Here is my case..

RD 09/30/2005,ND 10/17/2005,LUD 11/08/2005,LUD 02/25/2006,LUD 02/27/2006
Took infopass to get the EAD after 90 days, but was informed by the officer that it can be approved only after I140 approval. (This is not true for so many cases which I have seen in the forum). :confused:

I485 (No message change, not even about FP reciept)

Hi ST76,

Your I-140's RFE-wages were for the prior employer ? Or were for the current employer?

Hi Tuarek,

It's for the current employer. They needed Letter of Employment, 2005 W2 and last 3 paystubs.

Thanks for the reply. I guess this is going to happen to me as well. My 2005 w2 wasn't ready at the time we sent my application.

Got a wierd RFE requesting a form 9089 used for PERM labor substitution. Looks like the officer who is assigned to the case does not know what he is doing. Attorney is plannng to fill that form and send it next week.

Hi jackmate,

Can you give us little more details about your Infopass why did the officer said that you have to have the I140 approved and what was your receipt dates for I485 and 765. Also are you getting LUDs on 140 or 485?

I was surprised to see a LUD on my 1485 application on 03/04/2006 which is a Saturday.

Any idea's. My PD is EB3 july 2000 and ND is June 2005. The previous LUD was on 09/30/2005.

i've got approval email at 1:00 am, so nothing to wonder about

EAD after 140

140,765,485 , RDs are same 09/30/2005, NDs are same 10/17/2005,

LUDS were after the FPs done on all the apps, but no message was changed. Jan 2nd got an RFE on 140.
Meanwhile when there was no response on 765 application for 90 days, i took a infopass. appt date was on Feb 8th. Officer out there checked all the info on all the applications and informed, that EAD generally gets approved only after 140 approval. Since there was an RFE on my 140, he asked me wait till the RFE is responded and then wait for 90 days from the reciept of RFE of 140 for EAD approval. It all sounded stupid , but he consulted other officers while we were waiting, and he said we have to wait for 140 to get approved.

RFE for 140 responded and recieved by USCIS on 21st feb and message changed about the reciept of RFE. Since then there were 6 LUDS for 6 days on I140 .. and 2 LUDS on 765 and 485. But no approvals and no message change for 765 and 485. :confused:

Ours is not a PERM labor sub copy. A regular one from Feb2001 PD. Actually speaking , they should not ask that form, but they did. That form has information about recruitment etc to fill out, which is not there in our case. Just because they asked attorney is going to fil out that form leaving the recruitment info blank. I am guessing he would also write a cover letter explaining that this form is not required in our case

The processing Dates for 140-EB2 is now Sep 24th.
My ND is Sept 19th. so far 1 LUD on Sept 22nd......anything to be done from my side(employer or the attorney) ???? or wait some more time.......

CHICCHU... yours must be a clean sail... with your PD current..must be getting done with whole process very soon... ask your attorney to speed up things in replying so that there is no delay from ur side......rest is not in our hands.........

As per information from murthy.com, immigration.com and other resources, your 90 days start from the date you file 485 for your EAD. But if you get RFE for 485 or 140 then clock will reset to RFE reply date, that's your new time starts from the date they receive your RFE reply. So you have to wait another 90 days from the RFE reply date. Dont worry, once you reply your RFE then they will start processing ur EAD and you may get it in a month or so.

I guess u have to wait for a month after ur date becomes current, then u can have your attorney contact USCIS regarding the 140.
Employer is in India and is only coming back on 16th March,so the RFE will not go be replied until after that ,as he has to sign for it. It will be a smooth sail only if this 140 clears, and don't know how long it will be delayed because of this copy thing

WorryforGC,

This may be a good thing for us. I hope the LUD means that, that they have started to review our application, since we are out of retrogression. Let's wait and watch ( not that there is any thing else you can do ).

Fee for second extension

GC VARMA and some one else asked me about the fee for second extension.

This new fee came into effect on dec 8, 2004 due to Consolidated Appropriations Act of 2005 .
u can google on Consolidated Appropriations Act of 2005, to get more details.

I went to USCIS web site and clicked on forms and fees and then I 129.
Here we can see the fee details.

It says for first H1B application and first extension, the fee is 190+500+ 1500(or 750)

So, naturally for all other extensions itz base fee of $190 only
