F1 refuse for 214b needs your opinion

Hi my sister is Phd student and she applied for f1 visa she was rejected for 214b even though her documents were complete I need to know how can she prove ties with home country Pakistan at the moment she is single her brother is us citizen and her mother is green card holder .
I heard from rumors when you have relatives in USA there is no way they will issue visa because they think she is only applying to get settlement in the USA is it true ??
Also I need to know if my mother apply her for I-130 does it effect her if she apply again for F1 student visa ?

My guess is your sister’s (already approved) I-130, coupled with the fact that she has a USC brother and a LPR mother did not convince the CO she has a genuine intention of entering the US with the sole purpose of studying, hence her inability to overcome the perceived immigrant intent. I’m not surprised the CO came to this conclusion considering you were actually asking about the possibility of your sister filing for AOS back in March.

Thanks for your fast response we never file I-130 for her I was asking if her mom file I -130 does it effect her case if my sister apply again for F1 visa .
Also is it true if F1 student have relatives or family are in the USA they will not issue visa ?
 
Yes, I’m aware you’re asking on this thread about the mother (who recently became a LPR) filing an I-130 for her (like you also asked in a previous post). So are you now saying you, as a USC, never filed an I-130 for your sister a few years ago per this post, or is that referring to another sister?

Yes I never filed for her yet I am assuming to file with my mother since my sister is single and it will take around 7 years right ?
If we file and she apply again for F1 does it effect her I-130 case ?
 
So how come you claimed back in Mar. 2021 you already filed for her a couple of years back? You basically wasted the time of the member who answered your questions back then. Anyway as for your first question, I recommend you take another look at the response provided by the referenced member when you previously asked the same question.
For the second question, applying again for the F1 which is a NIV will have no impact on the I-130 or subsequent IV application. The obstacle your sister needs to overcome is the presumed immigrant intent in order for a NIV to be approved.

Sorry for misunderstanding she was my different sister I just wanted to make sure what is the right way to bring my another sister here , because my younger sister is full time teacher and part time student so I thought best way is to apply her as F1 but unfortunately it’s hard to prove her ties to home country because her brother and sister is here any way thank you very much for your help and time God bless you .

My original visa expire in a couple of months and now my research program PI plans us to attend 2 international conferences in coming years. So I need new stamp and planning to go home to get a new visa stamp filing DS160. But I am concerned since my family is LPR here and they filed application for alien relative for me. How will this affect me? Can my family withdraw this application now, so that I can face the interview without doubt? This is asked in DS 160 whether anybody filed an application for you. In case If they withdraw the application now do I have to wait until getting withdrawal confirmation notice to file DS160 or is it ok if I receive the notice by my interview date? (I am planning to go and get this done during the summer vacation). Please help me, I am half way through my graduate program. I am not very much concerned about my family's application, because I know I can go anywhere with a doctoral degree. All I need is to finish my grad program in another 2 years. Any valuable advice is appreciated.

Withdrawing the I-130 will make no difference to the outcome of the NIV application IMO, as you will still have to answer YES to if anyone has ever filed an immigration petition for you or not on the DS160 form.

Thank you for all the notifications (sorry for the desperate postings) and grateful for providing the answer. I was asking around about this but had not answer. So, If I indicate "yes", will it negatively impact? Does this mean that I can not go out of the country until my grad studies are over?

The way a forum works is to post once and wait for people to come around and hopefully respond. Duplicating the same post wouldn’t get you a response any faster.

It’s not a matter of “if” you say yes. That is the only right way to answer the question. I can’t say with certainty how having a pending immigration petition could impact a new/future NIV application. There have been folks with existing immigration petitions who successfully obtained NIV.

I have no idea as to how they overcame their preconceived immigrant intent. I can’t tell you if you should depart from the US or not before you complete your studies, that’s a call you’ll have to make on your own.

Thank you so much for the reply. It is a very frustrating and complicated situation for me since it affects my studies, even if I apply for F1 or not. If I apply, I might get rejected. If I do not apply also, I would be lagging behind in the field of research.
Again, I appreciate the information on the forums too. I am new here and made couple of additional posts in my desperation. Perhaps, any of the folks who were successful might give me some tips....

I was only asked a handful of questions and am sure I messed up at the "Who is your sponsor question?" I gave a answer which was robotic so perhaps did not show a genuine relationship with my Uncle(based in Zimbabwe) who will be sponsoring my education. I've even held a B1/B2 visa in the past. VO also asked "have you been to the US?" i replied "No but i've held a B1/B2 visa before" which is the truth.

I've gotten my new I-20 for Spring 2025 with even more finances from my uncle. Any idea or tips for my 2nd interview. Plan to go to same school and Same financial sponsor.

You say your parents are PR in SA, but how about you? 214b denial is usually about ties to home/to return after your course is completed. I doubt that a question about your uncle was the reason that you were denied. What can you show the consulate to prove (or strongly suggest) that you will return to SA or Zim after your studies are over?

Well I’m fresh out of high school so not much I can imagine . I applied for PR under my parents a while back but it is still processing though I have the receipt showing that I applied.

I also have positive Visa history as with my previous B1/B2 visa though I had that as a minor so did not need an interview.

Having a visa but not using it isn’t a factor. It would have been a different story if you had visited and returned on time. Unfortunately this is a common issue with student visas, and if I may say, possibly more of an issue for community colleges, so sounds like there’s not much you can do but hope. When is your interview? Please keep us updated.

I mean I applied for the DV Lottery although I won't put all my hopes into that happening. I don't know if it's worth the risk getting 2 denials on my record when I now have 1 denial and 1 approval. I'm also heavily considering Germany for my studies so hopefuly that works out but still contemplating whether it's worth going for a 2nd interview

At the end of the day i cannot afford to go to a 4 year university straight off the bat and will not change my sponsor nor school i'm attending.

If affordability is an issue it’s hard to see why you want to go to college in the most expensive place in the world to do so. I personally don’t see how a community college is a better option than a European university but your choice.

No i have family in the US who have offered to cover my fees and lemme stay with them. Distant enough family that I don’t need to mention in my DS-160 and shoot myself in the foot.

So in actuality I wont be paying anything in USA but its better to save money and go to a CC before transferring

Something is not adding up here. Are you saying you plan to lie on your DS160 about who is paying for your college and living costs while you are in the US? You’re telling them it’s your uncle in zim but actually it’s not? And in actuality you won’t be paying anything but also you can’t afford a 4+year college off the bat (previous post?)

I have a kid who recently graduated college and one about to apply so next year, so I am very familiar with the college landscape and costs. Even two years of a 4-year college, you are at best looking at around $30-40k a year for international student fees even if you stay with family and commute. You cannot get in state residency/tuition fees on a F1 visa. There is very little aid for international students and almost none for transfer students (even domestic ones), which is what you will be coming from a community college. Or are you saying that this “distant family” that you don’t feel is worth mentioning on your DS are prepared to drop $100k or so all in on your education?

By the way, if you get caught lying on a visa application form don’t be surprised to get all future applications denied, if you’re lucky enough to not get a permanent ban.
