My lawyer called today and he said he has received RFE from VSC.

Basically asking for my employment verification. My lawyer
said VSC has been sending out tons of these lately.

I am glad that they got to my file, but little upset that
they issued this RFE without approving it.

I do have a question for you guys.

     The organization that I work for will spin-off as of 2/1/2001.
     We couldn\'t file for I-140 adjustment ahead of time because we can\'t
     use the new company name before 2/1/01 because that is
     when all the tax code and etc.. becomes available.
     
    My lawyer said he will explain the situation and refer to the new
    180days law (which is still not clear he says)
    to convince INS so that I don\'t have to file
    redo I-140. He said I am the first guinea pig to try this in his office.
    Basically, he is sending all the information requested on
    RFE with a letter. Since I got RFE before 2/1/01, he could
    just send the information without telling them about the spin-off,
    but he was concerned that this could come back and bite me
    later on.
    
     He said he will also file I-140 re-do right after 2/1/01 just in case.

Any similar experience or comments or advice???

Thanks for posting the good news that VSC has finally gotten to Oct 99 cases.

In your case, I would convinnce the lawyer to file status-quo response to RFE and not try an explain the impending spin-off etc.

I guess legally you are not bound to explain what is to happen in future, as long as you can satisfy the RFE.

Actually, since your division hasn\'t been spin-off yet, technically you are still with your old company. So, why don\'t you respond saying that you are with your old company. At the same time, get the paperwork ready to file I140 redo and file it next month.

The approach that your lawyer is taking is very likely to case a xfer of cause to local office and the delay might be significant.

To be honest, I don\'t know what the difference
b/w ND and RD. The date I am posting is what
my AVM says. \'case received on\' 10/19/99.

Honestly, I request your attorney not to comment any thing about the spin off. that will trigger more delay. Just take the employement letter prior to feb and send it. You will be fine.

I am telling you this based on my experience. It would be better to just send them what they asked for. If you give more info, then ????
