BI-specilization

Dear A0001,

It looks like USCIS will make two service centers to deal with I-129 and the other two service centers specifically for I-140/485.
It means when this will go in effect the I-140/485 from all the sevice centers will be pooled in the two designated (I-140/485 processing centers) service centers.

Any oldtimers and folks with inside knowledge,

How does this new system (Bi-specilization) specifically affects those with "I140 approved by VSC but 485 still pending" ?

any ideas please share.

Thanks.

Hello Freind:

First Congradulations for your approval of I 140 and will like to know was your A2 P RFE was because your W2 was not at the pay scale as the Labor certification.

I have same RFE A2P and am a bit nerviuos my employer is in a bad shape today and was filling losses for couple of years now.

I will like to know what exactly your RFE was and how did you or your lawyer responded to that.

Please help me

Best Regards

Saburi

Hi Saburi,

UN is the star to take care off A2P RFE. Contact him asap.

My RFE was due to the diff between labor cert and W2. The diff was not that much less than $2K. In RFE they asked company's tax forms since 2003 and proof of ability to pay since PD.

I don't know how the reponse was handled as it was taken care off by the company and attorney. I was also very much worried when I got the RFE and till it was responded. My company is doing financialy well.

Don't worry and hopefuly UN can find someway to help you out.

Cdian,
Thanks for the response. I am afraid that my 1st 140 is going to be denied as an RFE was issued and there is not enough time to get all the papers ready.
That is the reason I am looking for an alternate solution so that I can save the time and money that has been spent on 485 processing.

Thanks again.

In my case my company , filed 2 applications for 140, one was filed in the month of June 2005 and anohter in Sept. 2005, but we got approval for june 2005 filed application in the month of oct 2005 , and in jan 2006 the second application get approved .

but my company's lawyer requested VSC to withdraw the second approval , as my first application was already approved ,
we received the notice with changes

i think you should wait for atleast one approval

Hi Desilal,

Did you had LUD's after RFE received on 3/10.
Mine RFE recieved on 3/22 and I had 5 luds since then, so approval.
I am praying god for approval.

BTB, since vermount started bi-specializtion program, does our pending 140 moved to Nebraska or different location?

Thanks

Hi Stillalive,

On 03/10 and 03/24 I had email messages from USCIS. That's how I realised the RFE was responded and approved. I didn't have any other LUDs in between. I have seen in some other posts that they received multiple LUDs between RFE response and approval. Hope your case will also be approved soon. My labor is original and not sub. Not sure if it will make any difference.

I have no idea what's in store for all of us in bi-specializtion. Whether it's good or bad only time will tell.

I-485 Approved

Dear All,

It has been a great surprise to see the I- 485 approval email, on this
Saturday, stating that this cas has been approved on 03/31/2006, which I
have seen on Sunday late. Here are my case perticulars;

EB2/VSC:
LC PD : June 2000 ( RIR)
140/485 : RD 09/26/05, ND 10/03/05

140 : AD 03/24/06. Not even is a single LUD
485 : AD 03/31/06. Not even is a single LUD
Email recived on 04/01/06.
I did not apply for EAD and AP.
Spouse : I-485 RD : 09/26/05, AD:03/31/06.

Intresting thing is I-485 got approved exactly in a week of I-140 approval.

I will stay in touch. Thank You.

:)

Physical Card ?

Can anybody tell, usally what will be the next step after I-485 approval ?
I mean, howlong does it take USCIS to desptech physical card ?
Will there be another case status update, stating the card has been
dispatched ?
AS JUST POSTED, MY I-485 HAS BEEN APPORVED ON 03/31/06
I rember in good olden days, people used to go for ( I-551) stamping soon
after I-485 approval. But later, these days, everybody is getting cards in
mail by a week or later.

Please advise me on this.

w8in4gc,

I did take a look at USCIS release, here is what it says:

"Customers will receive a receipt notice from the service center that will process their case. Applicants and petitioners should note that the filing location for the form type is not necessarily the Service Center that will decide the case. USCIS will continue to process cases received before April 1st using preexisting procedures."

Bottom line: in a senario that you mentioned in your post - there may not be any change for the near future.

I have also attached the pdf file for you to have a look.

Immigration reforms - Visa Numbers

Right time to get that elusive Green Card

TIMES NEWS NETWORK[ TUESDAY, APRIL 04, 2006 12:49:04 AM]

NEW DELHI: It is not just the Indian professional with H-1B dreams whose fate hangs in balance in the US Senate. The Specter proposal, passed by the Senate Judiciary Committee, holds the key for an increase in the number of EB visas, or green cards, as well.

The numerical cap of EB immigrants would increase from 1,40,000 to 2,90,000 annually. Moreover, spouses and children of EB immigrants on or after October 1, ‘04, will no longer count against the numerical cap. :D

The bill proposes that unused EB immigrant visas don’t lapse at the end of the government’s fiscal year (September 30).

The bill calls for recapturing the unused immigrant visas from ‘01. Such visas can be used over a period of time. If accepted, the country limits will be increased from 7% to 10% of the worldwide numerical cap to ease backlogs for highly-skilled workers born in populous countries.

This would benefit India and China. Experts contend that this would be the most serious improvement to the employment-based immigration system since the passage of the Immigration Act of 1990.

The bill passed by the Senate Judiciary Committee proposes to re-fashion the employment-based immigration system to consider the needs of the US economy.

Experts view that the US immigration system largely ignores the contribution of prospective immigrants to the US society.

At present, professionals, who fall into the EB-3 category, have to wait for five years to obtain permanent residency, and persons born in India and China face long lines even in the EB-1 and EB-2 categories.

This is despite the fact that the US suffers from shortage of scientists, engineers, computer professionals, healthcare professionals and teachers.

Bi-specialization impact

Any one notices any Approvals after 04/01/2006. Please post here.
It will help US on Bi-specialization effect.

Thanks in advance.

LUD on 4/4 on my I-140 case.

I got LUD today (4/4) on my 140 application. DETAILS BELOW... Finally somebody started looking into my applications and hoping that the approval goes smooth. Can anyone let me know how much time it will take to get the message change after this LUD? Anyone else who got the LUD?
---------------------------------------------------------------

Checking how many of you have still not gotten the 140 approvals ?

Mine case was filed in VSC on 29th Sept and ND is 17th Oct. After 12th of Dec I don't have any LUD either. What could be the case? Any one else is in the same category. The reason I am so worried is because I see approvals left and right and no update on my case? Once I get approval, I was thinking of availing the AC21 portability to apply for Full-time positions. As per Murthy.com last week bulletin, it says that VSC will start slowing down the processing for I140 dues to lots of 485 is coming in the queue for processing. Will greatly apprciate if anyone can suggest the best course of action. I believe that my lawyer also can;t call VSC and ask for the status as processing date in 21st of Sept. Are there any chances that my 140 lost in the crowd?

reconnecting....

We had a baby girl and I have been away for a while now.

Also, for some reason my online status check account won't work anymore so I had to create a new one.

I noticed an LUD on both our I-485 applications dated 03/23. No email so I am assuming it was not significant update.
