DV 2025 AOS (Adjustment of Status) Process Only

I’m still not understanding, or maybe you’re not realizing that the CP process works quite differently to aos. with CP, most often, you will interview in the month your number is current. If you miss the interview, you lose out. Some countries let you reschedule (before you miss it), some don’t, some make you cancel before you can reschedule, some never get you back on the schedule. So basically if you have an interview with CP you need to get there in time. If you try delay the interview by delaying ds260 submission then all bets are off as to when you will actually get an interview scheduled. You can’t expect it to time it for the period you will be there. It may work out to what you want, but chances are more likely that it won’t. That’s why most people going home for CP plan travel back to home country for once they know their interview date.
I understand that delaying my DS-260 submission could make the interview scheduling unpredictable, and I can see why this might be difficult if I have a short time period in my country. But assuming I go back to my country for all of my summer break, arriving early May and not returning to the U.S. until mid August, wouldn't that be enough time to receive my interview appointment? I would be available at any date within that range.

Sorry if it seems like I'm going round in circles, I just want to make a safe and well-informed decision.
 
How does applying for AOS through the DV lottery affect my current F-1 student status if the green card application is ultimately unsuccessful? Could it also impact future visa applications? I know that AP could pose a risk, but what about just applying for AOS?
Applying to process via AOS or CP both signify a demonstrated immigrant intent which can negatively impact future NIV applications, if in the event the GC application is not successful. An unsuccessful AOS application has no impact on an applicant’s current status as long as the applicant has not engaged in any type of activity that would have violated the status.

No one can predict when a CP interview could happen in this case. KCC process DS260 forms in the order in which they’re received, the form processing could take up to two months or more, depending on how busy the KCC is as at the time of form submission. Then there’s the issue of the embassy where the interview is supposed to be scheduled at - some embassies are drastically limiting the number of DV cases they’re willing to take, while some are operating as normal.

Once you submit the ds260 timing is out of your control. You don’t know how long kcc will take to process it, or when in the monthly scheduling cycle they finish processing it (does it immediately go into the queue for the next scheduling cycle or do you miss that cycle and wait another month) or or if there is any backlog at your embassy delaying a slot. You may have a “window”, but what if you get scheduled before or after that window?
all this even before you have any idea how accurate your estimate of when you are current is.

Just about to finalize my AOS package and send next week, but wanted to check on the Tax portion of the documents. I have only been in the us since February 2023, but have my 2023 tax return documents that I sent to the IRS (W2 and Form 1040) as well as payslips and bank statements.

Would the W2 be satisfactory or is it recommended to send the whole tax return (W2 and Form 1040 etc) with my payslips and bank statements?
 
One other question: if I try the CP route but don't end up getting an interview before mid-August, (date when classes start and I have to return to the U.S.), will I not be allowed entry? Will I lose my F1 status?

I’m not sure what you think an attorney would be able to do for you, help you make a decision? There’s nothing they can tell you that we haven’t already told you, assuming you can find one who is knowledgeable in both AOS and CP processing for DV cases. Anyway, I don’t have any attorney that I can recommend.

IRS “tax transcripts” is recommended in place of the tax form itself. Take a look at the AOS process spreadsheet for the list of recommended financial documents.

It all depends on what CBP is able to determine at the POE. If they’re able to determine a demonstrated immigrant intent, they may decide to not admit you into the country.

Hello,
on the weekend, USPS informed delivery showed a letter for each of us from USCIS, supposedly delivered on saturday. Its still not here as of today. The photo of the mail is postmarked with 11/06, I rescheduled bio a day or two before for the same week.

Also, it seems to be from the NBC, if thats somehow an indicator.

1. This is very likely just the original bio notice or could it be something else?
2. Should something be done here, like redelivery?
3. Would an EMMA agent know what was mailed out to us?

Following up on this. The mail did not show and it’s now been a week. Whenever USPS says it’s expected today and it does not show on that day, I never received it in the past. Should I do anything regarding this?

Can I somehow find out through EMMA what the mail was and have them resend it?

Our post office and USPS in this region is completely ignorant of any issues, this is not the first time mail went missing unfortunately but I will try.

Yeah, you can contact Emma to find out what was sent. If it is your bio notice, it will not be resent since you’ve already completed the bio anyways.

Is your name posted on your mailbox? It’s not unusual for USPS to return USCIS correspondence back to sender as undeliverable if recipient’s name is not listed on the mailbox.

And if you’ve been having consistent issues of mail not being delivered after it already showed up in your Informed delivery as incoming mail (as against mail getting stolen, hence the missing mail), then you really need to follow up with USPS, as against giving up while adopting the attitude of the USPS in your region being ignorant of issues. You can always escalate issues to the post master general level just so you know.

Yes names in the mailbox. It’s not very frequent, but one other USCIS notice went missing some time ago. I had it in my account anyway so decided to not get bugged with it.

With „as against mail getting stolen“, do you mean the mail has likely been stolen or not?
