Hi Itec,

Could you please let me know how we can confirm with FBI if my name check is already done besides the email.

Set an email to fbinncp@ic.fbi.gov on Tuesday, January 25, 2005 6:04 PM
and haven't got any response.

Please give me any suggestions. Most important is as I am presently working on EAD could you guess when it will be approved.

Thanks a ton.

FP done at Newark , 140 Approved the same day

Me and my wife did the FP at Newark , NJ today . The wait was not too bad , got there by 10.30 , finished eveything by 12.00 , Came back home checked the mail around 5.00 , saw the email that my 140 is approved ,
May be just a coincidence . (EB2 RD is 05/9/04 ) .

Jharkhandi,

I got my PP stamped today and they have not allowed my wife as she was scheduled on 15th. I waited for one hour, they took index finger print,my485 approval notice, two pictures and stamped I551 on my PP. The clerk told me that I can expect my card in 6-12 months.

Regards
Kat

Thanks for compliments Kat. The difference in notices is perhaps due to the fact that it is transition period and USCIS seems to be running both processes in order to evaluate how good and mature is FP code 3 for them!

My feeling is that down the line, some code 3 people will not get the card in time and then USCIS will revert partially - maybe start putting stamp(without asking for another right index FP and photographs) - this will be a nice compromise between saving time and saving hassles for applicants. Another feeling is that people will be able to exercise this option only if they do not get cards in 120 days of approval. - Just a feeling - all this may take 6 months or more, if USCIS ever realizes the pain of applicants who missed cards. Eventually most of the applicants will get cards delivered directly, but I doubt if code 1 will ever go out 100%!

Do post your experience when done with FP.

All the best.

itec,

my notice didnt say for PP but I am going .

Thanks for ur suggestions.

I think in your case you were told to stamp PP?

If this is correct then wait for 120 days then you can raise query. But in general you will get you GC in about 3 to 4 weeks.

Keep your approval notices and welcome letter safe...very important.

Make sure your PP stamping is nicely done. Because I have seen one case where immigration officers in India gave one lady hardtime to board a plane. She was questioned about stamping authenticity. She was luck to have welcome letter handy.

Most practical and To-The-Point-Guide !!

Can get any better ..... Excellent !

We got our FP done @ Newark, NJ. The scheduled time was 9:00 AM EST but just to beat the crowd we (my wife and me) went there @ 6:30 AM. Please don't call us nuts as, believe it or not, there were already 20 people ahead of us. Ours was code 3.

We were just asked to produce the license and the original FP notice, although we had taken quite a lot of stuff like EAD, 485 notice, etc with us. For people who don't remember their SSN, please take your SSN cards also.
At the 1st FP counter, they took the the FP of the right hand index finger, digital signature, and digital photo. At the 2nd FP counter, they took FP of all the 10 fingers. After doing the FP someone was called to do the QA of the finger-prints, after which they stamped our original FP notice and gave it back to us. Our FP was completed by 8:35 AM.

Parking:
I parked in the parking lot which is on the junction of Commerce St and Mulberry Drive. The parking attendant comes only @ 7:00 but u can park earlier also. The rates are $8 for 1 hour, $10 for 2 hours and $12 for 3 hours. For people who are coming by train, it's only 7-8 minutes walk from the Newark Penn Station. For people coming after 8:00-8:30, I would advise them to take the train as getting a parking might be difficult.

Cracked/Dry fingers:
I would advise such people to start using "Corn Huskers Lotion", available @ any Pharmacy, at least 2-3 weeks before the scheduled FP date. That's the lotion that the officials apply on your hands before taking FP. I had read somewhere on this forum earlier about that lotion also.

People With Kids:
I would advise them to take the strollers for sure. The wait might be long, depending on the time you go.

HI JK or ITEC or any gurus

Hi Gurus,

Today I recieved a mail from USCIS saying your I-485 is denied.

They mentioned just like this..

Title 8, code of federal Regulation , part 245.2(a)(2)(I)states:

Before an application for adjustment of status under scetion 245 of the Act may be considered properly filed , a visa must be immediately available. If a visa would be immedaitely available upon approval of a visa petition , the application will not be considered properly filed unless such petition has been approved. If an immediate relative petition filed for classification under section 201(b)(2)(A)(i) of the act or a preferance petition filed for classfication under section 203(a) of the act is submitted simultanously with the adjustment application, the adjustment application shall be retained for processing only if approved of the visa petition would make a visa immedaitley available at the time of filing the adjustment application. If visa petition is subsequently approved , the date of filing the adjustment application shall be deemed to be the date on which the accompanying petition was filed.

The immigration visa petition filed in your behaf.........was denied on Nov 10, 2004

Absent evidance that you are entitled to any other immigrant classification , your application must be , and hereby is denied

So boss my question is is it my I-140 is denied? Why it is not updated online. If it is denied on Nov 24th why they are mentioning now.Is it informed to my attorney?

