need advice on travel without AP

Hi Everyone,
I have valid H1 extension paper and my old H1 visa has expired and don't have my passport stamped with new H1 extension.

I need to travel to India shortly.

I don't have AP (even though have EAD which I didn't use and I am currently working on H1). In this situation, do I need to have AP to travle to India?

If you never used the EAD for work - you are on H1, and do not need AP. But you have to do something about new H1 stamp in the passport in order to get back in the US.
 
You don't need an AP if you are in H1 status. You can get a VISA at US consulate and travel back to US.

But if I were you, I will try to get AP first and then think about traveling.
 
I need to get H1 visa stamped on my passport from India(calcutta) while coming back to USA.

Since it's taking more than 3/4 months to get AP, I don't know if we will get AP soon. Is there any quick way to get AP before leaving USA?

Emergency AP is possible. You can walk to your nearest immigration office with I-485 original notice of action and show the reason to travel, they might issue an AP.
 
Incase you do decide to get H1 stamped in India, the process is quite simple. But you need to take prior appointment and that can be online. Make sure you get a suitable appointment before finalizing your tickets.

i also want to travel to india in Jan or Feb on AP. Do i need EAD along with AP to return back to US. I am also in the same boat as abhi123.

This issue was raised several times. Just to summarize.

1) If a person has valid H1 period left, but visa has expired and has applied for AOS (note here that you do not need to have applied for EAD) you NEED AP to travel (if you are not intending to get visa stamped).

2) AP can be used without having ever applied for EAD or used EAD.

3) If you have used EAD, u MUST use AP to travel.

It is taking 3-5 months to get AP. Also I have heard that emergency AP is issued only in cases of REAL emergency. Sister's/brother's wedding do not fit into the interpretation of emergency. In such cases Emer. AP was denied. Again that depends on the emotional factor of the Immigration officer.


As always when on AOS one should be extra vigilant.

Another 2 paisa advice. If you want to use AP and you are traveling via London/Paris/Frankfurt, you NEED Transit visa. Keep this also in mind.

I am 100% sure about London. I am not 100% sure about Paris and Frankfurt.

Can you please let me know how to get transit visa from London or Paris or Frankfurt? Do I need to get it from within USA before travel or can we get it from London/Frankfurt or Paris?

Search for transit visa to London. Almost a month ago there was a huge thread on the forum. You can get the visa in 2 ways:

1) If you are near NYC, you can go personally and apply for the DATV (Direct Airside Transit Visa) and get the visa the same day.

2) You can mail your application with the requisite fees and get it. Based on the several users experience, allow 10 business days atleast. With this option you will have to pay for the visa + the courier charges.

Dude,
What you have is a normal passport (unless u r a son/daughter of some Ambassador or some Minister). The requirment is diplomatic or official passport.
 
FYI...

Diplomatic passport are in RED color and official passport are in White color. Those passports are only issued to Govt. of India (normally MEA) employee(s) and their dependents.

RED: This passport is issued to people from Indian origin working outside India as a govt. of India employee (like embassy, consulate).

White: This passport is issued to all other Indian govt. employees who are working outside India on deputation to other international organization like UN etc.

Most probably you have blue passport issued by Indian govt.
