I got FP notice as well

I got a FP scheduling notice yesterday.

Could someone who updates I-140 include my new information please.

NSC way is that get everyone's FP and then sleep on files. You do not have to wonder Kosmo - you are 2001 LC PD - you will get approval soon. Looks like PD has started playing a role, atleast in VSC.
 
JK, lets see how this works.. now that i got used to waiting

this same logic works in case of labor sub of 2001 and applied 485 recently?

The State Department on their Visa Bulletin No. 77 announced that one of the reasons why they are imposing a cut-off date which is January 1, 2002 is BECAUSE THERE ARE A LOT OF CASES FILED BEFORE JANUARY 1, 2002. They want to clean the closet before accepting new ones.

Dexter mentioned the VAST MAJORITY OF BACKLOGS. I think most of the backlogs were cases that were filed or has priority dates around 2004.

The main reason why I DO NOT BELIEVE that there are cases older than January 1, 2002 is basically simple...THE STATE DEPARTMENT HAS ANSWERED IT THROUGH THEIR MARCH VISA BULLETIN. EB3 visa numbers moved to March 1. 2002. This movement is very important because IT ONLY PROVES THAT THERE ARE NO CASES OLDER THAN JANUARY 1, 2002. IN FACT THERE ARE NO CASES OLDER THAN MARCH 1, 2002 as of today.

About your question on consular processing and adjusment of status...According to the law visas will be given TO QUALIFIED APPLICANTS so it does not matter whether you are on consular or adjustment as LONG AS YOU ARE DOCUMENTARILY QUALIFIED and eligible for a visa.

The last quarter of the fiscal year 2005 will be starting on July 1, 2005 up to September 30, 2005. According to the law this PERIOD is referred to as the REMAINDER OF SUCH CALENDAR QUARTER that will be the time that visas will be allocated to countries that has exceeded its limitations of 7%.

The reason why I said that is my final article is because that is the end of it. This article basically explains everything. The only thing we have to do is wait. I also really got so tired doing this. I wonder why am I also doing this? But some men follow certain principles in life that is why they become REAL MEN...THEY ALWAYS STAND FOR WHAT THEY BELIEVE IN...WHICH IS THE TRUTH. i wont agree with this one becoz people having PDs of 2001 still waiting for their 485 appoval ,how can he tells that there are no cases before march 2002 ??
is he telling about Notice dates of 140/485 or Priority Dates ???
if Priority Dates then, here in our forum lot of people with 2001 are waiting and now they are getting FP's

I do agree, but for people affected by retrogression, his comments about the last quarter ie June-Sept when the unused Visa's of other countries will be availabe for the the retrogressed countries. If that is going to happen, than people should not worry about retrogression and wait for a couple of months to get their gc since already FP is on their way.

Expectant FP people

Something i learnt today, thought it would be useful to others waiting for FP.
I recently did change of address. Thanks to Vinod_tv, I called up USCIS to find out why i didn't get FP or whether it had been sent to my old address. Yesterday they said, my 485 case is on 60 hold shelf. That could be because USCIS is waiting for something from me, possibly FP. But i never received any FP notice. I called up again today to find out more about my case. After one hour of research by the representative, they found out that my FP was scheduled in Manchester, NH on Mar 17 for both myself and my wife. (It took some time for them to find out if FP was sent at all. Initially they said nothing has happened on my case.)

I confirmed with my attorney that they also didn't get any notice. I asked the USCIS lady if i can go to any other ASC and do FP. She said, since i didn't have the FP notice itself, that wouldn't be possible. So, she said she spoke with her chief and they are going to reassign the case back to the officer who scheduled the FP. The officer is going to reschedule it to another date in my region.

Correct me if i am wrong. I believe, if you don't respond to FP within 60 days, it is considered as if you have abandoned the GC process. So, i think that is that 60 days hold shelf.

People who think they should have got the FP, but yet to receive could call and find out, especially those who did Change of address.

gc_vsc's message talks about "Ability to file for 485" or "Ability to process 485 if already filed" (because of concurrent filing).

The issues is whether there are any cases before 2002, Jan 1st who are yet to file for 485? There might be, but very few.

The actual time taken to process 485 is completely a different issue.

if you can see in SESA NY there are lot of people who didnt even get their LC approved from 2001, i was also one of the victim but i did flie from another place and i got my labor cleared and applied 140/485 recently

its not few there are more cases for eb3 in NY city alone who applied before 2001

Y're right, once those NY labor approvals will come, they will be immediately eligible for 485 filing (and approval).