Please let us know all inputs and how I have to proceed.

I appreciate all your help and time.

Thanks

AM_OPTIMISTIC,
Thank you for the valuable information. Appreciate your thoughtfulness.

One Question.
--------------
I have my FP scheduled for 14th of April at 3:00PM at Newark, NJ.
Will they accept me if I go there as early as you did.??

Thanks

Hi palmighty...
now this is something which I won't be sure of.. There were approx. 20 ppl in front of me but nobody was turned back...

Even @ 7:00 EST there were abt 50 people which became abt 100 by 7:30 AM..

Call to NSC...What am I missing

Guys, A really basic question,
After dialing the 1800 number for NSC, and going through the menu, by pressing, 1-2-6-1, I was prompted for the receipt number, assumed it was EAC-xx-xxx-xxxxx and went ahead and entered all the numbers without EAC..and I heard the prompt "You have not entered enough digits" and kept reprompted time and again...what is it that I am doing wrong?

It's also possible that your 140 might have been revoked by your employer.

Try to contact UnitedNations immediately. He is an expert in such matters.

My wife and i went to Wheaton, MD service center for finger printing. The appointment was at 1pm and we were there at 11 am. The person who checks for the documents was about to let us in when some lady who was there to translate for hispanics came and pointed out the time as 1pm. So they turned us back and we went in again at 1pm. We waited about 40 minutes. Everything was finished in 20 minutes. Staff was very helpful and friendly. Finger prints, picture, biometrics (index finger, signature) was taken.

The person helping my wife turned and asked what exactly i did. I had to tell him one by one. He was helpful, but didn't know exactly what needed to be done.

So now I should expect LUD changes in a few days I guess.

I got my first LUD the same day both for myself and for my wife.

LUD change 4/7/05

Gurus, Please advise.
Filed concurrently in second week of January’2005. I have not yet joined GC sponsoring company. I got EAD. I have a fulltime offer.
1.Shall I take fulltime offer using EAD?
2.If so can you please let me know if I need to follow any procedure?
3.Anybody got I 140 approval who filed using EB2 in 2005?

If my employer revoked , how do we know that it was revoked,

To whom do I need to contact what exactly the reason. It was denied on Nov 10th, but no update on USCIS web site.It is still says application received on Sep 1st 2004...

If it is denied then how come I got FPs and we did FPs and 485 message chnaged that received and resumed etc..

I have not yet contacted my attorney as I received(seen) only at 6 pm of PST and my attorney is on EST.

When I am working with them, how can they revoke? can they revoke when working and in their pay roll.

My seventh year is completing by July end, but EAD valid upto Nov end.Can I stay in this country upto nov on EAD even though my application was denied?

Thanks

Dial 322 (for EAC on your dial pad) before the numbers.

is this for EB2 or EB3 , did that Agent told you about that info, that
they are looking RD for 485 Applications?

ptlsb said:
Just a while ago spoke to the Agent in Vermont center requesting him about my case status.

He took my receipt number and Name.

Asked me what i need? Asked him about my case status and he politely told me "Sir, the status is posted on the website".

To that i requested him to verify if the case is being updated with my latest information of AC21 which is sent on Feb' 15th 2005.

After he digging into something in his system and making sounds like sh..sh..sh..
he asked what that is? Is that I129 for seventh year...

I replied no Sir, it is for change in employment after 180 days... after listening to me he spent sometime with his system and told me "I don't see any thing like that in your file" You all know could not ask why?

I requested him how long would it take for a case like me to be approved?
He replied "Sir we are processing 485 cases based on the receipt date"

Again asked him are you not going by PD?

He replied "Sir we are going by the Receipt date, on which the application is filed and you can have alook at those dates in the processing times"

Could not ask this guy more...

Said.. Thanks for your time and have a good day...

He said the same to me.

Now what does all this mean? Please somebody respond to my plea..

Is my AC21 gone missing...if it is not there...

My 485 receipt date is 3/30/04 if he is right can i expect it to be approved soon.

Let me know.

Thanks

Third LUD (04/08/2005) and FP received message changed. It took 21 days after we completed FP and 17 days since last LUD (03/22/2005) change.
I am posting it here becasue I saw many ppl were getting concern about FP received message not changed after week or two of FP and started to call FBI/USCIS. I think best thing will be to wait at least 3/4 weeks after FP to see the FP received MSG change.

My feeling is that the entire process of updates (LUDs) after FP has slowed down due to the large number of FPs done ..

So, for us, those who are waiting for FP received message change should not take tensions.

Any other thoughts ?

Don't worry about this because friend of mine gave FP on 6th Sep 2004 still his message is not changed when he called USCIS he was informed that somehow system message is not changed.
