2. Once the baby becomes 21 he/she can file petition for his/her parents but the catch is that he/she must be making enough money

The formula is that the person must make atleast 1.25 times the poverty line X (number of dependents he is sponcering + himself and dependents already present in USA)

3. In some situations they can, I read about this few months ago in murthy.com

Since the baby is US citizen they don't need to go through the immigration process.

AC21 Rule of counting 180 days

Gurus,
I am a regular reader of this forum and need a suggestion from most senior memebers of the forum. I got a job offer(full time) from the client I currently work for. I filed my 140/485 concurrently on 23rd Aug 2004 and got 140 approval on 11/01/2004. My attorney is advising me to join the client only after 180 starting from the day my 140 approved. Is it true that I am not eligible to use AC21 even my 485 is filed >180 days and 140 approved 127 days back or my attorney is being too cautious?

I really appreciate your response. Please forgive me if I am using wrong thread for this question.

For invoking AC21, the rule is very clear and it says that you need to have 140 approved and your 485 should be pending for 180 days. Please note that 180 days is from 485 filing date and not from 140 approval. Looking at your post, you have already crossed 180 days after filing your 485.

Also, browse the AC21 forums to get more knowledge. You will have to make a thoughtful decision whether you want to inform USCIS about your AC21 now or respond if there is a RFE on your 485.

If I were you, I would go ahead and invoke AC21 and take the new offer.

H1BneedGC is right. Make a search on AC21 on the forum - you will get additional stuff which you will need sooner or later.

Fine prints of AC21

1. Same or similar job
When you change a job this is the first issue. In your case now you are with a consultant working for Company A. When you filed for your labor your consultant may have used general job description which fits many jobs so that when you are working for different companies without impacting your GC process. Now as Company A wants to offer you job you want to make sure with your lawyer, and Company A regarding your job description and pay level.

2. I-485 pending for < 180 days and approved i-140
There is a lot of controversy regarding this matter. I-485 pending from < 180, the catch is here. 180 days from filing or after i-140 is approved? So your lawyer wants to play safe that is advantageous for you.

3. Your safety
Now Company A may be paying your consultant $100.00/ hr and say you are paid $30/hr. Company wants to save $70.00/hr by hiring you ($70 x 8 hrs x 5 days x 4 weeks x 12 months = $ 134400). So you want to make sure that after joining Company A will keep you for long term preferable you +1 year after you get your GC.

4. Many time consultants try to revoke i-140 hence you have to face hardship and fight back so make sure you don’t run in this trouble. Reason you may be well aware.

Question Regarding Spouse FP

Hello Friends,

Hope every one is doing great.This forum so helpful and informative.I have a small question here. Gurus like Jharkandi,itec or anyone please share your thoughts.

I filled my 140 and 485 COncurrently Last November 2004(Labour Sub PD 2001).I got the FP notice and finished my FP (early FP,code 3) Last week.My concern is,my wife is in India already and we will be back after 5 weeks.But If I do so,then I have to postponed my wife FP date.

1.Is it advisable to post pone the spouse FP date?
2.By any chance does it have any implications on My approval (140 and 485).I am the primary applicant.
3.Since EB2 moved already to Dec 16,I did'nt get any message reg my I-140.Do you guys have any rough estimate,when it will be through.By the way TWO LUD changes already in I-485 after the FP.

I need to be behind my attorney for this. As of yesterday, they said, they will take another 2 weeks.
