You will have to redo your I-140. However what you can do is to file I-485 based on your EB3 I-140 and later replace it with the EB2 I-140 (once that gets approved).

You are perfectly fine they way it is. You can use your EAD with the new name and passport with the old one.
HOWEVER, I would strongly recommend that you contact your embassy/counsulate in the US and have the name on passport changed.

In your case, I would convinnce the lawyer to file status-quo response to RFE and not try an explain the impending spin-off etc.

That is possible. I guess you were a bit too impatient. Wait for about a week and then call back. Tehy should be able to tell you the status of both cases. It ususally take that much time to have it cleared and sent to INS
