's. If you send in an official inquiry, you will receive the letter stating visa unavailable.

Will the LUD change to say that case has been processed or somethign to that effect .I just want to know whether the RFE is resolved or not.

Also,if it does, is there is possibility of another RFE later ?
 
We are in same boat. After replying to the Birth Cert RFE, all we see on case status is the genereic -
"On <Date>, we received your response to our request for evidence or information. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case."


From talking to our lawyer I understand that no news is good news in such cases. Lawyer mentioned if they dind't like our response to the RFE, they might not send another RFE on the same subject. Instead they might just send a NOID or just deny the case outright :)
