    A tale of two I-485's

Dear All, my employer applied for EB3 in early 2003 and when the dates became current in July 07, my attorney screwed up and couldn't file my 485 on time. They are filing 140 as I write this thread. My employer also applied for EB1 in late 2006 and I have a pending 140 and 485 as a result...

    Nsc Rfe

All, as expected, according to the online case status, I got an RFE from the NSC right after I applied for PP. My question is that how long does it take for them to mail the RFE? The online status says that on 5/31 we sent an RFE to you but neither me nor my lawyer has gotten it so far...

    PP @ NSC Timeline

Folks, I opted for PP at the NSC last week. The request for PP (along with $) reached the NSC on last Saturday but I guess they'll look at it only today due to the long weekend. In your experience, how soon will they do anything in the system that'll change the LUD? Thanks! GG_007

NSC - Anyone applied after July 1, 06 and has an update?

Since EB1 EA 140 processing at the NSC seems to be stuck on July 1, 06 for the last couple of months per their web site, I was wondering if someone on this forum has applied after July 1, 06 and got a response/update from the NSC recently. Thanks. GG_007

    New processing dates

What is more surprising is that for NSC, the processing date for EB1 EA 140 still shows July 1, 2006 - same as it was when the USCIS posted their last update on March 15, 2007. Could it be a mistake or they are really stuck on July 1, 2006? GG_007

    EB1 EA Timeline at NSC

According to the data posted on the USCIS site, as of April 18, 07, NSC is processing EB1-EA I-140 filed on July 01, 2006. It's surprising since it seems the processing date hasn't moved at all since their last posting on March 15, 2007. GG_007

    EB1 EA Timeline at NSC

Hello, how many months does the NSC take generally for adjudicating an EB1 EA case (yes, no or RFE) without PP? I understand that nobody can predict exactly how long it'll take, but I was a little curious about the general trend observed/experienced by forum members so far. I've applied for my...

    EB1 and 8th year H-1B Extension

Hi All, my company has applied for my EB1 EA. I'm also in the 7th year of my H-1B extension that expires at the end of Sept 2007. If my company doesn't file an 8th year H-1B extension before knowing the outcome of my EB1 case and if my EB1 EA gets rejected say in Nov 2007, I'll be out of status...

    Difference between self-application and employer-application

Dear All, is there an advantage of applying for EB-1 EA through your employer (vs. a self petition)? Intuitively (without any data/facts to support), I think if your employer is well recognized (say a global giant in your field) and if they file a petition on your behalf, your application may...

I-140 E-filed EB1-EA: usps express mail can not deliver the supporting documents

Hi Madgu, did you file an appeal or created a new case? Good luck. GG_007

NIW RFE Approved at NSC today!

Congratulations! One quick question. I think I read in one of your previous posts that you had submitted some "new" things/evidence for your RFE. Did you work on those things after your initial/original application submission [but (obviously) before the RFE]? Thanks! GG_007

How did you deal with such a unprofessional lawyer?

Some tips: 1. Talk to your manager or HR partner 2. Talk to your attorney's manager 3. Hire another lawyer yourself GG_007

    Wife using EAD

Folks, I applied for EB-1 EA in Oct 06 and we just got our EAD cards. I'm in the 7th year of my H and don't intend to switch my job but if my wife gets her SSN and starts working on EAD and if our 140 gets rejected for any reason (yes, it's at NSC :-)), will she lose her H4 status? Does it have...

    advantages/ disadvantages to premium processing?

You're absolutely right, Pana. GC (or anything for that matter) doesn't really matter beyond a point. Forget about the US, we don't have "permanent" residence anywhere in the world. :-) GG_007

    advantages/ disadvantages to premium processing?

This is interesting. Was the quote taken from an appeal (that had been already denied in all probability) or an RFE response? What's your take? My attorney categorically said that for an RFE response, additional things would be considered. GG_007

    advantages/ disadvantages to premium processing?

Okay folks. I just confirmed with my attorney. It DOES count. I mean, even after your original submission, you can continue doing your usual good stuff and in case of an RFE, you can submit it. GG_007

    advantages/ disadvantages to premium processing?

Pana, in theory what you're saying could be true. However, in reality, a friend got his EB-1 OR approved and he had worked on papers, conferences etc. after his original submission. In my case, my firm is sponsoring all the expenses so it's not about $1K but I'm assessing the true value of PP...

    advantages/ disadvantages to premium processing?

Here are my $0.02 about PP: Since 140 doesn't have any major impact on 485 (and thus your GC), filing PP makes sense if you are close to or over 6 years of H so that a 140 approval can buy you 3 years on H AND are fully prepared for an RFE response. Again, since 140 approval doesn't really...

    Visa Bulletin Feb

In the Visa bulletin, under employment based, when they say, "China", "India" or any other country, do they mean country of birth? What if my country of birth is either of those countries but I'm a permanent resident of a non-retrogressed country such as Canada? Does it help in any fashion...

    7th visit on B2 in 7 years

Dear All, my mum has a 10 year multiple entry visa since 2000. She has come to the US every year and stayed for slightly less than 6 months each time per her visa stamp. Last time, she went back to India (our home country) in Sept 06 and is planning to visit the US again in March 07. It'll be...
