2004 Consolidated Tracker ONLY (140/EAD/AP/FP/485)

Slow approval b/w 4/21 and 5/18

There is only one 140 approval b/w 4/21 and 5/18. What is happening, lot of people after us approved.

I am still waiting to hear from my lawyer, I gave him the info that my LUD got changes for both 140 and 485, he said lets wait and see.

Given the current processing date for EB2 case, your approval seems to sugguest that three is some linkage beteen two files.

I received my FP notice within few days after I got for my wife. Have any idea of a thread for AC21?

"On September 22, 2004, the results of your fingerprint review for your I485 Application to Register Permanent Residence or to Adjust Status were received, and processing has resumed on your case. We will mail you a notice if further action is needed, or when a decision is made."

9/21: went to San jose ASC, they took FP notices (no FP again) and said no need to do the FP again.

9/17: received one more set of finger printing notices , I called my lawyer she said go to San Jose ASC again and show them notices.

FP Notice

I have received FP notice for me and my wife, scheduled for Nov 16, 2004 in Baltimore , MD. No LUD change, today I have received FP notice in mail.

Can I go for FP before the scheduled date?

I think it is from California Cervice center(WAC-04-228-5xxxx). Please post in that center.
 
Explanation of "Appellate Body" clause.

Kamvp, immiuser_140, Legally_Alien, gccrak and North American,

Here are the details about "Appellate Body" clause. There is good news and a bad news. The bad news is, this message means the case is NOT approved yet. But the good news is the initial review of the adjudicator is favorable and he/she has approved the case. But he/she is not sure about the decision and hence it has been referred to a higher official. This Process is called "CERTIFICATION". This happens under two circumstances

1. Head quarters has instructed the adjudicators to certify certain predefined cases, patterns of cases or patterns of facts.

2 The case is very complex or the facts/arguments for the case are so "novel" (lifted directly from the regulation/SOP), that it requires a review.

I believe the notice which they have sent us is Form I-290C. This should explain the details of why our case was certified instead of approval. We have 30 days of time to file a brief in favor of the case or it can be waived if we think it is not necessary to file a brief. 30 days period can also be waived by the reviewer if a favorable decision is made and the case is approved before the brief is filed.

Also FYI. A case could be certified either for an approval or denial. Since I see the word "Approval" in all our messages, I am hoping it is being reviewed for approval. That is why I said there is a good news also. Hope I am right. God help us.....

The law governing CERTIFICATION process is covered under Title 8 section 1103.4 (Also called just 103.4). You will find it thru google if you give this search "PART 1103—APPEALS, RECORDS, AND FEES".

I also found a PDF Document with Standard Operating Procedure it is called "AFMChapter10-Overview.pdf". Search for this document in google you will find it. Look under 10.8 and 10.18 sections of this PDF.

If you have already recieved the form, can you please post or PM the details? I would appreciate a lot.

I am right here, but no news to share

Hi njlabor20011,
Thanks for asking, I am still waiting for my 140. No LUD change etc., no movement at all. I am scanning 140s for ND 5/18. There are total 216 I-140 for this date. 89 are approved so far. Lately they are touching atleast 4 to 5 I-140 cases everyday for this date. There are total 11 RFEs and 1 approved with appellate clause.
