wait till submitting citizenship application

Hello friends. A friend of mine told me today that he recently met two people who got their GC thru asylum but submitted their citizenship application 5 years after the asylum grant and not the GC date and their citizenship was approved!!! Has anybody ever heard such a case???

There have been rumors in this forum about that, I asked my attorney and he said NO WAY. Anyway I don't trust my attorney. So no idea what the truth is. The problem is that is always a friend's friend, never had a testimony from the person that did it, maybe THANKFUL can help us with this issue.

In case of asylee the AOS decision is backdated to 1 year from the actual date the GC was granted (and that backdated date is included into GC in the "residence sinse" row). So, you can apply for naturalization 4 years and 9 months after that date, or, what is the same, 3 years and 9 months after the date GC was granted.

However, it is absolutely impossible to get GC just for 1 year and 3 months after entry (you have to wait 1 year with application, and 3 months is not enough for processing time).

So, there is only a small portion of truth in what you said - that the time starts not from the date of AOS decision. All the rest is not correct.

However, in case of refugee (vs asylee) the situation is different. GC is backdated to the date of entry to the US then. So, 4 years and 9 months are counted from the date of entry.

This is simply not possible. The law is clear on this. And when USCIS approves a citizenship case they have stringent internal control measures so it is almost inconceivable that an officer can make a mistake.

BTW, I know a friend of friend who went to Mars and came back to earth last night.

Do we know the same people?
