use Advance Parole

Hello Fellows,

We are thinking to use our Advance Parole (AP) documents to re-enter the states...but not sure if there is any significant problem of doing so... I'd be thankful if you can share with us your experience....

The following are some information about our cases:

1) I am a research scientist in a university with H-1B visa, my wife has a H-4 visa;

2) We concurrently filed I-140, I-485 and Advance Parole in March 2003;

3) Our Advance Parole have been approved, BUT I-140 and I-485 are in pending status now...

u can use advance parole. its meant for this very purpose.

Charles Fellow, if your H1/H4 still valid and you are still working for the same employer - use H1/H4 for reentry. Entering US with AP can be a quite painful, I can tell you from my own experience. AP is a subject for additional check from the immigration service, for some folks here it took 10 minutes, for me and my family - 4 hours (after the 11 hours flight)...
