    AC21 - resignation vs lay-off

Hi Guys, Could anybody advice me on the following matter: Given one has I-140 approved and I-485 is pending well beyond 180 days, is there a difference for using AC-21 between being laid-off from the sponsoring company versus resigning on one's own accord? What are the implications in both...

    Traveling thru NH

Do you refuse to carry your driver licence as well? You should, if you are such a man of principle. If such measures would help to enforce immigration laws and oust some of 7 millions illegals from the country, carrying EAD would be much lesser inconvenience for us, comparing to what we are...

    Traveling thru NH

Wow! I live in NH, but never heard anything like that... Where and how did they stop you? Just pulled you over on a highway like regular cops?

    140 Approved

Re: Congrats... Thanks, guys! Regarding the LC match - hard to say, I never saw the LC. :) But the lawyer asked me to "emphasize" some experience in the resume and the reference letters, so I guess it was pretty close... Good luck to anyone who are still waiting for I-140 approvals!!!

    140 Approved

I can't stop myself from looking at those magic words over and over again! :D So, my I-140 has been approved as of March 15th, 2004. ND - January 30th, 2003 (EAC03091XXXXX) EB3, labor substitute, concurrent filing, no RFEs. I have to admit I might be wrong saying there is no...

    use Advance Parole

Charles Fellow, if your H1/H4 still valid and you are still working for the same employer - use H1/H4 for reentry. Entering US with AP can be a quite painful, I can tell you from my own experience. AP is a subject for additional check from the immigration service, for some folks here it took 10...

    EAD renewal - Attorney Fee

The I-765 form posted on a USCIS website is quite self-explanatory, but just in case, there is a checklist suggested by our company's legal deparment: - I-765 application - 2 color photographs (compliant with USCIS spec). - Copy of I-485 fee receipt notice. - $120.00 fee made payable to...

    EAD renewal - Attorney Fee

Cool!.. Now I see where the "shortage of skilled professionals" came from. Why waste your time on computer or biology science when you can charge 1000 bucks for possessing the basic skills of literacy? It took me one hour and cost 37 cents "in mailing charges" to prepare and mail EAD renewal...

EAD renewal - I-140 dependency theory...

...is proven to be wrong in my case. I've just got my EAD renewal approved (which is of course a good news), but it has no impact on I-140 application. Still pending, 13 months and counting.

RE: Any I-140 Approval @ VSC

They don't. By running a scanning script I know those "processing dates" are meaningless. The day I am watching is January 30, 2003, more than a half of cases in this day still not approved, and the processing speed dropped to 2-4 cases a week. (No reason to kill oneself, though...)

Its more than 100days that i filed EAD...

I wish we would pay an application fees not upfront but after a case is processed. This simple alteration in rules would change situation dramatically - those bozos would need to move their fat asses in order to get paid. (Of course I understand how utopian this idea is...) Now we just...

    IS EAD Enough?

It is perfectly legal and you do not need any other proofs, but it all depends on a company HR's attitude and knowledge about immigration issues. I talked to one company some time ago, and all my attempts to explain what EAD is only triggered suspicions. They knew only two things - H1 or GC (I...

    EAD and H1 Question

Well, I am not a lawyer, but that's what I was told by my company's legal department. From the first day of employment based on EAD the H1 visa and status are invalid. Means there is nothing to transfer anymore, and new H1, if needed, should be obtained from scratch, with all implications.

    EAD and H1 Question

    1. EAD approval does not change your status. You still on H1 until you use the EAD for employment. 2. That's why it is preferable to stick with H1 as long as possible - in such unfortunate case as I-140 rejection or revocation you have a chance to find a new employer and go for H1 transfer...

I-40 approved in July - but still same receipt message on case status

I wish I was... :) If you already have a copy of approval - what do you care about that lame online message? The online system was noticed to be incorrect about a case status on numerous occasions.

I wish there was such a strong high tech industry in my home country as you guys have in India... I wouldn't take this abuse any longer.

need advice on travel without AP

If you never used the EAD for work - you are on H1, and do not need AP. But you have to do something about new H1 stamp in the passport in order to get back in the US.

    Vermount Center Backlog

EAC03091 (January 30, 2003). I don't have the data on hand right now, so numbers are approximate: ~260 I-140s, among those ~100 approved and ~40 in "RFE Send / Received" state. 1 is transferred to local office and 2 have undeliverable mailing address. And it is not "4 approvals a day", such...

    Vermount Center Backlog

After I have scanned all the I-140 applications in my ND, I trend to think that posted "processing date" is virtually meaningless. ~40% of all I-140 in my day has been approved already, and approvals / RFEs continue to drip slowly, 1-2 on average day, (4 approvals a day is the best result I have...

Change in Address-AR11..Should spouse also apply AR11?

My company's lawyer suggested to me just to put "N/A" here. BCIS must receive them by truckloads, so I highly doubt they do anything meaningful with that dull AR-11s.
