2004 Consolidated Tracker ONLY (140/EAD/AP/FP/485)

HI there.......I just to say thank you to all you.....this site has been a tremendous help for me, it has tought me a lot.

last night at 7.30 pm I got the e mail from uscis, my I-140 has been approved!!!!!!!!!! and my I 485 has been transferred to dc office

here are my details
:)
nd 04/15/2004.............I-140/I485 no ead no ap....concurrent filing EB3
I-140 ad......... 08/05/2004 ////// no RFE

have faith all of you.....i was really worried that my I140 was going to get denied cause my sponsor, 4 person company had posted losses since my lc date wich was apr 2001.....i got my lc certified on dec 2003......What helped was that i was still making the salary offered in the lc $27000

so even if your sponsor is not making any money but your w2 shows the salary offered in the lc you will be ok

BTw if any body can give me his opinion as to why my case was transferred to local office???????????????? :)

If we go by the tracker sequence no, I am next in line. But, i may not be so lucky. Still keeping fingers crossed.

congrats on your approval......
did USCIS or your lawyer actually asked you to submit W-2's at any point during your I-140/I-485 filling process? from what i understand is that, unless you are filing labor/GC with same job position that you are holding currently, GC could be for future position too. ie one could file for GC without physically being present in the country or without working for that particular company. In that case the W-2 theory doesn't work. May be our senior members, like jharkhandi, could comment on this issue as this has been discussed number of times withour clear resolution. comments awaited....

W-2 is about paying capability of the company. In scenario of future job context as mentioned by you it is presented in a different way.

CIS will look the capability of company in paying the LC salary.
If the company is already paying the LC salary, that it can even pay in future.
That is the proof of W2.

As you said the GC is for future and can even process to anyone even persons outside of US. yes it is true then :
1) Company's profits and 2) Company's assets come into picture.
Because the person is not working for this company and the company is not paying any salary, they look at the financial strength of the company.

CIS goes by this :

W2 + Company profits + Company net assets >= Your LC Salary
(In future employment case W2 = "0")

I'm also having same situation like u.. and i contact air india, i've got this mail. Hope this can help...
IF YOU ARE HOLDING A VALID USA VISA ON YOUR PASSPORT AT THE TIME OF TRANSIT, OR HOLD A GREEN CARD (WHITE CARD ONLY) ISSUED ON ARE AFTER 21APR1998 YOU DO NOT NEED A TRANSIT VISA.
HOWEVER IF YOUR USA VISA VALIDITY ON THE PASSPORT HAS EXPIRED AND YOU ARE HOLDING A VALID PAPER EXTENSION OR PAROLE OR I94 OBTAINED FROM THE USA IMMIGRATION AUTHORITIES, OR HOLD A GREEN CARD ISSUED BEFORE APRIL 1998, YOU WILL NEED TO OBTAIN A TRANSIT VISA.

this is what the German embassy in the US has to say about transit visas.
- i am not talking about visitor visas to Germany - just transit visas

"Indian passport holders with advanced parole do not require a transit visa
for airport transit only."