If the NY numbers are too many, then the Visa dates might become stagnant for a while or move at a slower rate than it actually would.

Btw, meet me, another victim of NY Labor. Another, I seriousely doubt if all those NY labors guys are still waiting in same state. The companies that filed for labor should be making lot of money by selling those labors when approved.
 
My employer sent 3 request to VSC asking about my I-140 because it is not showing up on the website or the phone-system. The last request was 2 months ago and till now we didn't hear any thing from the VSC.

As we all know visas are numerically limited. All the countries in the world have a PER-COUNTRY CAP for each visa categories. Many years before the EB3 as stated by the Department of State has remained current or “C” in the VISA BULLETIN but due to the BACKLOG REDUCTION effort of the USCIS more visas are being consumed than there are available. It means that the Department of State has PREDICTED that there would be more visas that would be consumed than there are available so they set PRIORITY DATES to slow down the issuance of visas. It works on a FIFO basis (FIRST IN-FIRST OUT) for all consular applications and adjustment of status. I ASSUME YOU ALL KNOW WHEN ARE YOUR PRIORITY DATES.

Another thing… it has nothing to do with the USCIS, your petition is still going even there is retrogression as long as it was been filed before January 1, 2005. The only thing that would happen is that it would FREEZE your consular or adjustment of status until well of course your PRIORITY DATES ARE CURRENT!

Ok this is the stuff you’ve been waiting for. HOW DO VISA NUMBERS MOVE?

Well as I mentioned earlier there is a per country cap visa limit for all countries. According to the LAW the consumption of VISAS are done in a QUARTERLY BASIS. The U.S. Government FISCAL YEAR starts at October 1 through September 30. So the Fiscal Year 2005 would start at October 1, 2004 and would end at September 30, 2005.
If you read the VISA BULLETIN at the travel.state.gov website there is a paragraph written below that the Department of State has PREDICTED it is necessary to impose a
CUT-OFF DATE to slow down the processing during the second quarter (January 1, 2005- March 31, 2005).

I hope you are all following on this. Well hmmm that is why the AILA (American Immigration Lawyers Association) claimed that they do not expect visa numbers to move until APRIL! Because April 1 would be the start of the 3rd Quarter of the FISCAL YEAR. According to the law, the Dept. of State can now use additional VISA NUMBERS. DEFINITELY THE VISA NUMBERS WOULD MOVE. Yehey!!!

My predictions during the 3rd QUARTER the PRIORITY DATES would be somewhere in around November 2003 or January 2004. The Department of State will be processing other cases that were approved by the USCIS(cases that were filed before January 1, 2005). First in-first out. The Dept. of State will be processing other cases without taking new cases in.

Here is really the most glorious part. LAST QUARTER OF THE FISCAL YEAR. (JULY 1, 2005 – SEPTEMBER 31, 2005 .)

ACCORDING TO THE LAW --- ALL UNUSED VISAS FROM ALL OTHER COUNTRIES AROUND THE WORLD WILL BE MADE AVIALABLE TO THE Philippines, India and China and other countries that has visa cap.

MY PREDICTION IS THAT PRIORITY DATES WILL BE CURRENT DURING THE LAST QUARTER FOR THE EB3 CATEGORY.

What the Department of State did is that they choose a priority date which is January 1, 2002, a date far enough so it would freeze processing entirely for the 1st and 2nd quarter (Oct.1, 2004 to March 31, 2005) so the Department of State would have time to process visas without taking new ones. On April 1, 2005 to June 30, 2005 (3rd quarter) the Department of State can open up and distribute visas again until the per country cap is met again. The good thing is that ACCORDING TO THE LAW, on the fourth quarter (July 1, 2005 – September 30 2005) THE REST OF THE WORLD’S UNUSED VISAS WILL BE GIVEN TO THE PHILIPPINES, INDIA AND CHINA. The EB3 category will be CURRENT AGAIN!

Although it will be ON and OFF until the U.S. Congress passes new legislations but IT WILL BE ONLY 5 TO 7 MONTHS DELAYS AND NOT 3 TO 5 YEARS. Do not believe all what you read in newspapers and articles

Hi Anru Would appreciate it if you could share the phone number you called to get this response. My PD is in 2001 and 140/485 ND is May 20, 2004. I'm starting to get a little concerned about the fact that I've not received my FP notice as yet.
